“To become a true global citizen, one must abandon all notions of 'otherness' and instead embrace ' togetherness'. '' The world is no longer white, black, yellow and brown. Through love, tribes and clan have been intermixing colors to reveal a new rainbow world. And as more time passes, this racial and cultural blending will make it harder for humans to side with one race, nation or religion over another. Therefore, practical wisdom should be used to abandon any cultural, social, religious, tribal, and national beliefs of alterity altogether. This is the only way mankind will truly evolve. Segregation is a word of the past. Unity is the key to a peaceful future.
Therefore, Alhaji Usman Ododo candidacy is for the best interest of Kogite. And it based on merit and competency. He posses exceptional leadership qualities that distinguish him from his combined opponents. Let buried the tribalism and beat the drum of competency. ‘Are we joking?’: Why Dino Melaye can’t be Kogi gov — Wike

Governor Nyesom Wike of Rivers state has rubbished Senator Dino Melaye’s alleged governorship ambition, saying the Peoples Democratic Party (PDP) chieftain does not have what it takes to contest for the Kogi state’s governorship.

Wike disclose this during a live media chat with selected journalists in Port Harcourt on Tuesday.
He stated, “Why would Kogi people say they would vote for a candidate like Dino? Are we joking?
“When you give Dino that ticket, you know he won’t win in Kogi State,” Wike said during the parley.

According to Wike, the mere fact that someone is from a place does not equate to electoral success if such a person contests an election.

“Dino does not have what it takes [to be a governor] for crying out loud,” Wike maintained.

“He knows me very well. He does not have what it takes to be a governor.”

Wike added that if the PDP gives the ticket to Melaye, the party is doomed to lose the exercise.

He said, “Does it mean now that if the PDP wants to win the election, it would give the ticket to Dino and you say tomorrow that you were rigged when you have already killed yourself?” he wondered.
“Are we saying that we want to win an election or just have a candidate?” he added.

The governor said he won’t campaign for the PDP if the party gives its governorship ticket to the former Kogi lawmaker.

When asked if he would campaign for the main opposition party if Dino wins the ticket, Wike said, “Do you need to ask me that kind of question? Are you not aware that I would not do that?”

Accusing the PDP leadership of trying to “manipulate” the process in favour of Melaye, Wike said, “Why are you trying to manipulate this in favour of one aspirant?''

EFCC Asks Court to Dismiss Gov Yahaya Bello’s Application to Vacate Forfeiture Order on 14 Properties, N400m

The Economic and Financial Crimes Commission, EFCC, on Tuesday, March 28, 2023, urged Justice Nicholas Oweibo of the Federal High Court sitting in Ikoyi, Lagos to dismiss the application by Kogi State Governor, Yahaya Bello, seeking to vacate the forfeiture order in respect of 14 properties and the sum of N400m.

The court had, on February 22, 2023, granted a preservation order of the properties linked to the Kogi State government and reasonably suspected to have been derived from unlawful activities, pursuant to Sections 9 and 10 of the Proceeds of Crimes (Recovery and Management) Act, 2022.

The properties including “Hotel Apartment Community, Burj Khalifa lying, being and situate at, Plot 160 Municipality NO 345-7562, Sky View Building No 1, Property No 401, Floor 4, Dubai U.A.E.”, were reasonably suspected to have been derived from unlawful activity.

At the resumed sitting today, the EFCC counsel, Rotimi Oyedepo, SAN informed the court that the preservation order had been published in the Punch Newspaper, in line with the court’s directive to advertise the same in one of the national dailies.

Oyedepo said: “We were directed to make a publication of the said Order and we have complied with the order of the court.

“There is an affidavit to the Order dated 22nd February, 2023, which was complied with on the 24th February, 2023.

“Sequel to that, we have received a notice of intention to oppose the making of the preservation order and we have equally responded”.

Responding, the Kogi State Governor, through his counsel, Abdulwahab Mohammed SAN, sought to vacate the order of the court, saying, “We have an application subject to your lordship’s convenience. We are ready to move the application. It was filed on March 9, 2023. The application is seeking your indulgence to vacate the order of the court made on the 22nd of February, 2023.

He argued that most of the properties sought to be forfeited were acquired by Bello before he became the Governor of the state and that the Commission lacked the power to proceed against the governor as he enjoys immunity under the constitution.

“By virtue of the position of the applicant (Kogi State Governor), you cannot proceed against him under any law, according to Section 308 of the Nigerian Constitution.

“If you want to prosecute or forfeit his properties, you have to wait till he no longer enjoys those benefits of a Governor,” he argued.

He, therefore, urged the court to grant his client’s prayers and vacate the order

In opposing the application, EFCC counsel Oyedepo relied on depositions in the 12-paragraph counter-affidavit and a written address dated 28 March, 2023, stating that the applicant failed to reply to the counter-affidavit made by the prosecution.

“In Usman against Garke, it was reported in 2003, LPLR 3431, Supreme Court, and our submission is that failure to reply to the counter-affidavit has a single legal consequence that the respondents are agreeing to the application. We urge your lordship to hold that the failure to respond is deemed admitted.

“We have cited authorities to this effect, one of which is Patience Jonathan and the FGN, in paragraph 1.08 of our submission. The Proceeds of Crime (Recovery and Management) Act, 2022 prescribes the mode of challenging the preservation order of the court and the steps to be taken by the party challenging the making of the preservation order.”

Oyedepo submitted that one of the requirements that the application must contain is that the applicant must show his interest in the property concerned.

“Apart from Paragraph 4H and I of the affidavit in support of the notice of intention, there is nothing before this Honourable court showing, by way of credible evidence, how the properties were acquired.

“In our counter-affidavit, we have established how the properties were acquired and there is nothing challenging how the properties were acquired.

“What was deposed is that, most of the properties were obtained before he became Governor of Kogi State and the properties were not acquired through illegal means.

‘”Without establishing the interest of the applicant, the application is bound to fail.”

On the immunity clause as contained in Section 308 of the 1999 constitution, Oyedepo said: “the Provision of S308 will not and cannot be construed to a ridiculous extent of preventing the state from investigating the beneficiary of the section.

“As far back as 2002, in the case of Fawehinmi and IGP, the court mentioned that a person protected under S308 can be investigated; and the fact that someone is under immunity does not prevent the state from investigating.

“Where a state governor is reasonably suspected to have committed a financial crime, the state can investigate for evidence that will be used in prosecution when he no longer enjoys the immunity.”

Oyedepo also argued that the steps the prosecution was taking “is a step for preservation and it cannot be stopped.”

He further told the court that, out of the entire assets that the EFCC seeks to preserve, only one asset was declared in the applicant’s Declaration of Assets Form and that nothing had been said in the affidavit to challenge “the reasonability of our suspicion.”

He, therefore, urged the court to dismiss the prayers of the applicant and order him to tell the court how the properties were acquired.

Justice Oweibo adjourned the matter till April 20, 2023 for ruling.

Kogi State House of Assembly has suspended nine of its members on allegation of terrorism.

Kogi Central election sham, undemocratic – Natasha Akpoti-Uduaghan
“I will say the entire election in Kogi Central is a sham, I find it quite barbaric and undemocratic… I will pretty much say 90 per cent of the polling unit had no elections but surprisingly results came out of them,” she said.
The Peoples Democratic Party (PDP) Kogi Central Senatorial candidate, Natasha Akpoti-Uduaghan has described the elections in Kogi Central as a sham, barbaric and undemocratic.

“I will say the entire election in Kogi Central is a sham, I find it quite barbaric and undemocratic… I will pretty much say 90 per cent of the polling unit had no elections but surprisingly results came out of them,” she said.

Mrs Akpoti-Uduaghan lamented the acceptance of the results despite her party’s complaints and petitions.

According to her, Okene Local Government experienced the highest violence of all five local government areas including ballot and BVAS snatching, even five INEC staff were abducted but rescued by the DSS operatives.

She further accused Yahaya Bello, the governor of Kogi, of rigging. “…nine polling units did not have their elections on 25 February, materials were not delivered and INEC officers did not present themselves at that point I knew the governor had targeted that Ganaja as an axis to rig in case his Okene plan failed.”

Mrs Akpoti-Uduaghan insists that she won the election and therefore, rejects the final results announced by the returning officer.

will interest Nigerians to know that the total number of accredited voters in Okene is 26,860 but the sum of the votes that came out is 38,315,” she said.

''She alleged that elections in Okene Local Government were “highly manipulated” in connivance with the electoral officials and APC thugs who invaded many polling units, chased out voters and snatched ballot boxes which were filled in a private residence.
APC in collaboration with INEC officials disregarded electoral guidelines, fraudulently rigged Okene local government area with a high number of over-voting. The results of the 11 Wards in Okene local government were highly doctored,” her campaign team said.

Mrs Akpoti-Uduaghan said she will not go to court, rather she will take advantage of the seven days window given by INEC to contest the election.

Section 65 of the Electoral Act allows INEC to review results declared by a returning officer under duress within seven days or where such a declaration was made contrary to the provision of the law, regulations and guidelines, and manual for the election.

The decision of the returning officer shall be final on any question arising from or relating to (a) unmarked ballot paper ; (b) rejected ballot paper; and (c) declaration of scores of candidates and the return of a candidate: Provided that the Commission shall have the power within seven days to review the declaration and return where the Commission determines that the said declaration and return were not made voluntarily or was made contrary to the provisions of the law, regulations and guidelines, and manual for the election.

The Independent National Electoral Commission (INEC) on Monday cancelled the results of 74 polling units in six local government areas of Kogi State over thuggery. It failed BVAS that characterised Saturday’s polls.

The News Agency of Nigeria (NAN) listed the LGAs involved: Okehi, Umala, Olamaboro, Ofu, Yagba East and Ibaji out of several others that suffered a similar fate.

Barely 48hrs to the 2023 general elections, the Nigeria Police on Thursday arrested workers of CCECC construction firm allegedly engaged by the Kogi State government to cutoff roads to prevent INEC officials and other stakeholders from accessing the senatorial district.

According to the workers; Mr. Ismail Abdulganiyu and Sheidu Amoto who were arrested by the police while digging pits in major access roads to Okehi local government area, they stated that they were commissioned by the Okehi Local Government Chairman, Hon. Abdulraheem Ohiare and instructed to carryout the assignment by one Mr. Toni, the project manager of the company in Kogi State.

Upon interrogation, Ismail confessed that he is a staff of CCECC construction firm while Sheidu said he is a staff of Kogi State Ministry of Works; admitting to the collaboration between CCECC construction firm and Kogi State Ministry of Works to block access roads in Kogi Central ahead of the February 25, 2023 general elections.

As at the time of filing this report, the
CCECC firm has already dug pits in four major access roads in Okehi local government area.

Several reports confirmed that the company under the order of the Kogi State government will carry out the same assignment in other four local government areas of Kogi Central to prevent INEC officials from accessing the senatorial district and prevent the impending defeat of the APC candidates.
