*Hope Uzodinma Receives Certificate* *Of Return As Imo Governor-Elect

*
Senator Hope Uzodinma of the All Progressives Congress (APC) has received the Certificate of Return from the Independent Electoral Commission (INEC) as the governor-elect of Imo State.

He was awarded the certificate on Wednesday in Abuja, barely 24 hours after the Supreme Court nullified the election of Emeka Ihedioha as the governor of the state.

Consequently, a seven-man panel led by Chief Justice Tanko Muhammad unanimously declared the Senator the winner of the March 19 governorship election.

The appellant, Senator Uzodinma contended that he scored the highest number of votes in the election, but that INEC had returned Emeka Ihedioha as the governor of the State.

Justice Kudirat Kekere-Ekun who delivered the judgment declared that the votes due to Senator Uzodinma were unlawfully excluded from the 318 polling units and should be added to his votes.

The apex court also considered the submissions of a principal witness who was on a subpoena to present results and held that the lower court was wrong in its ruling.

While reading the lead judgment, Justice Kekere-Ekun declared Senator Uzodinma as the validly elected Governor and the Certificate of Return issued to Ihedioha be withdrawn immediately.

Meanwhile, candidate of the Action Alliance (AA), Uche Nwosu, withdrew a second appeal filed against the election of Emeka Ihedioha.

According to his counsel, Mr Solomon Umoh (SAN), the withdrawal on Tuesday is based on the judgment of the apex court which had been delivered on the 20th of December 2019.

Why Supreme Court sacked Ihedioha, declared APC’s Uzodinma winner in Imo

The Supreme Court on Monday nullified the election of Emeka Ihedioha of the Peoples Democratic Party (PDP) as the governor of Imo State.

The apex court declared Hope Uzodinma of the All Progressive Congress (APC) as the winner of the March 9 governorship election in the state.

In the unanimous judgement of the seven-member panel, read by Justice Kudirat Kekere-Ekun, the apex court agreed that results in 388 polling units were unlawfully excluded during the collation of the final governorship election result in Imo State.

Justice Kekere-Ekun said with the results from the 388 polling units added, Mr Uzodinma polled a majority of the lawful votes and ought to have been declared the winner of the election by the independent national electoral commission, INEC.

Consequently, she voided and set aside the declaration of Mr lhedioha as the winner of the 2019 governorship election.

The court ordered that the certificate of return wrongly or unlawfully issued to Mr lhedioha be immediately withdrawn by the Independent National Electoral Commission (INEC) and a fresh one be issued to Mr Uzodinma as the elected governor.

“Vote due to the appellant Senator Hope Uzodinma and the APC from 388 Polling Units were wrongly excluded from scores ascribed to the appellant(to them).

“It is thereby ordered that the appellant votes from 388 Polling Units unlawfully excluded from the appellant vote declared shall be added and that the first respondent, Emeka Ihedioha, was not duly elected by a majority of lawful votes cast at the said election.”

“His return as the elected governor of Imo State is hereby declared null and void and accordingly set aside

“It is hereby declared that the first appellant (Mr Uzodinma) holds the majority of lawful votes cast at the governorship election held in Imo State on March 9, 2019.”

The judge said Mr Uzodinma has satisfied the mandatory constitutional requirement.

“It is hereby declared that first appellant, Senator Hope Uzodinma is the winner of the governorship of Imo State held on March 9, 2019.

“The certificate issued to the first defendant (Mr Ihedioha) is hereby withdrawn.

“It is hereby ordered that the certificate of return shall be issued to the first appellant, Senator Hope Uzodinma, forthwith and he should be sworn in as the governor of Imo State,” she ruled.

Lower court’s earlier decision
The Court of Appeal on November 19 had affirmed the victory of Mr Ihedioha as the governor of Imo State.

A five-member panel of the court led by Oyebisi Omoleye delivered the judgement following the appeals filed by the Action Alliance, All Progressive Grand Alliance and the All Progressives Congress challenging the election of the governor.

The appellants had argued that Mr Ihedioha did not obtain the constitutionally required one-quarter of the votes cast in at least two-thirds of the 27 local government areas of the state, as provided under Section 179 of the Constitution.

The appellants, therefore, asked the court to set aside the decision of the election petition tribunal and declare them the winner of the election or in the alternative order a rerun.

The Three Appeals
The three appeals filed against the judgment of the Imo State Governorship Election Petition Tribunal, which upheld the election of Mr Ihedioha, include that of the All Progressive Grand Alliance (APGA) and its candidate, Ifeanyi Ararume; Action Alliance (AA) and its candidate, Uche Nwosu and that of the APC and its candidate, Mr Uzodinma.

The different appellants asked the Court of Appeal to void the election of Mr Ihedioha on grounds that he did not obtain the constitutional one-quarter of the votes in at least two-thirds of the 27 local government areas of the state, in line with Section 179 of the Constitution.

In their various submissions by their counsel, they asked the court to set aside the decision of the tribunal and declare them the winner of the March 9 governorship election or in the alternative order the Independent National Electoral Commission (INEC) to conduct a fresh election into the office of Governor of Imo State.

The three-member panel of the tribunal had in a unanimous decision delivered on September 21 held that Mr Ihedioha was lawfully declared the winner of the governorship election by INEC.

The panel led by Justice Malami Dongondaji had in the judgment dismissed Messrs Ararume, Nwosu and Uzodinma’s petitions for lacking in merit on the grounds that they failed to prove the allegations made in their petitions.

Apart from claims that Mr Ihedioha did not obtain the constitutional one-quarter of the votes in at least two-thirds of the 27 local government areas of the state, in line with the provisions of the law, the petitioners had also alleged substantial non-compliance with the Electoral Act and Guidelines, including other irregularities.

But the tribunal in its judgement held that the case of the petitioners was unmeritorious because they failed to call relevant witnesses and that evidence of witnesses called were based on hearsay.

The tribunal, in addition, rejected documents tendered by the petitioners in support of their claims on the grounds that those who led evidence in the documents were not the makers of the documents.

In his appeal, Mr Ararume urged the appellate court to upturn the decision of the tribunal on the grounds that the lower court erred in law when it arrived at the decision that his case and that of his party lacked merit and accordingly dismissed it.

The appeal which was predicated on 22 grounds was argued by his lead lawyer, Awal Kalu, while that of Mr Nwosu and AA, was argued by Niyi Akintola. That of Mr Uzodinma and APC was argued by Damian Dodo.

They all urged the panel to allow the appeal and grant all the relief sought by the appellants.

However, lead counsel to Mr Ihedioha and the PDP, Onyechi Ikpeazu and Kaham Ejelam respectively, urged the court to dismiss the appeals for being incompetent and lacking in merit.

In a U-turn on Tuesday, Mr Nwosu withdrew his appeal, through his lawyer, Solomon Umoh.

He withdrew the appeal based on a December 20 Supreme Court ruling that Mr Nwosu was not a validly nominated candidate for the election.

The respondents in the matter, including Mr Ihedioha and the PDP, did not object to the application of Mr Nwosu to withdraw his appeal before the apex court.

Consequently, the court dismissed Mr Nwosu’s appeal.

COURT OF APPEAL RULING ON IMO GOVERNORSHIP ELECTION PETITION: ANOTHER VICTORY FOR DEMOCRACY.

The judgement of the Court Of Appeal, upholding the verdict of the Imo Governorship Elections Petitions Tribunal and affirming the victory of the People's Democratic party and His Excellency Rt. Hon. Emeka Ihedioha at the 2019 governorship elections in Imo State once again vindicates the collective will of the people and our faith in democracy, rule of law and the Judiciary.

As I join Imolites in yet another round of deserved jubilation, I seize this opportunity to congratulate our able governor, His Excellency Rt. Hon. Emeka Ihedioha, his deputy, Hon, Engineer Gerald Irrona, all members and supporters of our great party, all Imolites and indeed all lovers of democracy on yet another victory for democracy.

I congratulate as well, all gubernatorial candidates of the major opposition parties in Imo State for their remarkable effort in testing and strengthening our democracy and the rule of law. I dare say that our electoral victory would have been undervalued and diminished without their courageous and relentless challenges and expostulations.

But now that the verdict has been delivered and upheld, it is time to end the war of attrition, sheath the swords, close ranks and join hands to "rebuild" our common heritage - Imo.

From all reasonable indications , it is obvious that further litigation will only amount to avoidable waste of time and resources which our dear state can ill afford.

As our peace loving governor has extended the olive branch, I call on all Imolites , irrespective of political leaning to join hands in the "rebuild"process even as we bask in the euphoria of another win for democracy.

Umuiwuogu community in mabitoli LGA boils as youths murders suspected ra**st.

One Mr Pascal Uba aged 41 was yesterday slaughtered by youths of the area for allegedly attempting to r**e one Mrs Ebere who went to her farm.
Source confirmed that the deceased has been behaving abnormal since his return from Lagos last three years.

The father of the deceased said he son is a labourer and has no previous report of stealing or r**e adding that no one came to report to him about the matter instead they laid siege for him in the night and killed him.

Imo Govt. Disowns Group Over Ultimatum to Herdsmen

…Says State Hospitable, Receptive to Visitors

The Government of Imo State has disowned an ultimatum issued by a Group, under the aegis of Coalition of South East Youth Leaders, giving herdsmen in the state 24 hours to quit.

According to a Statement issued by the Chief Press Secretary to the Governor, Chibuike Onyeukwu, the group lacks legitimacy to speak for the state.

Onyeukwu described the report of the ultimatum as an embarrassment to the Government and people of the state, urging members of the public to disregard it.

“The attention of the Government of Imo State has been drawn to a report on some news media, credited to a group, which identified itself as Coalition of South East Youth Leaders, giving herdsmen in the state 24 hours to quit.”

“The group, led by one Goodluck Ibem relied on an alarm allegedly raised by the management of the Federal University of Technology, Owerri, accusing herdsmen of destroying their farm lands and crops, among other concerns.”

“The Government of Imo State, under the leadership of Rt. Hon. Emeka Ihedioha CON, hereby dissociates itself and entire good people of the state from the said ultimatum to herdsmen in the state.”

“Imo State Government is embarrassed by the development and has taken steps to prevent breakdown of law and order in the state.”

“While efforts are being made to ensure that concerns raised by the management of the Federal University of Technology, Owerri are addressed, let it be on record that the Governor Emeka Ihedioha - led administration shall not tolerate a situation where individuals take the laws into their hands.”

“For the avoidance of doubts, citizens of Imo State are very peaceful, hospitable and have always enjoyed cordial relationship with neighbours and strangers in the state.

Imolites are at peace with residents and have no axe to grind with anyone living or doing business in the state, as long as such transactions do not in any way violate the laws of the land or constitute public nuisance.”

“The general public is therefore advised to disregard the report and go about their normal businesses without fear or favour.”

Substantive IMO POLY Rector drags Gov. Emeka Ihedioha to court for his unlawful removal from office.

Dr. Kingsley Okechukwu Ikebudu, the substantive Rector of Imo State Polytechnic Umuagwo has dragged the Governor of of Imo Emeka Ihedioha to court over his unlawful removal shortly after his appointment.

It is on record that the former Governor of Imo State Owelle Rochas Okorocha appointed Dr. Kingsley following recommendations by the institutions governing council, on the 29th of April, 2019. But this was followed by his alleged unlawful removal and his new bid to seek justice from a court of competent jurisdiction.

Dr. Kingsley made the revelation over the weekend while interacting with men of the Press. He said, “there was a Pre-Action Notice of Claim dated June 28, 2019 and signed by Dr. E. S. C. Obiorah of Equity Law Office, on behalf of the Substantive Rector of Imo State Polytechnic Umuagwo – Engr. Dr. Kingsley Okechukwu Ikebudu in respect of unlawful attempts to declare his position as Substantive Rector of Imo State Polytechnic Umuagwo vacant and/or to terminate his appointment without any fault on his part"

“This was earlier served on Governor Ihedioha for immediate reinstatement as the final notice prior to the rector’s commencement of legal actions for damages, injunction and declaratory and/or mandatory orders against the Governor without any further notice on him, but up till now nothing has been done by governor Emeka Ihedioha led administration, hence his legal action,” Dr. Kingsley added

He finally noted that the court was the last hope of the common man, saying that this was his reason for taking governor Ihedioha to court to seek for justice.

Based on facts on grounds the appointment of the Rector and Principal Officers of Imo State Polytechnic are tenured subject to the Imo State Polytechnic Law No. 15 of 2012. The advert made on Daily Sun Newspaper Monday 25/3/2019 stated internal and external; hence, due process was followed in appointment of Dr. Ikebudu as Rector of the Polytechnic.

Of the 133,792 persons screened for the Human Immune Virus (HIV) between January and June this year in Imo State, 3,891 of them tested positive to the infection.

Also, two out of every 100 persons were infected by the virus in the state.

The Programme Coordinator of the State AIDS and Sexually Transmitted Infection Control, Dr Desmond Emenalo, made the disclosure yesterday in Owerri during the Imo State Inaugural Surge Consortium by Caritas Nigeria.

Governor Ihedioha Appoints Visitation Panel for Imo State Polytechnic.

Governor Emeka Ihedioh CON has approved the constitution of a Visitation Panel for Imo State Polytechnic, Umuagwo.

The panel is composed of the following:

1. Prof. Eugene Opara - Chairman
2. Prof. Martin I. Nwafo - Member
3. Prof. Poly Chigbu - Member
4. Dr. Mrs. Regina Amadi - Member
5. Dr. Felicia Anyanwu - Member
6. Mr. Robert Akujuobi - Member
7. Ms. Ifeyinwa Okafor - Member
8. Nwoko Ikedichi Sabinus - Member
9. Mr. Nnaemeka Nnoromele - Secretary

Terms of Reference:

i. To identify the strength and problems of the Polytechnic and make appropriate recommendations to the Visitor;

ii. To ascertain the operations of all Faculties, Departments, Units, Directorates, including, Students' Affairs, Academic Planning, Works, ICT, Continuing Education Programme, Procurement and other issues, such as Cliqueism and Cultism;

iii To ascertain the operations of the Polytechnic and investigate students' complaints bothering on various issues;

iv. To conduct audit of the Polytechnic's revenue and expenditure, including the Bursary Department, aimed at ascertaining the financial status from 2012, including Internally Generated Revenue(IGR), Polytechnic Micro Finance Bank and come up with a comprehensive report;

v. To investigate award of contracts in the Polytechnic and ascertain if due process was adhered to, in line with the Procurement Law;

vi. To investigate state of infrastructure, including collapsed or collapsing buildings;

vii. To ascertain the welfare of students investigate allegations of sexual abuse, extortion, issues bothering on allocation of hostel, substandard books, hangouts, SUG election and illegal payments.

viii. To make any other recommendation(s) on issues not listed in the Terms of Reference but necessary for the smooth running of the Polytechnic

Inauguration of members of the panel holds today, Wednesday, November 13, 2019 by 1pm at the Expanded Executive Council Chambers, Government House Owerri.

Members are requested to be seated by 12:30pm.
