BREAKING DOWN THE CHANGES TO THE EMPLOYEE RETENTION TAX CREDIT IN THE NEW COVID RELIEF BILL PART 2
Computational Changes from 2020 to 2021
Old: For 2020, Section 2301(a) of the CARES Act allowed an employer to claim a credit of 50% of qualified wages.
New: For 2021, Section 207(b) amends Section 2301(a) of the CARES Act and increases the credit percentage from 50% to 70%.
Old: For 2020, Section 2301(b)(1) of the CARES Act capped the “qualified wages” that could be paid to any one employee at $10,000 for ALL quarters.
New: For 2021, Section 207(c) amends Section 2301(b)(1) of the CARES Act and increases the maximum amount of creditable, qualified wages to $10,000 for ANY quarter.
Old: To be eligible for a credit, an employer needed to experience at least one quarter in 2020 in which 1) operations were fully or partially suspended by government order, or 2) the business experienced a precipitous drop in gross receipts.
New: Section 207(d)(1) makes significant changes to the gross receipts test of Section 2301(c)(2)(A)(ii)(II). For 2021, the test is satisfied for any quarter of the first half of 2021 in which gross receipts is less than 80% of the same quarter in 2019.

REMINDER - NEW EMPLOYEE RETENTION TAX CREDIT PROVISIONS TAKE EFFECT JULY 1, 2021!!!
As a reminder, the American Rescue Plan Act (ARPA) signed into law in March extended the Employee Retention Tax Credit (ERTC) through Dec 2021 and made a number of relatable changes.
The ERTC remains key support available to businesses seeking to recover from the effects of the COVID pandemic, potentially returning $28,000 per employee to qualifying employers for wages paid in 2021
On March 11, 2021, the ARPA was signed into law to provide further support affected by the COVID-19 pandemic.
Employers may qualify if their operation was at least partially suspended due to orders from the government authority related to COVID-19 or can demonstrate that gross receipts for a calendar quarter declined by at least 20 percent (generally compared to the same calendar quarter in 2019)

HOW NEW STARTUP BUSINESSES CAN POSSIBLY CLAIM THE ERTC???
Businesses that open their doors in 2020 or 2021 may be eligible for a tax credit worth up to 70 percent of their employee wages paid from June to December 2021. The American Rescue Plan Act (ARPA), which was passed in March 2021, extended and expanded one of the most popular business tax incentives: the Employee Retention Tax Credit (ERTC).
The centerpiece of ARPA's expansion was the Recovery Startup Business Provisions.
The original ERTC, enacted by 2020's CARES Act, required either a government-mandated shutdown or a substantial revenue decline due to COVID-19 compared to the same quarter in 2019. Startup businesses had nothing to compare. They could not qualify for the ERTC under the old revenue decline rules. ARPA added a new eligibility component allowing eligible startup businesses to qualify for the third and fourth quarters in 2021.
For new businesses that startup during the pandemic, the Recovery Startup Business Provision can open opportunities for increased cash flows.

Relaxed Standards For Eligible Businesses
Businesses of all sizes can qualify for the ERTC. There are a variety of factors that the IRS uses to determine if a private-sector business or tax-exempt organization is eligible for the tax credit. These factors have changed over time since the ERTC was introduced in 2020. As of now, the following criteria are used for eligibility:
1) A full or partial suspension of trade or business operations during 2020 or 2021 due to government orders stemming from COVID-19.
2) A decline in gross receipts of more than 20% (previously 50%) during a calendar quarter in 2020 or 2021 when compared to the same quarter from the 2019 year.
