The Attorney General of the Federation and Minister of Justice, Lateef Fagbemi (SAN), has officially taken over the prosecution of Abubakar Abdulkadir, also known as Julde, and six others charged with terrorism and kidnapping.

At the Federal High Court in Abuja on Thursday, Justice Emeka Nwite adjourned the trial to February 17, 2025, to accommodate the AGFโ€™s intervention in the case.

The trial, initially prosecuted by the Inspector-General of Police, involves 19 counts against Abdulkadir and his co-defendants for acts of terrorism and kidnapping in Taraba State.

The prosecution alleged that between February and November 2022, the defendants carried out attacks in Sabon Gida village, Gassol Local Government Area, kidnapping Alhaji Maidabo Zide and other residents, demanding ransom, and stealing property, including livestock and vehicles.

Count 19 of the charges detailed a December 2022 incident in Jatau village, Bali LGA, where the defendants, armed with weapons, allegedly killed two residents, Muhammadu Umar and Bagudu Umar, and stole 26 cows and food supplies.

The prosecution said the acts contravened sections of the Terrorism Prevention and Prohibition Act, 2022.

At Thursdayโ€™s proceedings, counsel for the IGP, Audu Garba, informed the court that the case file had been transferred to the AGFโ€™s office.The AGF has requested the case file, and it has been transferred accordingly,โ€ he said.

Justice Nwite confirmed receiving a letter from the AGF requesting an adjournment to January 29, but said the courtโ€™s schedule necessitated a February 17 date.

Counsel for the defendants did not oppose the adjournment.

However, Manjok Agom, representing the 1st, 2nd, and 4th defendants, raised concerns about the caseโ€™s delay, stating, โ€œWe are applying for the matter to be struck out since the AGF is now the prosecutor but is not in court today.โ€

But Justice Nwite rejected the request, clarifying that the case could not be struck out due to the AGFโ€™s formal assumption of the prosecution.

He said, โ€œThe matter is adjourned to February 17 for a report from the Honourable Attorney General.โ€

PRESIDENT BOLA TINUBU APPROVED THE APPOINTMENT OF BOARD CHAIRPERSONS AND CEOS

President Bola Ahmed Tinubu has appointed board chairpersons for 42 federal organisations and a secretary to the board of the Civil Defence, Immigration, and Prisons Services.

The President has also appointed a new managing director for the Nigerian Railway Corporation and a director-general for the National Board for Technology Incubation (NBTI).

President Tinubu directs the board chairpersons not to interfere with the management of the organisations, emphasising that their positions are non-executive.

All the appointments take immediate effect.

2003: The Federal Government awarded a $6 billion Build, Operate, and Transfer (BOT) contract to Sunrise and its Chinese partners after an international bidding process.

2005: Sunrise Consortium secured $5.5 billion in financing from China Eximbank to execute the project.

2007: The government annulled the BOT contract with Sunrise and instead signed a $1.46 billion civil works agreement with China Gezhouba Group Corporation (CGGC) and China Geo-Engineering Corporation (CGC), breaching the initial agreement.

May 2007: Sunrise initiated legal actions to challenge the contract termination, resulting in a 14-year delay that prevented the new contractors from commencing work.

November 2007: Sunrise petitioned then-President Umaru Yarโ€™Adua. In 2009, the government terminated the $1.46 billion EPC contract.

November 23, 2012: A General Project Ex*****on Agreement (GPEA) was signed between the Federal Government, Sunrise, and its Chinese partners to revive the project.

November 12, 2017: The government controversially awarded a $5.8 billion EPC contract to another Chinese consortium, despite warnings from the Attorney-General to honour the GPEA.

2018: Sunrise filed a $2.3 billion arbitration claim with the International Chamber of Commerce (ICC), seeking damages from the Federal Government and the Sinohydro Consortium.

2019: Following Chinese government intervention, a special envoy visited former President Muhammadu Buhari, leading to settlement talks.

2020: A settlement agreement was reached in January, contingent on approvals from China Eximbank and the Chinese Ambassador to Nigeria. The Federal Government failed to meet the agreementโ€™s terms.

2021: Sunrise withdrew its $500 million arbitration claim in September, demanding financial commitments and recognition as the projectโ€™s exclusive local content partner. The government defaulted again, delaying payments to contractors and contributions to counterpart funds.

2022: On October 13, the ICC ruled against the Nigerian government, rejecting its objections.

2023: The Economic and Financial Crimes Commission (EFCC) accused former Minister of Power Olu Agunloye of awarding the BOT contract without proper approvals and alleged he received a N3.6 million bribe in 2019 from Sunrise and its Chairman, Leno Adesanya.

2024: Former President Muhammadu Buhari is expected to testify in international arbitration over breaches of the Mambilla project contract.

N33.8 BILLION FRAUD: How I Received More Than N22bn from Federal Ministry of Power- BDC Operator

The trial of former Minister of Power, Saleh Mamman continued on Wednesday, January 22, 2025 at the Federal High Court, Abuja, presided over by Justice James Omotosho with the Economic and Financial Crimes Commission, EFCC presenting its 8th witness, PW8.

The witness, PW8 Abdullahi Suleman, a bureau de change operator, narrated how more than N22 billion was allegedly siphoned from the Federal Ministry of Power while Mamman was Minister. He said the naira equivalent of the money was exchanged for United States dollars through his business accounts.

Mamman is being prosecuted by the EFCC on a 12-count charge bordering on conspiracy to commit money laundering to the tune of N33,804,830,503.73 (Thirty-three Billion, Eight Hundred and Four Million, Eight Hundred and Thirty Thousand, Five Hundred and Three Naira, Seventy-three Kobo).

At Wednesdayโ€™s proceedings, Suleiman, while being led in evidence by prosecution counsel, Rotimi Oyedepo, SAN narrated that about 12 of his business accounts received money from the Federal Ministry of Power without carrying out any service, contact or project. His companies; Prymint Investment Limited, Strong Field International Projects Limited, Mintedge Nigeria Limited, First Class Construction and Project, Silverline Ocean Ventures, Golden Bond Nigeria Limited, Sipikin Global Enterprise, Spinhiills Biz International limited, Fullest Utility Concepts Limited, Platinum Touch Enterprises, Breathable Investment Limited and a company owned by his brother named Gurupche Business Enterprises were used for the transactions.

โ€œI know Alhaji Maina Goje, we are in the same business, sometimes in 2019, Maina Goje met me that he has transaction that I should give him some of my account numbers, the first account I gave him was Fullest, he will send money and I will give him dollars, he started asking for more accounts, he will tell me what to do with the transactions, I will get the dollar and give him and sometimes I will do a transfer to other accounts. We have been working together since then till 2024. From my rough calculations, the amount I have received through the transactions will be more than 22 billion naira. Also Maina used to send someone called Musbhu anytime he was not available, he would send him and give me instructions on what to do with him, we do call him Yaro Minister because he is from Saleh Mamman", he said.

Continuing, โ€œ I also know Mr Mustapha Muhammed, Goje told me that he is his oga, I didnโ€™t know him before until Maina Goje introduced him to me, then I learnt he works with Federal Ministry of Housing and instructed that anytime they canโ€™t reach him, I should give him the amount of dollars he requestedโ€

When shown Exhibit X series, which contained bank statements generated from his companies showing evidence of money inflows into his bank accounts with Strong Field international Projects Limited, Mintedge Nigeria Limited, Prymint Investment Limited, the witness admitted that they were the accounts he gave Maina Goje.

Among some of the notable transactions shown to him on the accounts were; N285,983,285 received on 24th May 2021, N278, 248.611 on 26th May 2021, , N320m on 1st January, 2021, 184m on 18 June, 2021, N178,300,285 on 14th July 2021, , N75,420, 000 on 5th August 2021, N75,120,000 on 1st December 2021, N68,150,620 and N70,650 on 15th December 2021, N90,247,395 on 12th Jan 2022, N64, 747,627 on 16 February 2022, among others and he agreed receiving them.

Earlier, a Compliance Officer from FCMB presented and tendered bank statements and attachments in a reply letter to the EFCC dated August 16, 2024 in respect of Prymint Investments Limited, Platinum Touch Enterprises, Royal Perimeter Ventures, Golden Bond Nigeria Limited, Flex Utility Concepts Limited, Bentech Nigeria Limited admitted and marked Exhibit XTUB.

The judge adjourned the matter to 23 January, 2025 for continuation of hearing.

A Prosecution Witness, Mr Ismail Lawal, on Tuesday told a Federal Capital Territory (FCT) High Court that former governor of Taraba, Darius Ishaku gave him 5,000 dollars to relocate to Lagos.

The Economic and Financial Crimes Commission (EFCC), on Sept. 30, 2024, arraigned Ishaku and former permanent secretary, Bureau for Local Government and Chieftaincy Affairs in the state, Bello Yero for fraud.

Both are being prosecuted on a 15-count charge, bordering on criminal breach of trust, conspiracy and conversion of public funds to the tune of N27 billion.

Testifying, Lawal alleged that Ishaku gave him the money to relocate when he learned that the EFCC was investigating him.

Lawal informed the court that he worked as a system analyst in 2011 with Excelarc Partners, owned by the former governor.

He added that he was later called in 2012 to work as a personal assistant to Ishaku when he (former governor) was appointed Minister of State for Power.

The witness said that when Ishaku became governor of Taraba in 2015, he invited him to work with him as personal assistant.

โ€œI was in charge of the former governorโ€™s mails. I ran errands for him as well as collect money from the accounts section of the Government House in Jalingo and followed the governorโ€™s instructions on what to do with the money,โ€ he said.

He was in his evidence by the prosecution counsel, Rotimi Jacobs SAN .

Lawal added that he was paid a monthly salary of N130,000 in cash by the former governor.

โ€œI was informed that the EFCC needed me for questioning on June 12, 2021.

โ€œI was ready to show up but I was later told by the former governor not to appear in the EFCC office. He said I should stay away.

โ€œI was in Lagos for close to two years. I moved from one hotel to another. I donโ€™t know how the EFCC officials traced my whereabouts to my hotel in Magodo, Lagos,โ€ he said.

The witness said that upon his arrest, he was transferred to Abuja from Lagos.

โ€I was shown a CCTV footage of how I collected money from the UBA branch at Jabi in Abuja and also shown my bank statement in Zenith Bank current and savings accounts,โ€ he said.

In spite of objection by the defence counsel P.H.Ogbole ,SAN for Ishaku and Adeila Adedipe SAN, for Yero, the prosecution counsel, Jacobs tendered the statements of account of the witness, which were admitted by the court as exhibits.

He told the court that each time money was paid into his account, he gets a call afrom either Permanent Secretary, Government House, Jalingo, Mr Chindo Audu or the Director of Finance, Mr Galenya Lydia.

โ€œThey always tell me that they sent money meant for His Excellency and that I should withdraw and give it to him (Ishaku).โ€

Justice Sylvania Oriji adjourned the case until Jan. 28 for continuation of hearing.(NAN)

Impending cabinet reshuffle unsettles Taraba commissioners

Mr. Tanko Adi, resident of Jalingo, told our correspondent that many Commissioners have lost a sense of direction with no vision to deliver on the Moving Forward train of the administration.

โ€œThe zeal with which the administration started is dying down. Most of the commissioners are not working. Go to the ministries and see what is happening. Once the governor is out of town most of the Commissioners donโ€™t report to work in their offices.

โ€œThese set of Commissioners have lost touch with the people and the reality is that if they are allowed to stay till 2027, it will be bad for the governor. Instead of going out to attract investment and benefits to the state, most of the commissioners are busy waiting for the governor to approve memos for them, sometimes for projects that are of no benefit to the people.โ€

Taraba State University ASUU Chapter Suspends Strike After Government Commitments

The Academic Staff Union of Universities (ASUU), Taraba State University (TSU) Chapter, has suspended its strike action initiated on December 5, 2024. The decision comes after a series of negotiations with the Taraba State Government, culminating in agreements to address the long-standing issues plaguing the institution.

The strike, according to ASUU-TSU, was necessitated by the partial implementation of several Memoranda of Understanding (MoUs) and Memoranda of Action (MoAs) signed with the government since 2014. These agreements covered critical issues, including university funding, earned academic allowances, staff pensions and gratuities, backlog of salaries, and compliance with minimum wage adjustments.

Key Agreements Reached:
1.University Funding: The government, through the Governing Council, committed to enhancing funding in alignment with Taraba State Law No. 4 of 2008.
2. Earned Academic Allowances (EAA): An initial 10% of the accumulated sum has been disbursed, with 5% to be paid monthly starting February 2025, until all arrears are cleared.
3. Pensions and Gratuities: Approval has been given for a State-Defined Pension Scheme to ensure prompt payment of benefits.
4. Backlog of Salaries: A template for clearing outstanding salaries will be finalized by the first week of February 2025.
5. Constitution of a Governing Council: Membership will be adjusted to meet statutory requirements.
6.Minimum Wage Adjustments: Implementation of the wage adjustment has commenced, with a promise of timely salary payments.

ASUU-TSU Expresses Gratitude
The union expressed profound gratitude to Governor Agbu Kefas for his leadership and commitment to resolving the crisis. The union acknowledged the governor's personal intervention, dialogue-driven approach, and dedication to addressing their concerns. They also extended appreciation to the Ministry of Tertiary Education and the University Administration for their collaborative efforts.

ASUU National and the TSU Congress were also commended for their unwavering support, which was instrumental in achieving this resolution.

According to sources, Esther Gana, who officially retired on October 27, 2024, has refused to vacate her position, continuing to perform all duties, including signing checks and awarding contracts. Further investigation revealed that Gadi's qualifications, a Bachelor of Science (BSc) in Nursing, fall short of the standards set by the Nursing and Midwifery Council of Nigeria (NMCN) and the National Board for Technical Education (NBTE) for the role of provost.

The staff member added, "Her appointment was mindboggling because obviously she didn't qualify; the immediate past governor, Darius Dickson Ishaku appointed her through the obnoxious Nigerian 'man-know-man' syndrome."

Notwithstanding the controversy surrounding her qualifications, Esther Gana held the office until her retirement in October last year. A document obtained by SaharaReporters reveals that her retirement was officially approved by the Taraba State Civil Service Commission.
