PUTTING THE NARRATIVE STRAIGHT OVER POLICE ILLEGAL INVASION OF PEACE CORPS OF NIGERIA'S HEADQUARTERS AND THE UNLAWFUL ARREST OF DR DICKSON AKOH AND OTHERS
For the sake of clarity and to avoid possible misrepresentation of facts surrounding the tenancy of the property under contention in Jabi, Abuja. It is pertinent to come out straight to state the lingering forth and back struggles that has characterised the said property in the proceeding years.
The landlord has often deviced crooked ways, (sometimes, using the security agencies and at other point approaching the Court to get hand twisted Order) to eject the organization out of the property even before expiration of its rent.
Peace Corps of Nigeria leased the property located at No. 57 Iya Abubakar Crescent, Jabi from the Landlord's Agent and had since renovated the dilapidated structure to it's present state before commencement of usage as it's Headquarters in 2017 before Police unfortunate sealing of the office for (3) years.
Within the period of police occupation of the said office cm the kangaroo trial of the organization before the Federal High Court, Abuja which the organization later won, frantic efforts was made to have the landlord in court to testify of his ownership of the said property that police wanted the federal government to confiscate but to no avail. He didn't just declined, but remained in hiding.
It was in May, 2023 that the Landlord, First Choice Global Ventures Limited in connivance with the Agent, First Icon Limited surreptitiously sneaked to FCT High Court, Gudu after several similar attempts to secure a Consent Judgement without the knowledge of Peace Corps of Nigeria to forcefully eject Peace Corps from the property even though the rent hasn't expired yet. On the 16th of Feb. 2024, First Choice Global Ventures executed the fraudulent consent judgement obtained through deceit and evicted Peace Corps of Nigeria from the said property.
As a law abiding organisation, Incorporated Trustees of Peace Corps of Nigeria approached same FCT High Court, Gudu presided by Hon. Justice Adamu to set aside the consent judgement. Counsel on behalf of Peace Corps submitted that the Honourable Court has the inherent powers to set aside its own judgement where it is a nullity or where it is obtained by fraud. Having looked at the merit of the case and realised that he was misled into giving the consent judgement where the tenant was wrongly omitted from the proceedings that led to the judgement, he consequently set aside the warrant of possession judgement.
In the words of Hon. Justice Adamu " from the facts and evidence deduced from this case, the Applicant (Peace Corps)who is a sub-lessee of this judgement is a necessary party and was unfairly excluded from the proceedings. In essence, the absence of necessary parties connotes lack of fair hearing. The law is that the failure to join a necessary party is a procedural irregularity which does not affect the competence or jurisdiction of the court to entertain the matter".
He further said, "this case which is an ordinary issue of recovery of possession has been inundated with several unnecessary issues in various courts and has clearly deviated from the main issue of tenancy. Accordingly, any of the parties who feels he is entitled to the recovery of premises is free to file for recovery in this Court or any other Court".
Going by the above, the subsisting Court Order grants total right of continuous occupancy of the property to the Peace Corps of Nigeria pending the expiration of its rent. It is unimaginable that the same Landlord that approached the appellate court to appeal the same matter could involve the police in this high illegality.
It is therefore most unfortunate that a civil matter that has been settled by a competent court of law, where any of the parties who feels dissatisfied has the fundamental rights to approach a higher court for appeal, now has the police paid by tax payers money intimating and harassing law abiding citizens in this uncivilised manner.
Most unfortunate was the gestapo style invasion, vandalization and high handed harassment and adoption of the National Commandant, Peace Corps of Nigeria, Dr Dickson Akoh and (15) fifteen others as response to allege complaint file by the landlord before the police. Should Nigeria Police take the law into it's hand in the manner they are doing?
Nigeria is not a Banana Republic where Court judgments are recklessly disobeyed. The IGP should call his men to order to stay off issues that is not within their purview, for the Nigerian youths will not stand aloof while the one who has dedicated the entirety of his life towards championing thier course is been unnecessarily harassed by men of the Nigeria Police Force.
