No refund after payment: Peace Mass Transit Limited loses in court

Transport company, Peace Mass Transit has lost its legal battle in a matter bordering on refund of money to passengers for trips not undertaken.

The incident that led to the suit occurred on the 10th of February, 2021, when the Plaintiff, Patrick C. Chukwuma purchased a ticket from the Obollor-Afor branch of Peace Mass Transit Limited to convey him to Enugu.

Following a two hours delay occasioned by the absence of passengers, the Plaintiff returned to the ticketing office and asked for a refund of the N500 he paid as the transportation fare.

However, staff of the Defendant refused to refund the money, insisting that their company policy was that money paid for transport fare cannot be returned to the passenger and citing the statement written on their ticket to that effect as conclusive proof of their position.

When the Plaintiff tried to explain to them that their policy was unlawful, as the law mandates them to refund fares for services that have not been provided they retorted in a rude manner, prompting the learned counsel to leave their park and seek alternative means of traveling back to Enugu.

A letter written by the lawyer to the Peace Mass Group of companies demanding an apology and refund was neglected, prompting the lawyers law firm to institute the action.

Delivering its judgement, the Court through Hon. Justice C.O. Ajah declared the no refund policy as illegal, null and void in light of the provisions of Sections 120, 104, 129 (1) (a) and (b) (iii) of the Federal Competition and Consumer Protection Act, 2018.

The court further ordered the Defendant to pay the sum of N500,000 as dam.ages to the Plaintiff.

Meanwhile, many Nigerians have been reacting to the judgment, describing it as an end to imp.unity among service providers.

True Love, Age is just a number

A 25-year-old man identified as Muyiwa is set to walk down the aisle with his 85-year-old lover against all odds

The young man who is head over heels in love with the woman said the way she treated him pushed him to love her

The old woman who has 8 children and 20 grandkids is the landlady of the apartment where Muyiwa and his friend resides

Despite the 60 years age gap between them, a 25-year-old man named Muyiwa is head over heels in love with an 85-year-old woman identified as Thereza.

Thereza and Muyiwa are set to take their relationship to a new level by getting married despite disapproval from the woman's kids and the man's friend Kakule.

Muyiwa told Afrimax in an interview that he had left his country Congo for another African country (undisclosed) with the sole aim of continuing his education at the university.

It happened that Thereza is the landlady of the house where Muyiwa and his friend rented.
In the course of residing there, an incident made him realize she was the one for him.
Muyiwa said other ladies he had loved in the past were dramatic, but Thereza is just different and hopes she doesn't die before him.

On how they fell in love, Muyiwa recalled an incident that transpired one fateful Friday.

"I remember one Friday when my colleague wasn't around, I was hungry and we had no food. I was very weak. And out of nowhere, the old woman brought me some food. She came and served me with too much care,'' he recalled.

According to him, this was one of the many attitudes of the woman he experienced that got him.
"The way she behaved and treated me pushed me to loving her. Though she is an old woman and in reality could be my grandmother, but so what! I love her."

Showering encomiums on her younger lover, the mother of 8 kids and 20 grandkids said she loves Muyiwa just as he loves her. Theresa said she is ready to risk it all for their relationship.

She said: "I am 85 years of age. I have 8 children and 20 grandchildren. According to my boyfriend's age, he could be my 5th grandchild. He loves me and I also love him. I am now ready to put on the wedding dress and ring."

Price Hike: Senate Demands Pay-per-view From PayTV Operators

The Senate on Wednesday demanded that the Federal Government direct all PayTV operators in the country to introduce pay-per-view subscription model.

Senator Abba Moro, who brought the matter to the floor of the red chamber, said that Nigerians were outraged by the recent hike in subscriptions introduced by Multichoice, owners of DSTV and GOTV.

Moro said, "MultiChoice Nigeria willfully and perpetually increases the cost of its bundles because there is no regulation whatsoever. Without recourse to the economic situation of the country, MultiChoice has again raised the cost of
and bundles."

The Senate President, Ahmad Lawan in his submission said, “What is doing here, they can’t do it in many countries but here they do it & get away with it. So we need to have a public hearing. Our ad-hoc committee should be given the mandate to do a whole scale investigation.”

After deliberations, the Senate resolved to “Urge the Federal Ministry of Communications and Digital Economy, and the Nigerian Communications Commission to direct all pay-tv providers to introduce a pay-per-view model of subscription against the month to month prepaid model presently in place;

“Direct all pay-tv service providers in Nigeria to immediately review their bouquet prices downwards in tandem with the prevailing reality of economic situation in the country; and establish an ad-hoc committee to further investigate this incessant increase in fees by in this country with a view to finding a lasting solution to it.”
