Skilled Migrant Category (SMC) Visa Review

Immigration Minister Kris Faafoi is considering a revamp of New Zealand's largest residence programme.

He says a review of the skilled migrant category is a priority.

The review could look at adjusting settings, such as minimum renumeration limits for lower-level skilled jobs.Or it could be something more wide-ranging.

No decision has been made on re-starting the selection of expressions of interest (EOI) for skilled workers, Faafoi said, but that would be looked at again by the end of next month.

The NZ Government signed deals with the University of Oxford/AstraZeneca and Novavax to bring in an additional 18.3 million doses. Both of these vaccines require two doses, meaning that over nine million people will be able to be vaccinated.

Prime Minister Jacinda Ardern has said: "We now have agreements in place with four providers, covering three different types of vaccine technology and we have secured more than enough doses to cover our entire population plus the Pacific."

Government officials announced that free doses will be provided to Tokelau, Cook Islands, Niue, Samoa, Tonga, and Tuvalu, according to NPR.

New Zealand has widely been praised for its response to coronavirus.

Nearly quarter of all partnership-based work visa applications 👫 are from applicants holding Indian passports 🇮🇳, followed by Philippines 🇵🇭 and China 🇨🇳. Although the approval rate is higher 📈 compared to last year, many new processing trends have emerged at Immigration New Zealand, including detailed interviews with the applicant (and the supporting partner), and this is even the case for some of the more well-established relationships.

The Government has announced that the Managed Isolation Allocation System is becoming fully booked prior to Christmas.
If you know someone overseas who is about to travel New Zealand during the COVID-19 pandemic, please make sure they are aware of the border restriction and isolation requirements.

All travellers entering New Zealand are required to:

- obtain a managed isolation voucher via the new allocation system.

- go into ‘managed isolation’ in a government-provided facility (hotel), or

- if you have COVID-19 symptoms, go into a quarantine facility (separate hotel).

You will need to stay there for at least 14 days. This will prevent any further unmanaged COVID-19 infection coming into New Zealand. You can’t self-isolate at home, or take a domestic flight before the 14-day period is completed.

Temporary Visa Suspension Extended - Update by Immigration New Zealand

Temporary visa suspensions for overseas applicants.

The current suspension of overseas applications for most temporary visas has been extended until February 2021.

The following offshore temporary entry class visa applications are not affected:

• relationship-based visas for partners and dependent children of New Zealand citizens and residents
• visas for diplomatic, consular and official staff and accompanying dependants
• Antarctic Traveller Visitor visas and Antarctic Work visas
• Recognised Seasonal Employer (RSE) Limited visas.

This measure was introduced on 10 August to prevent applications from those ineligible to enter the country due to current border restrictions.

The suspension is reviewed by the Government every month.

Many overseas-based partners of New Zealanders (and NZ based temporary migrant workers) who were earlier caught-up in a sudden policy change in Immigration NZ's assessment of partnership visa applications are devastated by the recent border closures that have once again created another roadblock in joining their partners, albeit this time, despite having their visas genuinely approved.

The frustration and the anguish within a small, but a "real" community who had earlier in 2019 endured the sudden changes in the manner Immigration New Zealand processed partnership visa applications, that had resulted in abrupt rejections of thousands of applications, is once again flaring-up after they were deemed ineligible to get an exception from strict border controls in place as a response to the covid-19 pandemic.

Changes to Accredited Work to Resident Visa - Good or Bad?

The Government has finally made the announcement we have all been waiting for regarding changes to Work Visa policy. The biggest news is that people applying for Work to Residence Visas from October 7th 2019 will require a job offer with a minimum salary of $79,000 per annum. This brings the policy in line with it's initial intention to cater for employers supporting highly skilled workers, as average pay rates have increased since the program was first introduced.

Current instructions require applicants for a Work to Residence (accredited employer) work visa to include in their application a job offer meeting the following requirements:

- for employment in in the accredited employer's core area of business activity and under the direct responsibility of the employer;
- for a period of at least 24 months;
- for full-time employmentj
- for a position meeting the minimum salary threshold.

These changes will not affect work to residence work visas that have been already been issued or that have been submitted before October 7th, which will be accepted even with a salary of $55,000 per annum or higher.

Such a significant increase will affect especially lower skilled workers performing in the core area of activities of accredited companies, whose jobs are vital for the business’ operations but for which the employers are unable to meet such a high salary threshold.

These migrants’ only possibility to obtain a more permanent immigration status in New Zealand currently lies almost exclusively in the Work to Residence system and in the pathway to residence that this visa offers.

These migrants will now, most likely, have the low skilled Essential Skill Work visa as their only valid option to work in New Zealand, and will be unable to obtain any security regarding their immigration status and duration, their welfare benefits or the possibility to migrate with their family.

In conclusion, the new Work to Residence work visa policy will undoubtedly deprive New Zealand of the stable presence in the country of a significant and necessary workforce.
