Protest vs. PFP officials evolves into criminal suits

CRIMINAL suits have been filed against South Cotabato Governor Reynaldo Tamayo Jr. and two other officers of the ruling Partido Federal ng Pilipinas (PFP) for alleged falsification of public documents and violation of the cybercrime law.
Complainant Abubakar Mangelen, said to be the founding chairman of the PFP, filed his complaint at the Manila City Prosecutor’s office on July 5 in what appeared to be an evolution of his protest against the candidacy in 2022 of now President Ferdinand Marcos Jr. which the Commission on Elections had not acted upon in the petitioner’s favor.
Mangelen, a retired police officer and former commissioner of the National Commission on Muslim Filipinos, accused Gov. Tamayo, Thompson Lantion, and George Briones, PFP president, secretary-general and legal counsel, respectively, of allegedly falsifying documents and violating the cybercrime law.
In his affidavit, Mangelen said the respondents allegedly committed falsification twice using falsified documents in a purported amended Constitution and By-Laws (CBL) of PFP in the Comelec En Banc proceedings in 2022 and 2024. The falsified documents were affixed with his e-signature without his authorization, he added.
He said the alleged falsification involved the use of a computer system in violation of Article 172 about Article 171 of the Revised Penal Code, and Chapter 11, Section 6 of RA 10175 otherwise known as the Cybercrime Law.
Mangelen was reportedly elected PFP national chairman when the party was organized on April 21, 2018, in General Santos City, with the original CBL submitted to Comelec on April 30, 2018. On Oct. 5, 20218, the Comelec accredited the PFP as a national political party, it was learned.
On September 18, 2021, a PFP national convention was held in Tupi, South Cotabato where Tamayo, Lantion, and Briones were elected as party president, secretary general, and legal counsel, respectively. The PFP chairmanship was left vacant for then-senator and now President Marcos Jr.
When the Comelec started receiving certificates of candidacy for President, Mangelen protested the use of the PFP by Marcos as his official party without the complainant’s knowledge and authority. The poll body en banc ostensibly ruled out his protest, it was learned.
Mangelen submitted as evidence a copy of the party resolution No.001, series of 2021, dated September 23, 2021, purportedly showing Gov. Tamayo’s election as among the party’s national officers.
He said that in April or May 2024, he discovered there was falsified PFP CBL, which was used by the respondents when they filed the party’s petition for accreditation as one of the 10 major political parties on May 9, 2022 elections before Comelec.
“It makes it appear that a National Assembly and Convention meeting took place wherein the original PFP CBL of 2018 was amended to become the 2022 CBL, while the provisions thereof cause it to appear, among others, the term of office of PFP national officers, is 3 years instead of 2 years under the same section 2 of Article XVII,” he said.
Mangelen said that his e-signature was allegedly used in the amended CBL without his knowledge or authorization.
He added that last May 2024, the respondents again used the falsified PFP CBL as “evidence-in-chief” in another Comelec proceeding docketed as E.M No. 24-002 filed against Tamayo, Lantion, and Briones by several party officers led by new PFP national president Atty. Leandro Verceles Jr and new Secretary-General Antonio Rodriguez Jr.
Other PFP incumbent original regional officers have reportedly executed affidavits stating that no national assembly or convention ever took place purposely to amend the original 2018 PFP CBL.
