..SDP Star Witness Denies Been in Kogi on Election Day, Says Anyone can Doctor BVAS Information

Case-value recession hit the camp of the Social Democratic Party's candidate, whom is challenging the electoral victory of the APCs candidate, Alhaji Usman Ododo, today, in court as the lawyers of the defendant and INEC cross examined the star witness of the SDP who demonstrated the BVAS machine.

The defense Counsel, Agabi, SAN, opened his cross examination on behalf of the APC. The learned silk questioned the witness brought forward by SDP who is an INEC staff, enquiring if he was a Presiding Officer (PO) of the recent elections held in Kogi State. The witness submitted a negative report, on a bold "NO".

In further cross examination, the witness was also questioned on his exact location on the day of the election, which he stated as "Imo State".

On the BVAS machine:

Below constitutes a summary of questions put to the star Witness from INEC and APC Lawyers:

Our Defense Counsel Agabi, SAN put *Q1*: Based on the INEC manual, it is the duty of the Electoral officer/adviser to receive the Electoral materials for the Election & passes same to the presiding officer?

Witness Response: YES.

Q2: Are you a presiding officer during the Election in Kogi State?

Witness Response: No

Q3: We understand that the BVAS devices can also contain Form E8-A & pictures & these were supposed to be attached to the BVAS?

Witness Response: Yes

Q4: But were these items (Form-E8-A & pictures ) part of what you showed to the Tribunal since you started?

Witness Responded: That the items were NOT attached & it was NOT part of what he showed to the Tribunal.

Q5: Did you have the records of ALL the BVAS used for the elections in Kogi state?

Abdulmalik of INEC (witness) said that he can confirm that he does not have the records or seen any of the BVAS Machine or the records kept for each before now (coming to the Tribunal)

*The Second Lawyer after SAN- Agabi* took over and below were the questions he asked:

Q1: What is your name again, please?

Witness response: AbdulMalik.

Q2: Is it the first time you are seeing the BVAS machine?

Witness Response: No

Q3: Where were you on the day of Election in Kogi State?
Witness Response: Imo State.

Q4: Isn't it true that the Polling Unit officers, APO1 & 2 to work together?

Witness Response: Yes.

Q5: So you were NOT one of the Polling Unit officers in any of the polling units in Kogi state Gubernatorial Election before you came to the Tribunal as witness?

Witness Response: YES

Q6: The letter served from the Tribunal to your office has the PUs listed to be brought to court ; please take a look at the letter. He (witness) was handed the letter to take a look
The witness Responded by saying . *He was not part of those who brought the BVAS to the Tribunal*
Confirming that he didn’t know the serial numbers of the BVAS & PUs; and he was not given.

But He (the witness) is aware that the PUO is responsible for sending results?

Witness answered: YES

Q7. What is your role here then?

Witness Response: It is the BVAS machine only that he tendered; after he saw the order. He said he is familiar with the INEC manual for Governorshil Elections to some extent.

INEC Lawyers Cross Examine SDP Star Witness on BVAS inter alia:

Q1: Is there a role assigned to *Programme Analysts* of INEC on Election Day?

Witness Responded, by saying NO. (Moreso, he was in Imo State on the election day)

Q2: As an INEC official , do you have any written Authorization from the Attorney General of the Federation (like His consent sorted by your office before you came to the Tribunal)?

Witness Response: NO

Q3: You never showed any Form: C8-A uploaded on the BVAS machine for the whole time you spent showing & demonstrating evidence of the Registered and Accredited Voters?

Witness Response:YES

Q4: The BVAS could only recognize the face & login credentials of the PUOs?

Witness Response: YES, and with login details .

Q5: If a thug sees a BVAS device with the correct Login details; he can login into the device?

witness Response: YES

Q5: BVAS can be re-configured again for another Election & for other reasons?

Witness Response: YES, It can be re-configured and old data erased and new data imputed.

Q7: INEC has other backup BVAS of about 900 Devices for Kogi State Election, are you aware?

Response: No

He was also asked whether some of those backup BVAS were here? Which he said, NO.

Q8: NOT ALL the BVAS machines used for the Elections in Okene, Adavi, Okehi, Ogorimagogo, Ajaokuta and Lokoja LGA are here?

Witness Responded by saying: YES

Tribunal Judge stopped the cross examination and adjourned the sitting till tomorrow, 26th of March, 2024.

Many of u seem to forget that someone from tribe/region is representing ur constituency in both the Senate & House of Reps, u have House of Assembly members, Local Govt chairmen, & some appointees as commissioners also as SA & SSA in govt. Now what is ur leader doing with the Local, State, & Federal positions they hold? Ask urself that before u being a local big¤t. M-BIG has the track-Record of grassroots politics of inclusiveness and human development investment.
M-BIG is born leader. Let's support him with every possible means available to us. May Allah SWT gives him more wisdom and power to do more for his constituency and beyond.
