The National Assembly Election Petitions Tribunal sitting in Enugu on Thursday affirmed the declaration of Hon. Dennis Agbo, member representing Igbo-eze North/Udenu federal constituency.

Candidate of the All Progressives Congress in the February 25 House of Reps contest, Obiageli Ajih is challenging INEC declaration of Hon. Dennis Agbo of the Labour Party.

Agbo was returned elected after he polled a total of 28,870 votes to defeat his closest rival, Simon Atigwe of the Peoples Democratic party who garnerd 14,221 votes.

Ajih, who was not satisfied with the outcome of the process had prayed the tribunal to nullify the election and order a rerun on the ground that the name of her party (APC) did not appear in the form EC8a being the declaration sheet.

Delivering her judgment on the petition on Thursday, the three man honourable Justices dismissed the APC’s suit for being incompetent, vague, lacking in merit and mere academic exercise.

This was made public by the international leader of the group Amb.Uchechukwu Ekpere Paul while addressing pressmen in Abuja immidiately after the group's annual convention. Rt Hon Amb uchechukwu Paul Ekpere who was the host of 2019 and 2023 Presidential Debate by the Organization used the opportunity to remind the judiciary not to attempt any absurdity ahead of tommorow's judgement. Tribunal sacks PDP law maker in Zamfara state !

Zamfara State National and State Assembly Election Petition Tribunal sitting in Sokoto has nullified the election of the State lawmaker representing Bungudu West in the House of Assembly, Basiru Bello Auki. He was elected on the platform of the Peoples Democratic Party (PDP). The Tribunal nullified his election on Thursday following a judgment delivered by the three-man panel of judges.

The reason for the nullification of the election was based on the fact that the sacked lawmaker has refused to resign from his work as a civil servant working with the Bungudu Local Government council thirty days to the date of election as provided for by section 107 (1) (f) of the Constitution of the federal Republic of Nigeria 1999 (as amended). Section 107(1)/(f) of the Nigerian constitution 1999 (as amended) states that “No person shall be qualified for election to a House of Assembly if he is a person employed in the public service of the Federation or of any State, and he has not resigned, withdrawn or retired from such employment thirty days before the date of election.”

The tribunal affirmed that the petitioner, Basiru Lawal Bungudu, who contested on the platform of the All Progressives Congress, APC, was able to prove his case beyond reasonable doubt. Counsel to the petitioner, Barrister Ibrahim Ali tendered before the tribunal a proof of the payslip of the last salary the sacked lawmaker received from Bungudu Local Government Council even after he was elected.

Principal denies Kebbi state deputy governor before the Tribunal....

There was drama on Tuesday at the governorship election petition tribunal sitting in Birnin Kebbi as the principal of Sultan Abubakar College, Sokoto said the Kebbi State deputy governor did not graduate from the school.

The Deputy Governor, Senator Umar Abubakar, claimed he finished from Sultan Abubakar College, Sokoto in 1979. But the principal of the school disowned the deputy governor by tendering 15 documents before the governorship election petitions tribunal.

The principal, Muhammed Zayyanu Umar, while being cross examined by counsels to the Governor and Deputy Governor insisted that there was no records in the school to support the testimonial allegedly given to him from the college because his name was not in the list of the 1979 graduands of Sultan Abubakar College, Sokoto.

The Peoples Democratic Party Governorship candidate, Maj General Aminu Bande (rtd) is challenging the victory of the candidates of the All Progressives Congress (APC), Governor Nasiru Idris and his Deputy Umar Abubakar in the last general election in Kebbi State .

The principal is the first subpoenaed witness to be cross examined by the respondent’s counsels after the tribunal admitted the 15 documents he presented to it.

While giving his testimonies and answering questions from the respondent counsels, Barrister Wale Agunbiade SAN, Yakubu Maikyau SAN and others, the principal insisted that based on the documents he submitted to the tribunal, the results of 1979,1980,1981 and 1982 did not carry the name Umar Abubakar alleged to be a graduand of the college within the period, particularly in 1979.

He insisted that based on the available records in his office as principal of Sultan Abubakar College, Sokoto, the deputy governor did not finish from the school in 1979.

A director in Sokoto State Ministry of Education , Abdulsamad Hamzat Yisa who was subpoeaned to testify at the tribunal said the ministry set up a committee to investigate the principal but they found that the principal was right .

Earlier, the counsels to the respondent had objected to the continuation of the hearing on the grounds that the list of witnesses were served on them around 8pm. They argued that report of pretrial indicated that parties should be served list of witnesses within 24 hours.

But the petitioner’s counsels told the tribunal that apart from the list of 15 witnesses scheduled to testify, there are other subpoenaed witnesses which are court witnesses not petitioners witnesses.

On that ground the tribunal chairman, Justice Ofem I. Ofem ruled that, on one part, agreed with the respondent counsels that since the notice served them was not within 24 hours, the tribunal will not proceed to take the witnesses but on the other hand subpoenaed witnesses which notice was served to the respondent since 12th of July to be heard.

The petitioners had called 21 witnesses,15 of them are normal witnesses while six are subpoenaed witnesses from government agencies and departments.

Enugu state election tribunal set to adopt the final address in the case between Hon.chijioke Edeoga of labour party and Mr. Peter Mba of PDP.

The election petition tribunal sitting in Enugu state will today 16th August, 2023 adopt the final addresses from the parties involved in the suit seeking to disqualify Mr. Peter Mba who was declared the governor of the state in the March governorship election.
Hon. Chijioke Edeoga of Labour party has approached the honourable court seeking the disqualification of Mr. Mba on three grounds.
Hon. Edeoga alleged that Mr. Mba was not qualified to contest the election since he presented a fake nysc certificate to INEC and non compliance to the use of BVAS machines.
However, each parties have presented their defenses and evidences before the court.
The court will today adopt the final addresses from them and subsequently fix a date for the final judgement.
