Former solon vs. ex-justice: People’s initiative constitutional, seeks simple amendment, not substantial revision

The people’s initiative to change the 1987 Constitution by having both Houses of Congress vote jointly is constitutional, as it seeks a simple amendment and not a substantial revision of the country’s fundamental law, according to former congressman Alfredo Garbin Jr.

The former Ako Bicol Party-list representative was reacting to the opinion of retired Supreme Court Associate Justice Antonio Carpio that the signature collection being carried out by the People's Initiative for Reform Modernization and Action (PIRMA) is unconstitutional as it introduces revisions and not amendments to the basic law of the land.

“The Supreme Court laid down two tests to determine whether a proposed change is an amendment or revision. These are the quantitative and the qualitative test. I submit that when pitted against these two tests, the proposed change is merely an amendment, capable of being introduced by the people directly,” said Garbin, who chaired the House Committee on Constitutional Amendments in the 18th Congress.

He explained that the quantitative test only looks at the number of provisions that will be changed or affected. He said that this test asks whether the proposed change is so extensive as to substantially change the Constitution.

“Broken down in layman’s terms, the quantitative test looks at the number of provisions that will be changed; if numerous, then it can be argued that the change is a revision. This movement only seeks to change a single sentence,” said Garbin, who is also petitioner in PIRMA’s people’s initiative.

The group's signature drive seeks to change the provision on changing the Charter to explicitly state that Congress vote jointly as a constituent assembly.

On the other hand, Garbin said the qualitative test “looks into whether the proposed change will accomplish far-reaching changes in the nature of our basic governmental plan as to amount to a revision.”

Former Justice Carpio, in his argument against PIRMA’s people’s initiative, said that the ongoing signature drive will fundamentally change the basic governmental plan, including its three branches framework and the powers of these branches.

Garbin argued that the ultimate system of checks and balances rests on the people, as a plebiscite will in the end determine the people’s decision.

“But a careful scrutiny of the Constitution reveals that the system of checks and balances will not be altered by this proposal when it comes to amendments and revisions. The system is set by the Constitution itself when it imposed that a plebiscite should be held for the particular purpose of introducing changes, where the majority of the votes cast will decide the fate of the proposal. This was not changed or even touched upon by the proposed amendment,” Garbin said.

“The question now is ‘who has the better moral and Constitutional authority to perform the checks and balances than the sovereign Filipino people themselves?’ Let the people decide,” he stressed.
