UPDATE ON THE HEARING OF APPEALS ON ONYENDU MAZI NNAMDI KANU’S CASE BEFORE THE SUPREME COURT OF NIGERIA.

The Supreme Court of Nigeria has slated for HEARING all Appeals on Onyendu Mazi Nnamdi Kanu's case before the Apex Court on Thursday, 5TH OCTOBER, 2023.

Recall that on the 13th day of October 2022, the Court of Appeal, Abuja Judicial Division, delivered a Landmark Judgment in an appeal filed by Prof Mike Ozekhome, SAN,CON, OFR, Ph.D, on behalf of Onyendu Mazi Nnamdi Kanu, challenging part of the Federal High Court ruling, which had retained 7 counts out of the original 15 counts against Mazi Nnamdi Kanu, after striking out eight out of the 15 count charge.

The learned Justices of the Court of Appeal, in allowing the appeal filed by our erudite Lead Counsel-Prof. Mike Ozekhome SAN, directed the Federal Government of Nigeria to immediately release Mazi Nnamdi Kanu unconditionally.The intermediate court in the Landmark decision, proceeded in the aforesaid judgement to prohibit the Federal Government of Nigeria from further detaining Mazi Nnamdi Kanu, or prosecuting him on any indictment or charge before any court in Nigeria.

On the 5th day of October, 2023, Prof. Mike Ozekhome SAN, leading Sir Ifeanyi Ejiofor Esq., and others, will be exchanging the legal fireworks on behalf of Onyendu Mazi Nnamdi Kanu, in urging the Supreme Court to dismiss in its entirety the frivolous appeal filed by the Federal Government of Nigeria against this landmark judgement of the Court of Appeal; and to further set aside the ruling of the Court of Appeal staying the ex*****on of its earlier judgment.

We are very firm, and committed to our solemn belief that the wheels of justice,though grinds slowly, but grinds exceedingly fine and towards the attainment of justice at the end of the day.
Justice shall prevail,by the grace of God. And the hour is here .

BIAFRANS REMEMBER MAY 30, 2023, BIAFRA HEROES REMEMBERANCE DAY, IS SACROSANCT AND A MUST SIT-AT-HOME- IPOB.

The Indigenous People of Biafra (IPOB) ably led by the Great and Indefatigable Leader, Mazi Nnamdi KANU wish to remind Biafrans, friends of Biafra, and lovers of Biafra freedom across the world that 30th of May 2023 is sacrosanct and every Biafran must remember and honour those who died for us to live.

We remember those who died in the Nigeria genocidal war against Biafra, the mothers and fathers bombed in the market places, hospitals, churches, and those children that the Nigeria government starved to their early death. We can not forget them till eternity.

We also remember the victims of the Atlantic Ocean, Mediterranean Sea, and Sahara desert who died on the way to Europe in an attempt to escape the draconian and wicked economic and political policies against Biafrans by the Nigeria State. We must remember those who died in slave chains and in tortures from Slave Masters hands, those thrown over board, and those that preferred death than to be taken as slaves. We remember them all.

We remember our eternal leader Ikemba Nnewi Dikedioranma DIM Chukwuemeka Odumegwu Ojukwu, General Philip Efiong, Dr Frank Opigo Okon ko Ndem, Col. Achzie, Bruce Mayrock, Christian Aid workers, Biafra Aid Volunteers, and many others whose contribution during Biafra the Nigerian genocide against Biafrans who are the reason why we are alive today. We must remember; WE REMEMBER ALL!

We remember IPOB members who were brutally murdered during peaceful protests and rallies, those murdered in Aba, Onitsha, Asaba, Igweocha, Enugu, Nkpor, Ebonyi in cold blood by murderous Nigeria Army at the resident of our leader, Mazi Nnamdi Okwuchukwu KANU in 2017. We remember our Ikonso and other gallant ESN volunteers who were murdered by Nigeria State because they were defending our land against State sponsored terrorism. We also remember His Majesty and Lolo Sally Isreal Okwu Kanu, whose lives were cut short from the shocks they received when the Nigeria Army invaded, murdered, and desecrated their Royal Palace. We must remember; WE MUST REMEMBER THEM!

This year's event will be special, and the one day sit-at-home in Biafraland will be total and will be from 6:00 AM to 6:00 PM on May 30, 2023. Every economic, social, religious, and political activity in Biafraland will be suspended, with the exception of hospitals, doctors, nurses, ambulances, and other health workers. All other people and workplaces are advised to sit at home.

Once again only hospitals and health workers are free to open and go about on May 30, 2023 (Biafra Heroes and Heroines Rememberance Day) to take care of our ones and the pregnant mothers and all other sectors including police stations should be under locks and keys within Biafra territory. We call on industries, companies, transport companies(air, land, and sea) hotels, schools, and churches to shut down in honor of our heroes and heroines. Also, Biafrans in Lagos and other parts of Nigeria are encouraged to join the seat at home order on that day its only one day. We, therefore, advise Biafrans and other residents in Biafra territory to avoid endangering their lives or their businesses by obeying the sit-at-home order from IPOB leadership.

Wherever our people are or gathered on that day, they must pray with lighted candles and must observe 3 minutes of silence immediately at 12 noon. Finally, the only joy and rest to appease our fallen heroes and heroines is Biafra restoration. So, "we must continue. "

UPDATE ON TODAY'S VISIT TO OUR INDEFATIGABLE CLIENT – ONYENDU MAZI NNAMDI KANU - AT THE HEADQUARTERS OF THE DEPARTMENT OF STATE SERVICES (DSS), ABUJA, WHERE HE IS STILL BEING ILLEGALLY AND UNCONSTITUTIONALLY DETAINED IN SOLITARY CONFINEMENT:

Our legal team visited our indefatigable Client – Onyendu Mazi Nnamdi Kanu – today, being the 20th day of April 2023, at the DSS Headquarters, Abuja.

Onyendu was briefed on the status of pertinent pending appeals and other important development in relation to our appeal, which details shall remain private.

The visit afforded our team the opportunity to ascertain the true position of Onyendu’s health condition and the recent outbreak of tuberculosis (TB) in some wings of the DSS facility. To this end, Onyendu directed that we make the following clarifications:

1) There is tuberculosis (TB) outbreak in some wings of the DSS facility.

2) An Igbo man – Mr. Emene Ibe Uduma who was arrested from Ohafia sometime in September 2022, is one of the victims. The said Mr. Uduma was very healthy when he was brought to the facility in September 2022, but unfortunately, he is now at the verge of losing his life on account of TB infection.

3) All the TB infected persons are kept in solitary confinement in their cells without any access to fresh air and sunlight. Meanwhile, it is common knowledge that the TB bacteria cannot thrive in an atmosphere of fresh air and sunlight. Sadly, these inmates are kept in conditions under which the bacteria is easily circulated amongst them, and this is further worsened by the fact that they are not receiving any medical attention.

Consequently, Onyendu directed that we should draw the attention of the Red Cross and other well-meaning health organisations to the predicament and plight of these infected inmates, who are in dire need of medical treatment.

Onyendu's recently diagnosed ear problem – tinnitus ear infection – requiring advanced medical solution; which condition is as a result of the severe torture he received when he was criminally abducted in Kenya, still persists and is worsening.

Our legal team ably led by the legal iroko- Prof. Mike Ozekhome, SAN, will continue to do everything legally permissible to ensure that Onyendu receives the much needed independent medical examination and treatment.

As usual, Onyendu extends his best compliments to Ezigbo UmuChineke for remaining resolute and undistracted even as he encouraged you all to continue to abide by your peaceful conduct as you have persistently displayed.

UPDATE ON OUR TODAY'S VISIT TO OUR INDEFATIGABLE CLIENT – ONYENDU MAZI NNAMDI KANU AT THE DSS HEADQUARTERS WHERE HE IS STILL BEING ILLEGALLY AND UNCONSTITUTIONALLY DETAINED IN SOLITARY CONFINEMENT:

We visited Onyendu today at the headquarters of the Department of State Services (DSS) Abuja, to provide him with update on our relevant filings before the Supreme Court, as well as briefed him on other pertinent legal briefings.

During our discussion today, Onyendu revealed partial compliance with his routine medication, though still not administered as medically prescribed. Yet, Onyendu is still being denied access to his personal Physician.

Furthermore, Onyendu directed me to issue the foregoing statements:

1. That this critical time calls for the greatest circumspect among his followers because the enemies are relentlessly exploiting the vulnerable, to sustain their status quo, and further blackmail the IPOB, ably led by Onyendu Mazi Nnamdi Kanu, which is a peaceful self-determination movement.

2. Onyendu has a hard stance in condemnation of crimes and dissidents, and reiterated that he has never condoned nor supported criminality of any form. Hence, the criminal elements who are involved in making lives unbearable to our people should be immediately fished out and dealt with as such. They have no place in IPOB's peaceful self-determination movement.

3. That the general public and indeed UmuChineke, should be notified in unmistaken terms that nobody is receiving any instruction from Onyendu for the purpose of encouraging dissidents’ behaviours and accordingly, disassociates himself from any person(s) who is mischievously feeding the public with such blatant falsehood. Onyendu stressed that he has since made his stance public, which position is clearly contained in a viral short clip, recorded during one of his appearances in Court.

4. Onyendu reiterated his call for total calmness in the entire South-East region, and particularly queried the mental state of those who are relentlessly waging war against his people, the very people he had sworn to protect and make life better for.

5. Onyendu’s movement was founded on a peaceful bedrock, in consonance with the universally recognized rights of indigenous people to self-determination, as clearly encapsulated under the extant laws.

6. That the activities of the dissidents/marauders who engage in criminal activities, have further emboldened the blood thirsty and untrained Nigerian security agents, to unleash unimaginable terror on innocent people of the South-East region.

7. In conclusion, Onyendu reminds UmuChineke to note that the successive landmark victories he recently recorded in various Courts of competent jurisdictions against the Federal Government of Nigeria (FGN), may not have gone down well with his traducers, including the FGN. Hence, he insists that all hands must be on deck to enable saner minds to identify the real enemies in our midst, and those being used by the establishment to try to implicate and/or blackmail him.

From every indication, it is very likely that a date will soon be assigned at the Supreme Court of Nigeria for the hearing of Onyendu’s Appeal against the Order staying the ex*****on of his judgment. We will not hesitate to inform UmuChineke, through the approved channel once a date is given.

Onyendu urged UmuChineke to maintain maximum restraint, and never to lose sight of the main reason why he is currently undergoing persecution. Onyendu was particularly delighted by the news of your peaceful conduct and consequently, encouraged you all to always keep your eyes on the ball as we all can see the light at the end of the tunnel.

UPDATE ON OUR TODAY'S VISIT TO OUR INDEFATIGABLE CLIENT- ONYENDU MAZI NNAMDI KANU AT THE DSS HEADQUARTERS WHERE HE IS BEING UNCONSTITUTINALLY HELD IN SOLITARY CONFINEMENT.

I visited Onyendu today at the Headquarters of the State Security Service (DSS) Abuja, to specifically brief him on the outcome of the Court of Appeal Ruling, of Friday last week, staying the ex*****on of Onyendu’s Appeal Court Judgement.

Apart from critical legal strategies which will remain private, Onyendu did not hesitate in giving our legal team a nod to immediately proceed with an appeal at the Supreme Court against the Ruling of the Court of Appeal staying the ex*****on of its Judgement, which expectedly, is to be heard under the Supreme Court Fast Track Rules.

Procedures towards an expeditious hearing of the appeal was agreed upon and we are very hopeful that it shall still end in praises, God being our Helper.

As we had earlier stated, be assured that the Court of Appeal Judgement which vindicated Onyendu, and consequently discharged him of every bogus allegation, still subsists, it has not been set aside.

Onyendu’s legal team eminently led by Chief Mike Ozekome, SAN, will vigorously pursue an appeal at the Supreme Court against the Ruling of the Court of Appeal staying the ex*****on of Onyendu’s landmark victory at the Court of Appeal.

Onyendu used the opportunity presented by the visit to generally thank all Umuchineke for their unshaken solidarity and support, even as he continued to encourage you all to remain peaceful and law abiding, as you have always demonstrated.

Leader of the Indigenous People of Biafra, IPOB, Mazi Nnamdi Kanu, Wednesday, floored the Federal Government as the Federal High Court sitting in Umuahia upheld his suit against the federal government.
The court presided over by Justice Evelyn Anyadike awarded N500 million cost against the federal government.
The Court ordered he should be returned to where he was before he was Illegally extradited to Nigeria

NEWS BREAKING: Kenya arrest: Buhari govt loses against Nnamdi Kanu in court.

The Nigerian Government on Wednesday lost its bid to transfer the suit of the extraordinary rendition of Nnamdi Kanu, leader of the Indigenous People of Biafra, IPOB, from Umuahia to Abuja.

The Federal High Court in Umuahia, Abia State, insisted that it has the jurisdiction to hear and determine the suit.

This was disclosed by Kanu’s Special Counsel, Aloy Ejimakor, in a tweet stressing that the matter was still ongoing.

He wrote: “Breaking: Federal High Court, Umuahia denies the Federal Government’s application to transfer the ‘extraordinary rendition’ suit to Abuja, and rules that Umuahia has the jurisdiction to hear and determine the suit”. Reading of the rest of the judgment continues.”

The Special Counsel was challenging Kanu’s abduction and extraordinary rendition from Kenya.

He is, among other things, praying the court to order his return to Kenya, where he was abducted or UK, his country of abode.

UPDATE ON TODAY'S COURT PROCEEDINGS AT THE COURT OF APPEAL ABUJA JUDICIAL DIVISION ON ONYENDU MAZI NNAMDI KANU'S CASE.

Hearing on the Motion for the stay of ex*****on of the judgment of the Court of Appeal delivered on the 13th day of October, 2022, took place today.

It was indeed an superlative outing as our defence team eminently led by our Indefatigable Chief Mike Ozekhome, SAN, practically removed the legal carpet from the feet of Federal Government today. Arguments proffered in stiff opposition to their application for stay of ex*****on was well marshalled out point by point by the erudite Silk.
By the end of the day’s proceedings, both the other lawyers in court and those in solidarity that visited, went home with the strong conviction that victory is again on our way.

The Federal Government’s application for stay of ex*****on which is not only grossly incompetent but also a grave affront to the sanctity of the Orders of the Court of Appeal, which decision of the same court they are now seeking equitable remedy to be stayed by the same court.
Orders of the Court must be obeyed and it’s sanctity must be respected by the Federal Governmentof Nigeria. He who goes to equity must go with clean hands.

It’s trite and as rightly submitted by the Learned erudite Silk- Chief Ozekhome SAN, that there is no Res to be stayed in the present case and Orders of the court cannot be made to stay the constitutionally guaranteed rights of a citizen.
The only available option for the Federal Government in the circumstance of this case is to kindly obey the Order made by the Court of Appeal, and consequently allow ONYENDU Mazi Nnamdi KANU to go home as ordered by Court of Appeal.

I want to emphasize once again that the erudite judgment of the Court of Appeal on Onyendu’s case has gripped the Federal Government like an irreversible rigor mortis. It has held them in a vice-like grip. There is no chance of extrication whatsoever.

In conclusion, we are very certain of victory once again, because ChukwuOkike Abiama is always on the throne.

Ruling on the Argument canvassed today has been reserved to a date to be communicated to the parties.
However, we have in addition, filed an application for the enforcement of ONYENDU’s fundamental rights to liberty and freedom of movement, which are now being grossly violated by the Federal Government of Nigeria, for refusing to obey the order of the Court of Appeal which discharged ONYENDU since the 13th day of October, 2022.

As it stands today, there is no order of court sanctioning ONYENDU’s detention since the 13th day of October, 2022, he was freed. He is being illegally and unlawfully held in the custody of the State security Services since the 13th day of October, 2022.

We have now gone for our routine visit to ONYENDU and to also brief him on the outcome of today’s proceeding.

Be assured that it has already ended in praises UMUCHINEKE.
We will update you on the outcome of today's visit to ONYENDU upon conclusion of the visit in the next hour or thereabout.

We wish to inform Umuchineke and all followers of Onyendu Mazi Nnamdi Kanu, that we just received NOTIFICATION from the Court of Appeal Abuja Judicial Division, that the long awaited Judgment in Onyendu Mazi Nnamdi Kanu’s Appeal No: CA/ABJ/CR/625/2022 BETWEEN: MAZI NNAMDI KANU VS. FEDERAL REPUBLIC OF NIGERIA, will be delivered tomorrow, the 13th Day of October, 2022, at 2:00PM.

UPDATE ON ONYENDU MAZI NNAMDI KANU’s CASES IN COURT.

A Federal High Court sitting in Maitama Abuja will today hear the Suit challenging the abduction and extraordinary rendition of Onyendu Mazi Nnamdi KANU.

The Suit is in substance challenging the abduction in Kenya, and extraordinary rendition of Onyendu Mazi Nnamdi Kanu, filed before the Federal High Court Abuja, against the Federal Republic of Nigeria & Anor, in Suit No: FHC/ABJ/CS/462/2022; and another Suit challenging the constitutionality or otherwise of the 2022 Practice Direction on the trial of terrorism offences, filed against the Chief Judge of the Federal High Court & Anor, in Suit No: FHC/ABJ/CS/550/2022, are equally coming up for Hearing this morning before my Lord, the Hon. Justice Ekwo of Court No. 5, Federal High Court Abuja.

We shall keep you updated as to the proceedings and outcome.

Please be informed that Onyendu will still not be coming to court today because the Suit is independent of the frivolous charge preferred against him, which we are challenging before the Court of Appeal.

RE: Court to hear Mazi Nnamdi Kanu’s extraordinary rendition case on 4th October

On 4th October 2022, the Federal High Court, Umuahia will hear Mazi Nnamdi Kanu’s extraordinary rendition suit which I had filed before the court in March this year.

The Suit is sui generis (of a special class) and it is primarily aimed at redressing the infamous unlawful expulsion or extraordinary rendition of Nnamdi Kanu, which is a clear violation of his fundamental rights under Article 12(4) of the African Charter on Human and Peoples Rights, as well as Chapter IV of the Nigerian Constitution.

In addition to the rendition, I am asking the Court to redress the myriad violations that came with the rendition, such as the torture, the unlawful detention and the denial of the right to fair hearing which is required by law before anybody can be expelled from one country to the other. I am also seeking to halt his prosecution and restore him to the status quo before he was rendition on 19th June, 2021.

You will recall that that on 19th January, 2022, the High Court of Abia State decided that portion of violation of Kanu’s fundamental rights that occurred in 2017. Even as I had made claims that bordered on rendition, the Court declined jurisdiction on grounds that rendition, being related to extradition, lies within the exclusive jurisdiction of the Federal High Court. This is what informed my decision to initiate the suit before the Federal High Court.

To be sure, the extraordinary rendition of Nnamdi Kanu triggered myriad legal questions that cut across multiple jurisdictions in Nigeria and even triggered the international legal order, to boot. In other words, the rendition has expanded the matter of Kanu far beyond the realms of the Abuja trial and opened up new legal frontiers that must be ventilated to the hilt before other courts and tribunals within and without Nigeria.

Thus, this very case before the Federal High Court, Umuahia is one of such that is aimed at seeking a definitive judicial pronouncement on the constitutionality of the extraordinary rendition. The ones in the United Kingdom, Kenya, African Union and the United Nations are in addition.

I would like to cease this opportunity to express my profound appreciation to the highly competent and hardworking team of lawyers that I am leading in the prosecution of this complex suit. Special mention must be made of Barristers Patrick Agazie, Ifeyinwa Nworgu, Tochukwu Arugbuonye, Franklin Amandi, Ohaeto Uwazie and Mandela Umegborogu.

For ease of reference and avoidance of any doubt, the following are the specific reliefs that I requested in the Suit:

1, A DECLARATION that the arrest of the Applicant in Kenya by the Respondents’ agents without due process of law is arbitrary, and the Respondents’ enforced disappearance of the Applicant for eight (8) days and their refusal to produce the Applicant before a Kenyan Court for the purpose of Applicant’s extradition is illegal, unlawful, unconstitutional and amount to infringement of the Applicant's fundamental right against arbitrary arrest, to his personal liberty and to fair hearing as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.

2, A DECLARATION that the detention of the Applicant in a non-official secret facility in Kenya and the torture of the Applicant in Kenya by the Respondents’ agents is illegal, unlawful, unconstitutional and amount to infringement of the Applicant's fundamental right against unlawful detention, torture and to fair hearing, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter).

3, A DECLARATION that, pursuant to Article 12(4) of the Charter, the expulsion (or extraordinary rendition) of the Applicant from Kenya to Nigeria by the Respondents without a decision taken in accordance with the law of Kenya is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant's fundamental right to fair hearing and not to be expelled from a State Party to the Charter except by virtue of a decision taken in accordance with the law, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.

4, A DECLARATION that any criminal prosecution of the Applicant the purpose of which the Respondents unlawfully expelled the Applicant from Kenya to Nigeria is illegal, unlawful, unconstitutional and amounts to infringement of the Applicant's fundamental right to fair hearing, as enshrined and guaranteed under the pertinent provisions of CFRN and the Charter.

5, AN ORDER OF INJUNCTION restraining and prohibiting the Respondents from taking any further step in any criminal prosecution of the Applicant enabled by the said unlawful expulsion of the Applicant from Kenya to Nigeria.

6, AN ORDER mandating and compelling the the Respondents to forthwith restitute or otherwise restore the Applicant to his liberty, same being his state of being as of 19th June, 2021; and to thereupon repatriate the Applicant to his country of lawful domicile (to wit: the United Kingdom) to await the outcome of any formal request the Respondents may file before the competent authorities in Britain for the lawful extradition of the Applicant to Nigeria.

7, AN ORDER mandating and compelling the Respondents to issue an official Letter of Apology to the Applicant for the infringement of his fundamental rights; and publication of said Letter of Apology in three (3) national dailies.

8, AN ORDER mandating and compelling the Respondents to pay the sum of N25,000,000,000.00 (Twenty-Five Billion Naira) to the Applicant, being monetary damages claimed by the Applicant against the Respondents jointly and severally for the physical, mental, emotional, psychological, property and other damages suffered by the Applicant as a result of the infringements of Applicant’s fundamental rights by the Respondents.

It is our humble expectation that, sooner than later, justice shall prevail for Mazi Nnamdi Kanu.
