The left and the right are spinning the Supreme Court's decision to suit their own bias, not to objectively report what's so as authentic journalists. Here's my best journalistic understanding of their decision. If you are aware of my having gotten something wrong, please describe it and provide citations for your understanding from the Supreme Court decision itself, not from someone's biased interpretations of the decision.

The ruling that a former president has absolute immunity for their core constitutional powers, but not for unofficial acts, should come as no surprise. Core constitutional powers include recognizing ambassadors and foreign governments. Nothing about this part of the ruling should be considered controversial.

What are a President's "core constitutional powers?" They include:
- Sign or vetoing legislation
- Commanding the armed forces
- Asking their Cabinet for written opinions
- Convening or adjourning Congress
- Granting reprieves and pardons
- Receiving ambassadors and other foreign affairs functions not otherwise granted to Congress or shared with the Senate, such as controlling the formation and communication of foreign policy and directing the nation's diplomatic corps
- Ensuring that the laws are faithfully executed
- The power to appoint and remove executive officers, make treaties (although these must be ratified by two-thirds of the Senate)
- The power to appoint Article III judges and some officers, but only with the advice and consent of the U.S. Senate, although when the Senate is in recess, they may make a temporary appointment.

Trump had claimed that all actions he took while in office were immune from prosecution. The Supreme Court disagreed with him, finding that a President has no immunity for actions that are not deemed "official." Nothing about this part of their ruling should be considered controversial.

This, in a nutshell, means that the Supreme Court is leaving it to lower courts to determine which of Trump's alleged or confirmed actions are and aren't “official” actions. For instance, the Supreme Court left it to Washington, D.C., appeals court to determine whether or not Trump’s pressure on state-level officials and campaign aides to create fraudulent slates of Electoral College electors in states he had, in fact, lost, were "official" Presidential actions.

Chief Justice Roberts, on behalf of the Supreme Court's majority opinion, wrote: “The president enjoys no immunity for his unofficial acts, and not everything the President does is official. The President is not above the law. But Congress may not criminalize the President’s conduct in carrying out the responsibilities of the Executive Branch under the Constitution.” He also added that this immunity "applies equally to all occupants of the Oval Office, regardless of politics, policy, or party."

The Supreme Court decision returns Smith’s case to lower courts. They must now review whether the specific steps Trump took in an attempt to overturn the results of the 2020 election do or don't constitute responsibilities of the executive branch under the Constitution. If lower courts decide that these steps fall within the responsibilities of the executive branch under the Constitution, those courts must drop those charges against Trump. If they find that those steps do not fall within the responsibilities of the executive branch under the Constitution, those courts must allow those cases against Trump to proceed.

The majority opinion also specified that whatever the court deems as "official acts" cannot be introduced as evidence in a potential trial, and that the lower courts may not consider a former president’s motives when deciding whether their actions do or don't exceed the responsibilities of the executive branch under the Constitution.

They majority opinion also found that Trump’s conversations with the Justice Department about whether or not there was sufficient fraud to call the results of the 2020 election into question do fall within the responsibilities of the executive branch under the Constitution. Roberts wrote that a President's "power to remove ‘executive officers of the United States whom he has appointed’ may not be regulated by Congress or reviewed by the courts.”

In contrast, the majority opinion found that since Trump’s pressuring of then-Vice President Mike Pence had to do with Pence's role as president of the Senate, prosecutors could attempt to prove that these actions of Trump’s are not immune. Wrote Roberts: “It is ultimately the Government’s burden to rebut the presumption of immunity. We therefore remand to the District Court to assess in the first instance, with appropriate input from the parties, whether a prosecution involving Trump’s alleged attempts to influence the Vice President’s oversight of the certification proceeding in his capacity as President of the Senate would pose any dangers of intrusion on the authority and functions of the Executive Branch.”

The minority Supreme Court opinions included comments like these from Justice Sotomayor:
- In "every use of official power, the President is now a king above the law."
- “Orders the Navy’s Seal Team 6 to assassinate a political rival? Immune. Organizes a military coup to hold onto power? Immune. Takes a bribe in exchange for a pardon? Immune. Immune, immune, immune.”

Justice Barrett wrote that "a President facing prosecution may challenge the constitutionality of a criminal statute as applied to official acts alleged in the indictment. If that challenge fails, however, he must stand trial.” She also wrote that there was no reason to depart from the “familiar and time-tested procedure” that allows evidence from Trump’s official acts to be included in evidence introduced into trials.

It seems clear that this ruling gives presidents broad authority to use — or abuse — presidential power, particularly in their dealings with other executive branch officials.

Lastly, the majority found that Trump is not immune from legal prosecution simply because he was previously impeached and acquitted by the Senate. Roberts wrote: "Impeachment is a political process by which Congress can remove a president. Transforming that political process into a necessary step in the enforcement of criminal law finds little support in the text of the constitution or the structure of our government."

Therefore, the question that the lower courts must now answer is which of Trump's acts were official as part of a President's core constitutional powers, and which of his acts were unofficial.

Time for me to reiterate this: The Idiocracy Spell is society’s single biggest pandemic and threat.

Ideological rightness addiction leads people into malinformed yet adamant opinions, and to view anyone who doesn’t share their opinions as an idiot at the very least, and quite possibly as a danger to society who needs to be attacked and canceled.

We’re long overdue in breaking this Idiocracy Spell, individually and collectively. The longer we wait to stop being run by this spell, the more imperiled our republic will become.

It’s long past time to wake up and wise up to how the “Dunning-Kruger Effect” combines with “Confirmation Bias” to produce widespread socio-political illiteracy across the ideological spectrum.

WHEN IDEOLOGY TRUMPS FACTS, REVISIONISM TRUMPS HISTORY... AND REPUBLICS DIE PAINFUL DEATHS

Sarah Matthews, who was a deputy press secretary in President Trump’s White House, reflecting on January 6, 2021, “…if you would have told me that people would have been whitewashing the events of the day or spreading all kinds of conspiracy theories, I would not have believed you... We saw these people violently attacking police officers. To whitewash and downplay the events is so frustrating because if they took place in any other country, we would be calling it a coup attempt.”

I completely trust that some of the protesters remained nonviolent in their words and actions, attacked no one, and did no damage. It is also incontrovertibly clear, no matter what denialists claim, that some were violent in their words and actions, attacked police, and did damage to the Capitol Building that houses the United States Congress. The fact that some were nonviolent protestors can never be used as a shield to excuse those who were violent insurrectionists.

Peaceful Protest or Violent Insurrection?
The events of January 6, 2021, and the subsequent ideologically biased narratives about them, are modern-day examples of the power of Manufactured Consent.

Manufactured Consent is a covert manipulation tactic designed to propagandize us into supporting products, services, causes, and candidates, while we're believing we’re doing this out of our own free will. This highly honed subversive technique is a centerpiece of the ongoing "Battle for Your Brain, Hijacking of Your Heart, and Subversion of Your Spirit."

All the News That Fit to Spin
In today's atmosphere of fake journalism, ideology-supporting narratives fueled by manufactured consent pretend to be news stories. In contrast, authentic journalism is an honest effort to report in an objective and balanced way. All else that is not authentic journalism is commentary not news. Narratives are biased commentaries not objective reporting. Positioning narratives are though they're journalism undermines the wellbeing of supposedly free societies.

We Tend to Sympathize With and Even Justify the Violent Who Seem to Share Our Ideology
Excusing hate-filled violence among those who seem to believe as we do is a profoundly dangerous human tendency that exists across the ideological, religious, and political spectrums. In reality, it is the moral and ethical responsibility of those who hold a particular belief to contain, and if necessary excommunicate, the violent extremists who are embedded among them.

Refusing to recognize and learn lessons like these that are embedded in what happened on January 6, 2021, will keep us at high risk of perpetuating the insanity that imperils our republic. It's time to end this insanity.
