VAT Judgement Will Be Fair And Free From External Influence - CJN Tanko

Ibrahim Muhammad, chief Justice of Nigeria (CJN), says the panel which will hear an appeal by the Rivers state government on the value-added tax (VAT) controversy will be free from external influence.

Rivers is seeking a supreme court ruling setting aside an order of the appeal court which directed the state to maintain status quo on the collection of VAT pending the determination of an appeal filed by the Federal Inland Revenue Service (FIRS).

Supreme court insiders had told TheCable on Thursday that there are plans to arrange a UK trip for the CJN before a panel is constituted to determine the appeal.

In his absence, Mary Odili, the No 2 in the supreme court hierarchy and former first lady of Rivers state, will appoint the members of the panel.

However, A senior special assistant on media to CJN, Isah Ahuraka, said the CJN is healthy and thus, has no plan to travel to the UK for medical attention.

The Chairman of Economic and Financial Crimes Commission (EFCC), Abdulrasheed Bawa, was rushed out of the Presidential Villa, Abuja, on Thursday, after he slumped at a programme.

Bawa was giving his goodwill message at the National Identity Day celebration when he suddenly stopped speaking.

He was speaking about a man the commission arrested in Ibadan, Oyo state, with 116 SIM cards when the incident happened.

He was later assisted to his seat by the Minister of Communications and Digital Economy, Dr Isa Ali Pantami, and other senior officials at the event.

Shortly, he was rushed out of Nigeria’s seat of power.

Lagos Assembly Amend Criminal Justice Law of Lagos State.

▪︎No more parading of suspect by Police

▪︎No arrest without warrant, unless suspect Carrie's fi****ms.

▪︎No more arrests of suspect's family members.

▪︎No more torture or harassment of suspects, before or after arrest.

▪︎Suspects should have access to lawyers.

1. No more parading of suspect by Police.
“As from the commencement of this law, the police shall refrain from parading any suspect before the media.”

2. No Arrest without warrant.
The new law makes it mandatory for Police to present an arrest warrant before arresting a suspect, and the only condition to do otherwise is when the person is reasonably suspected to unlawfully be in possession of fi****ms or other such dangerous instruments.

In any case where the suspect does not possess weapons or fi****ms unlawfully, the police must show a warrant of arrest.

3. No more arrest in lieu.
This means that a family member or relations of a suspect can no longer be arrested and only the alleged suspect should be arrested.

The Nigerian Police are used to arresting every person they meet at an arrest location whether the suspect is there or not, this act is no more legal and the police in Lagos can now be sued for arresting friends or family members of a suspect.

4. No more harassments or torture of suspects.
The new law bars the Police from harassing or torturing a suspect before or after arrest.

"A suspect should also be accorded humane treatment, with the right to dignity of person; not subjected to any form of torture, cruel, inhumane or degrading treatment; be brought before the court as prescribed by this law or any other written law; or be released conditionally or unconditionally.”

5. Access to lawyer.
The new law stipulates that a suspect has the right to a lawyer and must not be held in custody beyond the lawful day.

Breaking: Journalists barred access to Federal High Court to cover trial of Nnamdi Kanu, acclaimed leader of the Indigenous People of Biafra IPOB.

The authorities of the Federal High Court Sunday evening released a list of ten media organizations accredited to cover the hearing.

There is massive disquiet by media correspondents assigned to cover the hearing, as they fault the controversial arrangement.

There is also the talk of this arrangement being masterminded by the government to gag the media.

Yoruba Nation agitator, Sunday Adeyemo also known as Sunday Igboho has been arrested in Cotonou, Benin Republic.

Igboho who will be repatriated to Nigeria on Tuesday July 20 from the neighboring country, was arrested at an airport in Cotonou three weeks after the Department of State Services declared him wanted for allegedly stockpiling arms. It was further learnt that his destination was Germany.

"Sunday Igboho has been arrested in Cotonou. He was arrested about an hour ago.

"He was supposed to travel to Germany through Cotonou this night. He wanted to leave Africa through Cotonou. He was arrested by security operatives in Cotonou.

"They are planning to bring him back to Nigeria."

Recall that the DSS raided Igboho’s Ibadan residence in Soka area on July 1, 2021, arrested about 12 of his aides and killed two of them in a gun duel.

Nigeria Immigration Service and the Nigeria Customs Service were subsequently placed on alert to stop Igboho from leaving the country.

Sunday Igboho trying to escape – Buhari govt places activist on Stop-list

The Nigerian Government has said that popular Yoruba activist, Sunday Igboho, is trying escape the country and is currently acquiring a new passport.

The government also said it had at the moment, placed the activist on the stop-list in order to facilitate his arrest.

The government said it has directed security agencies to arrest Igboho anywhere he is found.

This was contained in a letter by the Nigeria Immigration Service dated July 9, 2021 and addressed to the Director-General, Department of State Services, DSS, the Inspector General of Police and the DG, National Intelligence Agency, NIA.

Igboho was declared wanted by the DSS on allegations of stockpiling arms to destabilise the country, which he has since denied, but his whereabouts remain unknown.

Igboho’s whereabouts has remained unknown ever since his home was attacked by operatives of DSS and other security agencies attacked his home, killing some of his aides and taken his wife and other family members away.

The NIS letter titled ‘Stop-listing of person: Adeyemo Sunday Adeniyi (aka Sunday Igboho), male, Nigerian, passport number A11613637, date of birth 10/10/1972’ was signed by Assistant Comptroller General of Immigration, Investigation and Compliance, A.B. Baba, on behalf of the Comptroller General and was copied to all zonal controllers and control posts nationwide.

“I am directed to request that you kindly place the above-named person on stop-list. Credible intelligence revealed that Adeyemo is making efforts to obtain a police extract and/or court affidavit to enable him acquire a new Nigerian passport, apparently to facilitate his escape out of the country,” it reads.

“In addition, he should be arrested wherever and whenever sighted and referred to the Director-General, Department of State Services vide letter no: S.605/A/246 dated 05 July 2021.”
