The Supreme Court (SC) resumed on Monday hearing a set of petitions against a newly enacted law aimed at limiting the powers of the Chief Justice of Pakistan (CJP).

The eight-member larger bench CJP Umar Ata Bandial, Justice Ijazul Ahsan, Justice Munib Akhtar, Justice Mazahar Ali Akbar Naqvi, Justice Muhammad Ali Mazhar, Justice Ayesha Malik, Justice Syed Hasan Azhar Rizvi and Justice Shahid Waheed.

During today’s hearing, Attorney-General of Pakistan (AGP) Mansoor Usman Awan informed the court that a plea had been filed for the formation of a full court to hear the case.

Justice Ahsan replied that the request had not been scheduled for a hearing yet. The judge then inquired whether the AGP had provided the documents that the court had requested during the previous hearing.

The bill, titled the Supreme Court (Practice and Procedure) Bill 2023, was passed by the National Assembly on April 21 and sent to the President for assent amid a standoff between the government and the judiciary over elections in Punjab and Khyber Pakhtunkhwa.

But the president had returned the Bill to the Parliament for reconsideration.

According to the law, the CJP can no longer take suo moto notice in an individual capacity. Rather he and two senior judges need to make the decision together.

On April 13, the top court barred the government from enforcing the draft law, saying the move would “prevent imminent apprehended danger that is irreparable”.

During the previous hearing on May 2, the CJP had said that political parties wanted to “pick and choose” the Supreme Court bench for “desired judgments”.

He had gone on hunger strike several times after previous arrests, including a 55-day strike in 2015 to protest his arrest under so-called administrative detention, in which suspects are held indefinitely by Israel without charge or trial.

Israel is currently holding more than 1,000 Palestinian detainees without charge or trial, the highest number since 2003, according to the Israeli human rights group HaMoked.

ISLAMABAD: Prime Minister Shehbaz Sharif on Wednesday affirmed the ruling coalition’s position on holding dialogue with Pakistan Tehreek-e-Insaf (PTI) through the Parliament instead of “arbitration” by the Supreme Court with regard to holding polls on the same day across the country later in October or November.

The prime minister was addressing a meeting of the ruling coalition partners at the PM House ahead of the apex court deadline which expires today (Thursday) about explaining its position with regard to holding of talks with the PTI on countywide polls on the same day.

In a televised address to the meeting, Shehbaz Sharif said that the coalition partners discussed the prevailing challenges to the country and the steps taken by the National Assembly and the joint sitting of the Parliament in line with the Supreme Court’s previous directions for addressing the challenges.

“It was a consensus decision that we accept the verdict given by 4-3 and not by the 3-2 or 5-2. And we still believe that the decision was by the 4-3, but the Supreme Court wants to proceed with the matters with its three-member bench. So, we once again got together today to reiterate our previous position,” he added.

On the dialogue with the PTI, he said that there is an overwhelming opinion within the ruling coalition that the doors of the dialogue should not be closed and there is an opinion that the coalition can convey its stance to the opposition through the Speaker National Assembly.

“Then a parliamentary committee can take up the matter so that the nation gets to know that the allied government has made all-out efforts to ensure everyone unites on holding elections across the country on one-day,” he said, adding that, unlike PTI, the coalition never make anything a matter of “ego”.

Around 427 Pakistanis have reached Port Sudan, a port city in eastern Sudan, for repatriation as the North African country continues to work with Islamabad's missions in the region to provide relief to Pakistanis, APP reported.

Fighting in Sudan has triggered a humanitarian crisis in the impoverished country, where millions of people have been left without access to basic services.

At least 420 people have been killed since the fighting broke out on April 15, four years after long-ruling autocrat Omar al-Bashir was toppled.

Amid the clashes, the Pakistan Embassy building in Sudan was hit by at least three bullets, the Embassy said in a statement earlier, advising Pakistanis to avoid leaving their homes

“All Pakistanis are once again advised to stay at home and avoid unnecessary outgoings due to deteriorating security situation,” the statement read.

In the statement today, the FO said it continues to follow the developments in Sudan and was working with Pakistan’s Missions in the region.

Meanwhile, other countries have also started evacuating their citizens from Sudan. British Prime Minister Rishi Sunak said that the country’s armed forces evacuated diplomatic staff and their family members from Sudan.

Sunak paid tribute to what he called a “complex and rapid” evacuation after he said there had been a significant escalation in violence and threats to embassy staff. But British nationals living in Sudan were not rescued.

ISLAMABAD: Pakistan has placed its first order for discounted Russian crude oil under a new deal struck between Islamabad and Moscow, the country’s petroleum minister said, with one cargo to dock at Karachi port in May.

The deal will see Pakistan buy crude oil only, not refined fuels, and imports are expected to reach 100,000 barrels per day if the first transaction goes through smoothly, Minister Musadik Malik told Reuters on Wednesday night.

“Our orders are in, we have placed that already,” he said.

“Yes it is true that we will be getting only crude, not refined oil,” Malik said in response to confirm sources information whether that’s correct.

He said Pakistan Refinery Limited (PRL) will initially refine the Russian crude, with other refineries to be included later after a trial run.

Russian Energy Minister Nikolay Shulginov led a delegation to Islamabad in January to hold talks on the deal, after which he said oil exports to Pakistan could begin after March.

At the time, Shulginov also said Pakistan will pay for crude oil purchases in currencies of friendly countries.

“We have agreed that the payments will be made in the currencies of friendly countries,” he had said at a joint news conference with Pakistan’s Economic Affairs Minister Ayaz Sadiq in January.

He did not specify the ‘friendly countries’ and neither of the two ministers gave details on the size of the planned purchases.

ISLAMABAD: The country’s textile group exports declined by around 12.40 percent during the first nine months (July-March) of the current fiscal year 2022-23 and remained at $12.476 billion as compared to $14.242 billion during the same period of last year, the Pakistan Bureau of Statistics (PBS) said.

The data of exports and imports released by PBS revealed that the country’s textile group exports witnessed a decline of 22.61 per cent in March 2023 on a year-on-year basis and remained at $1.257 billion when compared to $1.625 billion during the same month of last year.

Jul-Feb textile group exports dip 11.09pc YoY

Cotton yarn exports registered 36.92 per cent negative growth in July-March and remained $573.084 million compared to $908.487 million during the same period of the last year. On a year-on-year basis, cotton yarn exports registered 26.32 per cent negative growth, while on a MoM basis, it registered 22.43 per cent growth.

Rice exports declined by 10.79 per cent during the first nine months of 2022-23 and remained $1.598 billion compared to $1.791 billion during the same period of the last fiscal year.

The country’s overall exports during July-March, 2022-23 totalled $21.051 billion (provisional) against $23.350 billion during the corresponding period of last year showing a decrease of 9.85 per cent. The exports in March 2023 were $2.372 million (provisional) as compared to $2.191 billion in February 2023 showing an increase of 8.26 per cent but decreased by 14.58 per cent as compared to $2.777 billion in March 2022.

Main commodities of exports during March 2023 were knitwear (Rs87,269 million), readymade garments (Rs77,456 million), bed wear (Rs55,154 million), rice others (Rs48,799 million), cotton cloth (Rs44,260 million), towels (Rs22,077 million), rice basmati (Rs19,467 million), cotton yarn (Rs19,073 million), sugar (Rs17,389 million), and fish and fish preparations (Rs15,325 million).

In a clear violation of the Supreme Court's order, the National Assembly on Monday approved the election summary sent by the Standing Committee on Finance and Revenue regarding the non-provision of funds to the Election Commission of Pakistan (ECP), Aaj News reported.

The development comes after the National Assembly (NA) Standing Committee on Finance and Revenue on Monday sent the issue pertaining to funds for Punjab and Khyber-Pakhtunkhwa elections back to Parliament.

Minister of State for Finance and Revenue Dr Aisha Ghaus Pasha told reporters after the meeting that the State Bank of Pakistan (SBP) and the Finance Division had no authority to release funds from the Federal Consolidated Fund (FCF).

Earlier, sources in the SBP told Business Recorder on Sunday that on the Supreme Court’s order, the SBP had decided to hold the required amount from the government’s treasury to ensure the availability of the funds for the elections in the two provinces on May 14.

The Supreme Court’s deadline to release Rs21 billion for the polls ends today for which a special meeting of the NA Committee was called.

According to Dr Pasha, Parliament's approval is required prior to the allocation of the funds.

“Without the approval of Parliament, no bill or budget has any legal authenticity,” she stressed. “Hence, we leave the entire matter to Parliament now. The Parliament is supreme for us because this is what is written in the Constitution.”

She clarified that the SBP could allocate the funds but it cannot release them before Parliament's approval.

The International Monetary Fund (IMF) said it is looking forward to obtaining the necessary financing assurances as soon as possible to pave the way for successful completion of the 9th Extended Fund Facility (EFF) review, a statement that comes after Pakistan secured $3 billion in fresh inflow from Saudi Arabia and the UAE.

“We welcome the recent announcement of important financial support to Pakistan from key bilateral partners,” Nathan Porter, IMF Mission Chief to Pakistan, was quoted as saying in a statement to Business Recorder.

“During the meetings between the Pakistani delegation and IMF staff and management, there was agreement on the need to maintain strong policies and secure sufficient financing to support the authorities’ implementation efforts.

“The IMF is supporting these efforts and looks forward to obtaining the necessary financing assurances as soon as possible to pave the way for the successful completion of the 9th EFF review.”

Porter’s statement did not give details on the additional financing amount, but implied that the staff-level agreement could still be a few steps away for Pakistan as the country is required to arrange fresh foreign exchange inflow.

Before the new bilateral support, reports suggested that at least $5 billion of inflow was required to be arranged – even after the narrower current account deficit.

China’s rollover of $2 billion, and refinancing of another $2 billion – which included $1.3 billion from the Industrial and Commercial Bank of China (ICBC) and $700 million from China Development Bank – is not categorised as a new inflow.

On Friday, Pakistan had announced financial support from the UAE, days after Minister of State for Finance Aisha Ghaus Pasha also said Saudi Arabia had assured the IMF it will provide a $2 billion loan to the South Asian country.
