In November 2017, it emerged that the Governor of Central Bank of Nigeria, Godwin Emefiele, had significant interests in an off-shore company registered in Bermuda, which held an account with the UBS in London. The UBS is a multinational investment bank and financial services company with its headquarters in Basel and Zurich in Switzerland.

Disclosures released by the International Consortium of Investigative Journalists in the Paradise Papers revealed that Emefiele owned 49% of Oviation Asset Management since 2009 and was a director in the company since January 2013.

According to The Guardian newspaper in London, “Oviation was part of a structure that imported two jets via the Isle of Man. The latest purchase, a $50m Gulfstream G550, arrived in November 2015. It replaced a $33m Gulfstream G450, imported in 2013.”

Fifteen months before the import of the second Gulfstream, in June 2014, Emefiele became the Governor of the CBN. In this capacity, he also leads The Mint, which prints Nigeria’s currency.

Section 9 of the CBN Act of 2007 requires of both the Governor of the Central Bank and his deputies that they “shall devote the whole of their time to the service of the Bank and, while holding office, shall not engage in any full or part-time employment or vocation, whether remunerated or not, except such charitable causes as may be determined by the Board and which do not conflict with or conflict with their full-time duties.”

This prohibition places three constraints on the CBN Governor: one substantive, another procedural, and a third, ethical. Substantively, it bars him from moonlighting in any other job or vocation, whether or not remunerated. Procedurally, he needs the approval of the Board of the CBN before taking on any role outside the bank. Implied in this is an obligation of full and honest disclosure on the part of the CBN Governor. As an (additional) ethical standard, the Act precludes the CBN Governor from putting himself in a position that conflicts with his full-time duties.

As the head of a “public corporation” (which the CBN is), Emefiele, as the CBN Governor, is also subject to the Code of Conduct for senior public officers contained in the 5th Schedule to the Nigerian constitution, which imposes on him standards of conduct with reference to asset disclosures, acceptance of gifts and donations, and holding of overseas interests.


For Emefiele, it seems these standards were ornaments of convenience. Three years into his office as the CBN Governor, his interests in Oviation were still intact. Contacted by The Guardian for an explanation in November 2017, Emefiele claimed that he “gave instructions for his shares to be handed back” to his former employers, a Nigerian bank, in 2014. For a central banker, this claim shows either a tendency for the cavalier or habit of casuistry. The former puts his professionalism in question and the latter is a question of character.

On or about May 4, 2022, Emefiele was a guest of the President, Major General Muhammadu Buhari (retd.), in the Presidency. The following day, some characters claiming to be armed Niger Delta militants endorsed the CBN Governor for the presidential ticket of the ruling All Progressives Congress, promising to lay down their arms if the party were to hand the ticket to him. It is too soon to say whether or not these two developments which appear unrelated have anything to do with what happened next.

Putting months of speculation and hide-and-seek to rest, it emerged on May 6, 2022 that one Rice Farmers Association of Nigeria and two other shadowy organisations had purchased for Emefiele forms to run for the presidency on the ticket of the APC. His political organisation goes by the brand “ ”. The following day, May 7, Emefiele claimed that he was awaiting “God’s Divine intervention” which he hoped to receive “in the next few days”.

Emefiele has been nothing if not consistent in his convenient attitude to rules. As the CBN Governor, he has maintained a ruinous regime of multiple exchange rates, sustaining a deliberate scheme of profitable arbitrage which is conducive to cronyism at his discretion and insider abuse. The result is this his version of “Farmers Earnestly Yearn for Emefiele”.

He has got the CBN involved in schemes and scams that almost assuredly violate Section 34 of the CBN Act; from taking over the management of the National Theatre (despite pending litigation) to making himself a willing instrument for the persecution of protesters. Premium Times in a February 21, 2021 editorial fears that his tenure at the CBN will be remembered for having wilfully “shredded” the guardrails in the CBN Act.

In a country where consequences follow malfeasance, Emefiele will already be in prison. In Nigeria, he longs for the presidency.

The question whether Emefiele can run for the presidential ticket of a political party while also continuing to serve as the CBN Governor is both moral and legal. Premium Times addressed the former, pointing out that “the operational and administrative autonomy granted the central bank by its enabling statute was precisely to protect the governor from political influence.”

The governor of Ondo State, himself a Senior Advocate of Nigeria and former president of the Nigerian Bar Association, Rotimi Akeredolu, puts it even more pointedly in a release issued on the same day that Emefiele collected the form to actualise his aspiration: “It is difficult to imagine that a person who occupies the exalted and sensitive office of the Governor of the CBN will be this brazen in actualising his ambition.”

A partisan politician grubbing for votes while hanging on as the CBN Governor messes with more than the statutory independence of the Bank. It is inconceivable that he can retain independence while seeking the presidency. On the same May 6, on which he collected his presidential forms, “news of Emefiele’s presidential bid sent the Naira close to a record low”, confirming that his is no ordinary ambition.

But this is, even more, a legal issue. To be sure, Emefiele, as an adult citizen of Nigeria, is entitled to run for any office he desires. Two of his predecessors have preceded him into elective politics. Clement Isong, the second Governor of the CBN from 1967 to 1975, became the first elected governor of old Cross-River State in October 1979. Chukwuma Soludo, who was the CBN Governor from 2004 to 2009, is currently serving as the governor of Anambra State, having been elected on November 6, 2021. Both Dr. Isong and Professor Soludo ran for office after the expiration of their terms.

Section 9 of the CBN Act makes it quite clear that the CBN Governor just cannot choose to run for elective office while still holding on to office. In any case, he has to first secure the approval of the CBN Board, which is not the case here. He could, of course, choose to resign in order to pursue his ambition. For this, Section 11(3) of the CBN Act requires him to give “at least three months’ notice in writing to the President of his intention to do so.”

So, Section 9 of the CBN Act precludes Emefiele from political activities and Section 11(3) requires him to give three months’ notice of resignation. As a matter of law, he should have resigned at least three months before the party presidential primary in which he is to be a contestant. The possibility that such a notice from the CBN Governor can be concealed for this long in a political season would require terminal skills in political self-immolation.

But, as with his holding in an offshore company despite being prohibited from doing so, Emefiele would wish this away as yet another inconsequential encounter with an inconvenient guardrail. The Presidency, however, is ultimately about guardrails. As Lincoln is reported to have said and many more since then have shown, it is a test of character.

In pursuit of his audacious project, Emefiele has not encountered any guardrails which he has not been willing to destroy. For those who wish to turn over to him the keys to the presidency at this time and in this manner, Governor Akeredolu’s words bear repeating: This is a joke taken too far.


In the end, it would appear that Emefiele is relaxed about having the fate of his ambition decided by a college of Nigerian judges. He carries on with the cockiness of a man who has assured himself that, as the boss of The Mint, he can issue enough notes to buy any number of judges on his march to whatever he fancies. If he ultimately suffers a bloody nose, it’ll be just desserts for a man who clearly believes everything can be bought and sold.

TEXT OF A STATE BROADCAST BY HIS EXCELLENCY, NYESOM EZENWO WIKE, CON, GSSRS, POS TO THE PEOPLE OF RIVERS STATE ON FRIDAY 6TH MAY 2022

My dear people of Rivers State

Today, 6th May 2022, the Supreme Court of Nigeria has delivered its judgment on the subsisting boundary dispute between Imo State and Rivers State over the ownership of some oil wells at the Akiri and Mbede Oil fields.

2. Let us recall that following the disputed claims to the location and ownership of some oil wells at the Akiri and Mbede oilfields between Imo and Rivers States in 1999, the Governors, Their Excellencies, Achike Udenwa and Dr. Peter Odili respectively, worked out a political settlement and mutually settled for a 50:50 percent beneficial sharing of the derivation proceeds accruing from these wells pending the proper demarcation of the boundaries between the two States by the National Boundary Commission (NBC).

3. While the dispute lingered, nothing was done by the NBC to demarcate the boundaries of the two States and establish the proper location and title to the disputed oil wells.

4. However, instead of instigating the NBC to do the right thing, Governor Emeka Ihedioha of Imo State, shortly after assuming office, repudiated the subsisting 50:50 percent sharing formula and made provocative claims to the exclusive ownership of the entire Akiri and Mbede oil wells.

5. In order to actualized this spurious claims, he stealthily wrote a letter dated 9th August 2019 to President Mohammadu Buhari and requested for the refund of the sum of N15, 000,000.00 (fifteen billion naira) from Rivers State to Imo State as backlog of accrued proceeds from the 13% derivation revenue of the said oil wells.

6. Acting on Governor Ihedioha’s letter, Mr. President warranted a letter to be written to the Revenue Mobilization, Allocation and Fiscal Commission (RMFAC) through his late Chief of State, Mr. Abba Kyari, to alter the status quo against in favour of Imo State without reference to the subsisting dispute and agreement between the two States.

7. Surprised by the surreptitious plots and collusive actions of the Government of Imo State and the NBC to overreach the legal interest of Rivers State in the disputed oil wells, the Rivers State Government opted to approach the Court for a just and lasting resolution.

8. Accordingly, we first applied to the Federal High Court, Abuja and among other reliefs, successfully challenged the powers and authority of Mr. President to give directives to the RMFAC and or interfere in any manner whatsoever with the distribution of public revenues from the distributable pool account, including the Federation Account.
9. Not satisfied with the positive ruling of the Federal High Court, the Imo State Government appealed to the Court of Appeal and lost. We then proceeded against the Government of Imo State at the Supreme Court in a fresh suit for a final and conclusive determination of the boundary dispute between our two States.

10. In approaching the Supreme Court in this matter, we believed that the dispute between the two State and the contentious issues are such that the Court can judicially, justly and expeditiously determine with the available facts and supporting evidence, including valid administrative maps, subsisting judgments, and other relevant documents.

11. And so, the Supreme Court has finally and conclusively resolved the dispute and granted full and exclusive ownership of all the disputed oil wells in Akiri and Mbede oilfields, to Rivers State much to everyone’s relief.

13. Although Governor Hope Uzodima was not the mastermind of the impulsive trajectory that compelled us to seek the intervention and protection of the Courts, he nevertheless participated fully in the litigation process to the end without engaging the Rivers State Government for a possible a political solution.

14. However, his reactions to the judgments of the lower courts on this matter were clearly uncalled for.

15. Indeed, itwas rather unfortunate that for someone who became Governor through the instrumentality of the judiciary could turnaround to castigate the very institution that made him ruler over the good, peaceful and progressive people of Imo State.

16. Now that the Supreme Court have spoken, we hope Governor Hope Uzodima will accept the outcome in good faith, refrain from his usual diatribes against the judiciary and explore possible pathways to accommodation and compromise from the Rivers State Government.

17. This, we may readily oblige, despite the betrayals and back-stabbing by Emeka Ihedioha, who in spite of the extensive support and goodwill he received from the Government and people of Rivers State to become Governor, led the onslaught and created a wedge between two brotherly States that have been living at peace and in friendship with each other.

18. We also deplore the collusive actions of the NBC, which unfortunately, has become notorious as one of the most corrupt national agency, which has functioned more in causing confusion that resolving boundary disputes.

19. It bears repeating that the quest to defend our ownership rights through the courts over the Akiri and Mbede oil wells was not intended to claim victory over Imo or any other State.

20. We are therefore open to further discussions with the Government of Imo State on the best way forward without prejudice to the outcome of today’s judgment.

21. We appreciate the lawyers that prosecuted and secured this landmark success for Rivers State, and for their efforts, it is my pleasure to announce the conferment of State Honours on every one of them as the Distinguished Service Star of Rivers State (DSSRS).

22. Finally, I wish to reiterate our resolve to continue to fight for, advance and protect the best interest of Rivers State at all times and under any circumstances up to the end of our Government, and we hope our successor would likewise continue in this courageous spirit and determination to make the desired positive difference for our State and our people.

Disputed Oil Wells: Gov Wike Writes Name On Marbles – Rt. Hon. Dekor

The lawmaker representing Khana/Gokana Federal Constituency in the House of Representatives, Rt. Hon. Dumnamene Robinson Dekor has again given Gov Nyesom Ezenwo Wike a pat on the back for living true to his promise of putting the State first in the management of state affairs.

Rt. Hon. Dekor made the commendation on the heels of the epochal Supreme Court victory in favour of Rivers State in its legal battle over the disputed 17 oil wells in Egbema and Ndoni Communities of Rivers State.

The Chairman of Committee for Host Oil Communities in the House of Reps, described the Supreme Court victory as another landmark of the Gov Wike administration which according to him is unprecedented in the annals of the history of Rivers State.

Rt. Hon. Dekor, a former Deputy Speaker of the State Legislature and one time Commissioner of Works in the State said by this feat, Gov Wike has written his name in the sands of history and will be kindly remembered by posterity as a selfless leader that defied all odds to ensure that the Riversman proudly retained his identity in the comity of other ethnic groups in Nigeria.

Having drawn a roadmap for the political and economic emancipation of Rivers State, Rt. Dekor reasoned, “it now behooves on future leaders and other political office seekers to take a cue from His Excellency and make sure that ‘forward’ ever and ‘backward’ never”.

The Ogoni-born lawmaker and political strategist expressed joy that Gov Wike by this particular victory has proved again to all that the focus of his administration is the state and Rivers people and not for a particular group or political party.

Rt. Hon Dekor urged all men and women of goodwill in the state irrespective of political affiliation to support and pray for Gov Wike as he proceeds to raise the bar of good governance to the national level as a presidential aspirant on the platform of the Peoples Democratic Party. This is again, a plus and political statement for all Rivers people, the federal lawmaker declared.

Rivers: Detained PDP Guber Aspirant To Remain In Detention Till May 23

The trial of the detained governorship aspirant on the platform of the Peoples Democratic Party (PDP) in Rivers State and member of the House of Representatives, Hon. Farah Dagogo, before a Chief Magistrate Court in Port Harcourt, has been adjourned till May 23, 2022

The development followed the inability of the Nigeria Police, which is holding the lawmaker in custody since April 29, 2022, failed to produce him in court.

Addressing journalists outside the courtroom, the state prosecutor, Chidi Eke, said he has filed fresh charges against the governorship hopeful, at the Rivers State High Court.

Meanwhile, the detained PDP governorship aspirant, Hon. Dagogo, has accused Rivers State governor, Nyesom Ezenwo Wike, of plotting to nail him with falsehood.


Dagogo, in a statement made available to LEADERSHIP in Port Harcourt by his media aide, Ibrahim Lawal, alleged that the charges against him, which he described as trumped-up, were allegedly well calculated and masterminded by the governor and his co-conspirators, to put him away and scuttle his governorship ambition.

The statement reads: “Governor Nyesom Wike, during a Thanksgiving Service in Church, confirmed our concerns and fears that the trump-up charges levelled against Hon. Doctor Farah Dagogo by the governor is a well calculated attempt, masterminded by the Governor and his co-conspirators to put Hon. Doctor Farah Dagogo away, and out of circulation and scuttle his governorship aspiration.

“At the Thanksgiving Service, the governor admitted in public, what was being rumoured in private, that he wield lots of influence in the judiciary and as such would frustrate and prevent any bail application for Hon. Doctor Farah Dagogo. We want to believe that the Judiciary remains the very hope for a fair adjudication and the coming days will tell us more.

“He equally justified his illegal declaration of Hon. Dagogo as a cultist and a criminal’ in conformity with his attempt to tarnish the image of the Federal Lawmaker.

“Contrary to the misinformation the Governor peddled in the House of God, Hon. Doctor Farah Dagogo is not a criminal, he has never been charged as one, neither has he been convicted of such an offense. His record remains unblemished.

“The story of the Niger Delta agitation and struggle is in the public domain, and Hon. Doctor Farah Dagogo had stated his role publicly, the sacrifices and the overtures he rejected.”

TONYE COLE MUST ACCOUNT FOR RIVERS $50 MILLION-WIKE

Rivers State governor, Nyesom Ezenwo Wike, says no person will succeed in becoming the next governor of the state if the intention is to make the State a personal estate.

Governor Wike made the declaration at the thanksgiving service on Sunday to celebrate the legal victory secured at the Supreme Court of Nigeria in the oil well dispute between Rivers and Imo States, that held at St. Paul's Anglican Cathedral in Port Harcourt.

The Rivers State governor said the All Progressives Congress (APC) aspirant, Tonye Cole will have to first answer to what had happened to the $50 million his Sahara Energy Company received through the Access Bank from the Rivers State government when Chibuike Amaechi was governor.

The governor insisted that he is not against anybody aspiring to be governor of the state, but in the case of Mr Cole, he must first give account for the money he received from the Amaechi’s administration.

“He (Cole) must account for the $50million they took from our account. Whoever knows him should tell him. $50million was taken from Rivers State Access Bank account and transferred to Sahara Energy account. And I asked them what is the job you people did for Rivers state? Can I see the contract paper, did you people loan us money?”

However, governor Wike said it should not be a situation where the former governor will bring his business partner to become governor of the State when they have both sold and bought assets of the State including gas turbines.

“You think you can sell this state. The former governor think that he can bring his business partner, after you have sold all our gas turbines, Olympia hotel, collected our $50million cash.”

The governor further added: “People think we will sit here and you will sell our state. Nobody can sell this state. Nobody can make this state his personal estate. A governor must be somebody who wants to develop this state, not somebody who wants to put the state in his pocket.”

Governor Wike described as a waste of time the 48 hours ultimatum issued by the Ijaw National Congress (INC) over the arrest of Farah Dagogo, who is standing trial on two-count charge of conspiracy to felony and cultism.

The right thing for them to do, governor Wike said, would have been to come to government to find out crux of the issues.

Governor Wike expressed the regret how criminals who r***d women, kidnapped people and done several crimes were allowed to live above the law with the lifestyle that they are Lords who cannot suffer any consequences of their actions.

According to Governor Wike, Farah would have lived within the bounds of the amnesty offered him by the Federal Government instead of returning to acts that threatened the peaceful conduct of the Peoples Democratic Party (PDP) screening exercise.

Governor Wike explained that as chief security of the state, he directed the police to arrest Dagogo because he had mobilised cultists to disrupt the screening of federal and state legislature aspirants. According to the governor, some of the cultists were arrested by the police and arraigned in court.

“Enough is enough of all these young boys, thinking that they can take everybody for granted and overrun the state, not when I’m a governor of this State. You can do it when another person is a governor, not while I’m here.

“You (Farah) are not running for National Assembly, you are not running for State Assembly, you went and brought cultists to the party secretariat, to destroy the party secretariat and as a governor, as a leader of the party I should fold my hands and see a criminal, an illiterate overrun my party.”

Governor Wike also berated the former director general of the Nigerian Maritime Administration and Safety Agency, NIMASA, Dr Dakuku Peterside, for threatening the peace and stability of the state over the arrest and arraignment of Dagogo in court.

PRESS RELEASE ON MR FARAH DAGOGO'S ARREST

Arrest Of Mr Farah Dagogo: Political Persecution Of An Ijaw Son

1. The Ijaw National Congress with appalling disgust state in unequivocal terms the kangaroo arraignment and crude detention of a prominent Rivers Ijaw son and member representing Degema-Bonny Federal Constituency in the House of Representatives, Hon. Farah Dagogo, on the orders of Rivers State Gov. Nyesom Wike.
We wish to state in most unequivocal terms that Hon. Farah Dagogo's continued detention without conviction in a court of law is a clear violation of his fundamental human rights.

2. The illegal arrest and detention of Farah Dagogo is an orchestrated design by the Gov. Wike's administration to persecute the Ijaws who are resolved to come together to challenge the governorship of Rivers State. May we ask, when did the constitutionally guaranteed right to contest an election become a crime? As a former Minister of State in the President Goodluck Ebele led federal administration did the then Rivers State Governor Chibuike Amaechi who had become an APC chieftain threatened or ever arrested and illegally detained Governor Wike even though they were at loggerheads?
When did Rivers State become the private empire of Gov. Wike that indigenes need permission from him to decide their political future?

3. The INC is particularly miffed at the trumped-up charges against Farah Dagogo that he hired cultists to disrupt the PDP screening exercise which was presided over by his Governor colleague, Sen. Douye Diri of Bayelsa state. Did Gov. Diri ever call him (Gov. Wike) that their lives were under threat on account of the invading cultists? Did the well-fortified security apparatus of Gov. Diri call for security reinforcement because of Gov. Wike's imaginary marauding cultists? What on earth justifies this premeditated political onslaught against Hon. Farah Dagogo and the Rivers Ijaws? Was the mission essentially to deny him screening so that he would not have a chance to contest the governorship elections against other opponents?

4. We wish to remind Governor Wike that Dagogo is as eminently qualified as any other Rivers man or woman to contest for the office of governor on the platform of the Peoples Democratic Party. As nobody is denying Wike his right to contest for the office of President of the Federal Republic of Nigeria, he too should refrain from scuttling the rights of others to aspire to any elective office in the country, including the office of governor of Rivers State.

5. By the current shenanigans, Governor Wike has exposed his pangs to underscore his disdain for an Ijaw successor. We now know that this has been his secret agenda. Let the historic contributions of the Ijaw people to the creation of old Rivers State not be lost on Governor Wike.

6. Governor Wike should be reminded that the beauty of democracy underscores free contest and not an imposition. He is not an emperor and therefore cannot single-handedly dictate a successor against globally accepted democratic tenets.

7. As a sitting governor, who is exiting office in 2023 after his constitutional two tenures, his politics of succession must be seen to be all-inclusive and not designed overtly or covertly to exclude Ijaw interest in Rivers State.

8. We have it on good authority that Dagogo's health has deteriorated as a result of his ordeal in the hands of Governor Wike. He is said to be suffering from chest and stomach complications. Let Gov. Wike realise that the Ijaw nation is watching. Nothing should happen to Hon. Farah Dagogo.

9. The Ijaw National Congress (INC) demands the immediate release of Hon. Farah Dagogo from incarceration. As a lawyer, Governor Wike knows that his trumped-up charges against Dagogo are bailable. If Gov. Wike thinks he has legitimate charges to convict him let him allow the due process of the law to take its legitimate course. Release Dagogo in the interest of peace, justice and fairness, to enable him to pursue his political ambition, to which he is constitutionally entitled.

Rivers 2023 Guber Race: Obuah Pledges To Reduce Gap Between Rich And Poor

A frontline Rivers State governorship aspirant under the platform of the Peoples Democratic Party (PDP), Bro. Felix Amechi Obuah has promised to bridge the gap between the rich and the poor in the state, if given the mandate to fly the party’s flag at the forthcoming PDP state primaries.

Addressing journalists and a horde of supporters at the South-South Zonal office of the PDP along Aba Road, Port Harcourt shortly after he was screened by the Screening Committee on Friday, Bro. Obuah said governance is all about the welfare of the people and striving to provide their basic needs.

Bro. Obuah who was the immediate Chairman of the PDP in the state, pledged to live by his philosophy of ‘Go Round’.

In his words, “You know my name is ‘Go Round’. I want to make sure that at least, I reduce the gap between the rich and the poor, so that the wealth can go round”.

He disclosed that the screening exercise was straightforward and very successful, adding “We are expecting nothing but success all the way. We have all been screened and by the grace of God, it is confirmed.

“The best candidate will carry the day. We are going to showcase our democratic credentials and what we intend to do for our people. The delegates will have to select among the 15 of us who they feel is best suitable for the job”.

Mba Anabara Agu, as Bro. Obuah is traditionally titled, reiterated that he has the requisite capacity to govern the state, if given the party’s ticket, even as he expressed confidence in the ability of the Screening Committee Members to do a good job.

“The members of the committee are well respected citizens and the governor of Bayelsa State is the Chairman of the Screening Committee. Almost everybody there is a well respected and disciplined personality in the party. I am very confident because I have the capacity to lead the state”, he echoed.

“Rivers people should expect good governance. They should expect continuity. I am very sure that by the special grace of God, Insha Allah, I will make it”, he said.
