Eva Nissioti, who writes her PhD at both the Erasmus School of Law and the Hamburg Institute for Law and Economics, as part of the European Doctorate in Law and Economics programme, is joined by Professor Louis Visscher from the Rotterdam Institute for Law and Economics, to discuss new forms of .

Ensuring access to justice may be costly for societies, yet without adequate access to justice the incentive effects of law may be weakened. Can equity and efficiency be achieved at once by changing our approach to litigation? And can this be supported, in part, by the availability of online platforms?

Episode 3 of Law Out Loud is out now: “Mathijs and Piebe: High Frequency Trading in Financial Markets”.

EGSL PhD researcher Mathijs Giltjes challenges expert and advocate Piebe Teeboom – Secretary General of FIA European Principal Traders Association - on several issues relating to high frequency trading in financial markets. What is high frequency trading and what role does it play in modern financial markets? Can high frequency trading increase risks for market manipulation or insider dealing in some cases?

The discussion in the episode touches upon both the benefits and risks posed by high frequency trading. This practice, made possible by algorithmic trading technology, is argued to provide liquidity to markets where that is sorely needed, and to cut transaction costs, increasing efficiency. On the other hand, some have expressed concern that firms engaged in high frequency trading may profit from market volatility - including during the onset of the COVID-19 pandemic in early 2020. Whilst some traders find they have an edge due to the adoption of new technologies, others feel they are left behind. The question arises whether those at the front of the technology race should be restrained by law. Is further regulation needed? In episode three of Law Out Loud, Mathijs challenges Piebe on various tricky aspects related to high frequency trading and is met with some well-argued responses.

Episode 2 is now available on Spotify: Tita and Xandra “Choice of Law in International Commercial Contracts.”
Erasmus Graduate School of Law PhD researcher Priskila Penasthika and Professor Xandra Kramer discuss and the case of .
Globalisation has brought a huge increase to cross border trade in recent decades, and Priskila (better known by her nickname ‘Tita’) sets out the significance of ‘choice of law’ when undertaking cross border transactions. Xandra and Tita then go on to consider various instruments of private international law, such as the Rome I and II regulations of the European Union, the Mexico Convention applying to Latin America, and the 2015 Hague Principles on Choice of Law in International Commercial Contracts. There have been difficulties fostering universal uptake of these instruments, and Tita explains her PhD research project which involves identifying reasons why some courts reject a choice of foreign law. She and Xandra then discuss the case of Indonesia, its aspirations to become the world’s 5th largest economy, and changes which may need to be made to its rules governing choice of law if it is to achieve that goal.
