Court stops NCAA from issuing AOC to Nigeria Air

A Federal High Court sitting in Lagos has restrained the Director General of Nigeria Civil Aviation Authority, Captain Nuhu Musa, from issuing an Air Operator’s Certificate to the proposed national carrier, Nigeria Air.

This development came several months after the proposed national airline got Air Transport Licence from the NCAA as the Ministry of Aviation stepped up plans to float a national carrier.

Some domestic airlines are in court seeking to stop the Federal Government from partnering with Ethiopian Airlines to float a national carrier.

The latest court order prohibits any step being taken in relation to the Nigeria Air project until further notice. The order was obtained by the domestic carriers.

Justice Lewis Allagoa granted orders of interim and interlocutory injunctions in the terms contained in the order, restraining the relevant parties from taking any step in relations to the Nigeria Air project.

In a letter dated 19th April, 2023 to notify the NCAA of the restraining order by the plaintiff’s lawyer Abubakar Nuhu Ahmed, (of Nureini Jimoh Chambers) read in pa, “You are therefore notified to desist from dealing with the Minister/the Ministry of Aviation and/ or their agents, privies or representatives, pertaining the Air Operator Certificate, subject matter of the suit, to avoid consequences of disobedience of court orders”.

“As a law abiding regulatory agency, you are under the watchful eyes of the world and it is in your interest to desist from any further action on AOC process that will ridicule the integrity of the Agency before the local media as well as the global aviation community.”

The Federal Government had through the Ministry of Aviation revealed in March that Nigeria Air would begin local and international flights soon, despite the controversies and legal dispute.

Obi attacks INEC for defending Tinubu, Atiku claims victory

The presidential candidate of the Peoples Democratic Party, Atiku Abubakar, says since 1993 when he began gunning for the President seat, he has done so without any controversy unlike the All Progressives Congress candidate, Bola Tinubu, who is contending with alleged drugs and identity scandals.

Atiku said this in his response to the preliminary objection filed by Tinubu and APC in reaction to Atiku’s petition, challenging Tinubu’s emergence as the winner of the February 25 presidential election.

The Independent National Electoral Commission had declared that Tinubu polled 8,794,726 votes to win the election.

The commission declared that Atiku came second with 6,984,520 votes, while it announced Labour Party’s Peter Obi as the second runner-up with 6,101,533 votes.

But Atiku, Obi and some other parties rejected the results announced by INEC and heeded for the Presidential Election Petitions Tribunal in Abuja with prayers that the election should be nullified.

In response to Atiku’s petition, Tinubu had described the former Vice President of Nigeria as a serial loser, noting that he had been trying without success to become President since 1993.

But in his reply to Tinubu filed before the tribunal, Atiku said he towers above Tinubu and there was no basis for comparison.

“The comparison of the second respondent (Tinubu) with the first petitioner ( Atiku) who had attained the eminent position of Vice President of the Federal Republic of Nigeria for eight years is unfounded,” Atiku said.

The former VP said unlike him, Tinubu is being dogged by many “controversies such as age, state of origin, identity, educational qualifications represented by certificates obtained from universities and colleges, forfeiture in drug-related offences and failure to disclose dual nationality to the 1st respondent (INEC), among others.”

Full list of Forbes’ 25 world billionaires in 2023 with no African

American business magazine, Forbes, in its 2023 list of 25 richest people in the world, featured Bernard Arnault on the No. 1 spot, followed by Twitter Chief Executive Officer, Elon Musk.

In its previous list in 2022, Musk was on the No. 1 spot.

Forbes described the drop of Musk from the top spot as ” this year’s second-biggest loser”, adding that “Elon Musk, had it worse.”

Musk lost his title of the world’s richest person after his pricey purchase of Twitter, which he funded in part by the sale of Tesla shares, helping to spook investors. Musk, who is worth $39 billion less than a year ago, is now No. 2.

For Jeff Bezos, fortune knocked him from number. 2 in the world in 2022 to No. 3 this year as Amazon shares crashed by 38 per cent.

Also, among the top 25, two billionaires — Zhang Yiming, Changpeng Zhao lost their spots and were unable to make it on the list for this year.

Atiku, Obi, two others ask tribunal to nullify Tinubu’s victory

Four presidential candidates on Tuesday approached the Presidential Election Petitions Tribunal in Abuja with separate petitions, seeking the nullification of the declaration of Bola Tinubu of the All Progressives Congress as winner of the February 25 presidential poll.

The petitioners, seeking nullification of Tinubu’s emergence as President-elect as Atiku Abubakar of the Peoples Democratic Party; Peter Obi of Labour Party; Solomon Okangbuan of Action Alliance and Allied People’s Movement’s Chichi Ojei.

Atiku Abubakar of the Peoples Democratic Party came second with 6,984,520 votes; while Obi came third with 6,101,533 votes.

The petition by Obi and LP, marked CA/PEPC/03/2023, had INEC, Tinubu, his running mate, Shettima Kashim, and the APC as respondents.

In the petition, Obi further contended that Tinubu “was not duly elected by majority of the lawful votes cast at the time of the election.”

Obi claimed there was rigging in 11 states, adding that he would demonstrate this in the declaration of results based on the uploaded results.

INEC postpones gov, state assembly elections by one week

The Independent National Electoral Commission has postponed the governorship and state assembly elections scheduled to hold on March 11 by one week.

The elections will now hold on March 18, 2023.

This was made known in a statement signed by the National Commissioner and Chairman, Information and Voter Education Committee, INEC, Festus Okoye on Wednesday.

A state Resident Electoral Commissioner who spoke to our correspondent on the condition of anonymity also confirmed the decision.

Media had reported that the INEC Chairman, Prof. Mahmood Yakubu, and his commissioners were in a closed-door meeting over the governorship election. The meeting commenced at 7pm on Wednesday.

The decision was reached after the meeting with the INEC chairman and his team.

The postponement is coming about three days before the March 11 date earlier scheduled for the state elections.

Consequently, all activities pertaining to the exercise are rescheduled, especially the states inspection of sensitive materials at the Central Bank of Nigeria.

INEC’s decision was due to the commission’s inability to earnestly commence reconfiguration of the Bimodal Voter Accreditation System machines utilised during the February 25 presidential and National Assembly elections to enable their use in the state elections.

The Presidential Election Petition Court, sitting at the Court of Appeal in Abuja, had earlier today given INEC the go ahead to reconfigure the BVAS it used for the presidential election.

It dismissed objections that the Labour Party and its presidential candidate, Peter Obi, raised against INEC’s move to reconfigure all the BVAS.

Lagos releases impounded vehicles free of charge

Lagos State Government has begun the release of impounded vehicles to their owners free of charge owing to cash crunch that has hit the nation following the Central Bank of Nigeria’s (CBN) naira redesign policy.

The release of the vehicles to their owners began since last Saturday and is still ongoing. Chelsea see off Dortmund to reach Champions League quarter-finals

Chelsea kept their season alive by beating Borussia Dortmund 2-0 at Stamford Bridge to progress to the quarter-finals of the Champions League 2-1 on aggregate on Tuesday.

Telcos hamonise shortcodes for credit recharge, others

Telecommunications operators have commenced the hamonisation of shortcodes across all networks. The announcement, which was made, yesterday in Lagos by the umbrella body, the Association of Licensed Telecoms Operators of Nigeria (ALTON), said the hamonisation was pursuant to a regulatory modernisation initiative by the Nigerian Communications Commission (NCC).

ALTON Chairman and Head of Operations, Gbenga Adebayo and Gbolahan Awonuga respectively, in a statement, said the harmonisation of shortcodes is aimed at implementing a streamlined process for common shortcodes across the industry, by making life easier for Nigerians through the memorisation of single codes, for various services across all networks, as well as providing a cohesive regulatory framework that is consistent with global best practices.

Following the directive from NCC, the Association informed the general public: “The Network Operators have begun implementing the shortcodes, working closely with the NCC. The Commission has provided adequate time for subscribers to get used to this new development. We are confident this will enhance customer experience across networks.”

ALTON said during migration (which is to be concluded by May, 17, 2023 old and new common codes will run concurrently, after which the old codes will cease to operate.

‘Double taxation, FX charges killing $10 billion barging business’

Double taxation and charges in foreign currency for barging business are crippling the industry, which has potential revenue generation of $10 billion into the government’s account, operators have warned.

The President of the Barge Operators Association of Nigeria (BOAN), Olubunmi Olumekun, said there are hidden tariffs operators pay before moving containers, which are not friendly to the business.He also noted that the government charges barge operators in dollars instead of local currency, just to move containers from Calabar to Port Harcourt.

“Government wants us to go and pay in dollars, which is not done all over the world. They forget that these containers are still going to be subject to another movement from that port to wherever it is going in the world.

“Also, they still need to pay the freight. So, you can see double freight and this person will still charge their commission on the freight. It is double taxation. We are supposed to encourage our local businesses, not the government putting all these charges on us,” he stated.

Giving a breakdown of the charges and the cost implications on logistics, Olumekun said the government charges $500 per container, while a barge carries about 30 containers.

He said currently, barge operators charge importers N300,000 to N400,000 to move a container from the port to its destination, whereas it is about N200,000 by road.

He said barge operators still pay over N150,000 charges to terminal operators, out of the amount the importer pays to transport his goods, leaving barge operators with the little amount left after the business.

Fuel price to skyrocket as marketers threaten shutdown

The queues for Premium Motor Spirit, popularly called petrol, grew worse on Tuesday following an earlier directive to shut down filling stations by the Independent Petroleum Marketers Association of Nigeria.

Although the directive was later withdrawn, it was observed that the order triggered fuel queues in many parts of Abuja and neighbouring states, as hundreds of motorists besieged the few outlets that dispensed petrol, which were operated by major marketers.

Our correspondent observed that heavy queues resurfaced at the two Nigerian National Petroleum Company Limited filling stations on the Gwarimpa end of the Kubwa-Zuba Expressway on Tuesday evening in Abuja.

Similarly, there was massive queues by motorists at the Shema filling station on the same road, while the outlets of many independent marketers in Abuja and neighbouring Nasarawa and Niger states were shut.

Oil marketers confirmed that the queues were due to the confusion caused by the earlier directive to filling station operators by a branch of the Independent Petroleum Marketers Association of Nigeria.

There was confusion on Tuesday as regards the directive by the Maiduguri Depot branch of IPMAN directing its members to shut down operations.

IPMAN Chairman, Maiduguri Depot, Mohammed Kuluwu, had directed members to suspend all operations, in a statement he personally signed, but this was countered by the National Public Relations Officer, IPMAN, Chief Chinedu Ukadike, after marketers in other states started closing down their outlets.

Ukadike said Kuluwu had been asked by the National Chairman, Debo Ahmed, to retract the statement, because IPMAN was interfacing with the Nigerian National Petroleum Company Limited and the Nigerian Midstream and Downstream Petroleum Regulatory Authority over the concerns raised in the statement.

CBN will accept old naira notes after deadline, says Emefiele

Godwin Emefiele, governor of the Central Bank of Nigeria (CBN), says the bank will continue to accept old naira notes after the stipulated deadline.

Emefiele spoke on Tuesday when he appeared at an interactive session with the house of representatives ad hoc committee on the currency redesign and naira swap policy.

He said the CBN will also accept the old naira from banks after the February 10 deadline.

Emefiele made reference to the CBN act which mandates the apex bank to continue to accept old notes after its expiration.

However, the CBN governor did not mention a duration when the banks will stop collecting the old notes.

Section 20 (3) of the CBN act states: “Notwithstanding sub-sections (1) and (2) of this section, the bank shall have power, if directed to do so by the president and after giving reasonable notice in that behalf, to call in any of its notes or coins on payment of the face value thereof and any note or coin with respect to which a notice has been given under this sub-section, shall, on the expiration of the notice, cease to be legal tender, but, subject to section 22 of this act, shall be redeemed by the bank upon demand”.

Speaking further on the CBN act, he explained that even after the old currency has lost its legal tender status “we (CBN) are mandated to collect these money (old notes) and I stand with the house of representatives on this”.

“What does that mean? It could (old notes) have lost its legal tender status which means we have moved on. But if you have your money that you have not been able to send to the bank, we will certainly give you the opportunity to bring them back into the CBN to redeem it. Either you pay it to your bank account or you want to do exchange, we will give you. You will not lose your money. This is the assurance I give to Nigerians,” Emefiele said.

Oil blocs licensing will end in April –FG

The Federal Government, on Monday, announced that the licensing round for seven deep offshore open oil blocs, which commenced on January 3, 2023, would last for four months.

It invited investors from across the world with capability and experience in deep water operations to embrace the fiscal provisions of the Petroleum Industry Act 2021 and join in bidding for the oil blocs.

The Chief Executive, Nigeria Upstream Petroleum Regulatory Commission, Gbenga Komolafe, disclosed this in Lagos at the pre-bid conference for the 2022/2023 licensing round of petroleum prospecting licences in deep offshore Nigeria.

The pre-bid conference was held following the announcement of the 2022/2023 mini-bid round exercise on December 22, 2022.

Speaking at the conference, which had its theme as “Growing Upstream Investment in Nigeria through Licencing Round: The Bid Process and Opportunities,” Komolafe said the approval of the exercise by the President, Major General Muhammadu Buhari (retd.), was the first in the last 15 years.

In his speech, which was made available to our correspondent in Abuja, the NUPRC boss explained the commission had announced the commencement and launched the bid round portal which was officially opened on January 3, 2023.

“The exercise is scheduled to last for approximately four months along the following processes: registration and pre-qualification, data prying/purchase, technical bid submission/presentation, technical bid evaluation, and commercial bid conference,” he stated.

He notesd that in compliance with the provisions of the PIA 2021 and regulations made pursuant to the Act, the commission issued a licensing round guideline and published a licensing round plan for a total of seven deep offshore open blocs.

He outlined the blocs to include PPL-300-DO, PPL-301-DO, PPL-302-DO, PPL-303-DO, PPL-304-DO, PPL-305-DO and PPL-306-DO.

The Federal Government has allocated N3.36 trillion for fuel subsidy in 2023, even as the country’s debt profile hits $102 billion.

Tinubu PCC demands Atiku’s prosecution, PDP protests

There were fireworks between the ruling All Progressives Congress and the opposition Peoples Democratic Party on Monday over the integrity and eligibility of their presidential candidates.

The Tinubu-Shettima Presidential Campaign Council called on security agencies in the country to arrest the presidential candidate of the PDP, Atiku Abubakar, for allegedly stealing public funds through ‘Special Purpose Vehicles.’

A special purpose vehicle is a type of business arrangement that allows companies to operate a subsidiary with independence from the parent company to mitigate financial risk.

The allegation was made by the joint media directorates of the PCC at a world press conference in Abuja on Monday.

In attendance were PCC Special Adviser on Media, Communications and Public Affairs, Dele Alake; Chief Spokesperson, Festus Keyamo; Director of Media and Publicity, Bayo Onanuga; Director of Special Media Projects/New Media, Femi Fani-Kayode and Director of Strategic Communications, Idris Mohammed.

Addressing journalists, Alake said the PDP candidate deserved to be arrested following evidence that he abused his office as vice president from 1999 to 2007 by allegedly siphoning and looting public funds through the creation of SPVs.

The call for Atiku’s arrest came in the wake of an allegation by his former media aide, Michael Achimugu, that he was privy to how the Atiku laundered public money through the Special Purpose Vehicles.

Corroborating Alake’s position, Keyamo said it was obvious from the oral account, voice notes and all other supporting documents provided by the whistle-blower that Atiku committed infractions.

He enumerated some of the possible infractions as gratification, money laundering, conspiracy and criminal breach of trust.
