A Federal High Court in Abuja on Tuesday adjourned till May 10 for ruling in the suit filed by the Economic and Financial Crimes Commission against the immediate past governor of Kogi State, Yahaya Bello.

Breaking News
Tribunal has admitted evidence tendered by CBN on the payment of receipt signed by one Maduka onyinalu of CBN,which was communicated to Yakubu Muritala Ajaka, and indicating that SDP filed his petition out of time ie 21 days allow by law and Direct Practice.
The tribunal has marked the evidence in Chief.
Inview, Governor Ododo defense counsel were satisfied with their case ,and wasn't ready to continue with other matter.
Here is the good news:
Governor Ododo has closed his case on this note, and on the basis that SDP filed his petition/case out of time, which means his petition is statues barred.
It's over for SDP,case closed.

Meanwhile, Tribunal has adjourned sitting to Thursday April 25th 2024.

Kogi Tribunal Report:
Victory loading for Governor Ododo...

As his defense counsel secured the order of tribunal to subpoena CBN Governor and Director of Corporate Services to appear before her tomorrow, to testify on the SDP petition , which was filed out of time .

My people,my people, you could recalled that i told you earlier ,that tribunal sitting and proceeding have entered critical stage,where media propaganda will no longer save SDP defective petition.

Now hear the substantive and procedural matter:
1. SDP petition was filed out of time, instead of filing within 21 days as prescribed by Electoral Act and Standard Practice (Law),they filed 22 days, which was a day after the closing date as allows by law.
2. Payment Receipt: CBN have record of SDP payment of receipt, which was paid through remitta ,an online fintech app .
3. CBN have issued Governor Ododo defense counsel, the captured copy of the transaction of SDP payment of receipt.
As such, the court is calling on CBN , to come forward and testify in person, in order to substantiate the evidence before the honourable tribunal.
which was evidently captured by remitta app and CBN open record ,and can't be tampered with or altered.
4. Once CBN established the fact on the date of transaction/payment of receipt;
5. SDP petition will become statues barred .
6. And once a petition is statues barred,the tribunal will strike out your entire petition.

In conclusion, this is why ,I have maintained my stand to tagged SDP petition as defective.

*Summary of Tribunal Report Update on the 02nd of April,2024 between SDP Vs APC/INEC, PRP Vs APC and AA Vs APC in the appellant court of law holding in Abuja.*

The council to SDP Okutepa SAN has the following witnesses from Central namely: Salawudeen Okeji Abdulrahim from Kuroko II in Adavi LGA polling unit 011,Abdulazeez Abdulkareem from Eika ohizenyi in Okehi LGA,Raji Usman from Oboroke- Eba Ihima, Okehi LGA and lastly Abdulsalam Andasi.

All these witnesses are not member of SDP,not an agent and again responded that BVAS machine is widely in used as accreditation were done with it and voting commences.

This testimony alone is enough to say that SDP council is looking for nothing excuses as he is widely known since the election petition.

Here comes the PRP and AA report:

Action Alaince (AA )and PRP party said that they cannot bring witness anymore and that they will stop here for now especially AA party to allow the law to take its effect.

The court adjourn the hearing till tomorrow again.

Court Resumes as SDP Witnesses Deny Membership, Over-Voting Claims
..6th Witness Claims not to Understand Own Deposition Due to Year Long Eye Problems, Affirms Use of BVAS

The ongoing Kogi Tribunal court, sitting in FCT, Abuja, comes back to life on Saturday, the 30th of March, 2024, after a 24 hours recess, with the cross examination of the Witnesses provided by the Social Democratic Party lawyers by the APC and INEC Lawyers.

The first Witness introduced was Isah AbdulGaniu from Okene, LGA, a Fashion designer.

Caught in the cross fire of cross examination by APC lawyers, the Witness denies being a Member of the SDP, which by law, an Agent of SDP is the legal status necessary to protest a result in any election. The fatal error by the SDP lawyers reveals how pre-packaging of Witnesses could hurt a case in court.

Reading from the witness count, four (4) other Witnesses denied Membership of the party, agreeing to sighting SDP agents by tags at the Polling Unit where they voted on the election day.

Furthermore, Abdulganiu denies knowledge of forms DCE-41 which was cardinal to his petition, suggesting in reality that the petition was written for him by the SDP Lawyers.

To lay further credence to this suspicion, he also attested to signing his petition in Lokoja, instead of Okengwe, his domicile of voting, which clearly shows the petition was carefully arranged by the SDP lawyers who alleged over-voting in his polling unit, however, failing to coach him properly on the fundamentals of the Oluwole arranged petition.

After many legal missiles from the counsel(s) to the Defendants and INEC, SDP withdrew the visibily confused Witness, introducing another witness, who denied over-voting claims of 584 in his petition, as he could produce the scores between APC and PDP on the day of Election, claiming he doesn't know.

In addition, the second witness agreed before the court that due process were followed during the elections, providing a graphical testimony of how he sighted the Voters Register, BVAS Machine and submission of results sheets to SDP agents in his unit on election day.

“Onuwu, Obinna is nowhere to be found but Police officers are doing their job, I believe they will return to the Palace with good news. The King replied.

“They should better return to the palace with our Heir because our people are seriously worried. The King's cabinets said.

“While they were conserving, Ebuka drove into the palace, sat on the ground, and began to scream fakely
“Ehhh.. yiiii.. It's finished oo, who did my brother offend oo. .

“Is that not Prince Ebuka's voice I am hearing? The Prime Minister asked.

“They all rushed out to see what happened to Ebuka.

“So they rushed two of them to a nearby Hospital for an urgent treatment.

“Amarachi, you're the only trusted and reliable friend I have in this life, I believe you are aware of the circumstances Eric and I are facing currently because of the Strange Ma'dman . Ada said.

“When Ada, got home, she began to recall all the beautiful moments she and Eric had shared and she also reminisced all the amazing things Eric had done for her and her family and she eventually made up her mind to k'll the madman.

“Thereafter, she went to Eric's house and told him that she was ready to k'll the mad man and Eric became extremely happy with her, so, at the end of their discussions, Eric gave her a deadly poi'son to put in the ma'd man's food or water and she sadly collected the substance.

“The next morning, Ada put the poi'son in the ma'd man's food and also sprinkled some in his drinking water. And just as she was about to go to where the ma'd man was staying to give him the poisonous food, she got a video call from Eric, so she sat on the couch to answer the call and all their conservations were about the po'son and the ma'd man.

“Immediately after the video call, Ada dozed off and had a very strange dream and she was extremely shocked by what she saw in her dream.

..SDP Star Witness Denies Been in Kogi on Election Day, Says Anyone can Doctor BVAS Information

Case-value recession hit the camp of the Social Democratic Party's candidate, whom is challenging the electoral victory of the APCs candidate, Alhaji Usman Ododo, today, in court as the lawyers of the defendant and INEC cross examined the star witness of the SDP who demonstrated the BVAS machine.

The defense Counsel, Agabi, SAN, opened his cross examination on behalf of the APC. The learned silk questioned the witness brought forward by SDP who is an INEC staff, enquiring if he was a Presiding Officer (PO) of the recent elections held in Kogi State. The witness submitted a negative report, on a bold "NO".

In further cross examination, the witness was also questioned on his exact location on the day of the election, which he stated as "Imo State".

On the BVAS machine:

Below constitutes a summary of questions put to the star Witness from INEC and APC Lawyers:

Our Defense Counsel Agabi, SAN put *Q1*: Based on the INEC manual, it is the duty of the Electoral officer/adviser to receive the Electoral materials for the Election & passes same to the presiding officer?

Witness Response: YES.

Q2: Are you a presiding officer during the Election in Kogi State?

Witness Response: No

Q3: We understand that the BVAS devices can also contain Form E8-A & pictures & these were supposed to be attached to the BVAS?

Witness Response: Yes

Q4: But were these items (Form-E8-A & pictures ) part of what you showed to the Tribunal since you started?

Witness Responded: That the items were NOT attached & it was NOT part of what he showed to the Tribunal.

Q5: Did you have the records of ALL the BVAS used for the elections in Kogi state?

Abdulmalik of INEC (witness) said that he can confirm that he does not have the records or seen any of the BVAS Machine or the records kept for each before now (coming to the Tribunal)

“I woke up at midnight when heavy rain was falling to close my windows that I left half opened, while I was trying to close my windows, I heard some interactions outside,

“I was extremely touched when I heard that, I wanted to scream from the upstairs that I was staying, but I was too fearful to scream.

“They brought the guy out of the Vehicle, and I was watching them from upstairs and heavy rain was falling, they tied his hands, legs, and mouth and they threw him inside the big gutter and drove away.

“ So I hastily sneaked out of the house while everybody was asleep to save the guy's life when I got to the place that they threw him inside, I brought out my touch light and pointed at the gutter, but I couldn't find him, and when I tiptoed a bit forward, I saw this handsome guy with an expensive outfit inside a gutter struggling. I quickly rushed inside the gutter to bring him out but I couldn't lift him because of his weight, I hastily ran to my brother's room and persuaded him to come and help me, and he followed me.

“My brother and I struggled so hard to bring him out of the gutter and when we eventually brought him out of the gutter, my brother carried him on his back and we hurriedly took him to a nearby Hospital that was very close to our house because he was extremely feeble and strengthless.

“When we got to the Hospitals, fortunately, we met Nurses and Doctors who were on duty that midnight.

“What happened to him? Doctor asked.
“I explained everything clearly to the Doctor. The Doctor conducted tests and gave him drips.

“Doctor, please is he okay? My brother asked with teary eyes.
“Yes, he would be okay, but he could've passed away, assuming you people didn't bring him here on time. Doctor replied.

“Please, Kenny, go back to the house, in case Mum and Dad wake and look for us so that you can explain to them the incident that we encountered lately. Ada said.

“Sister Ada, I am going nowhere this night, I will stay here till day-dawn, I can't leave you here all alone and this man lying here is like an elder brother to me. Kenny said.

“Please, I beg you in the name of God, go back to the house, before our parents start looking for us. Ada begged.

“Sister, I am very sorry to disobey you, but I can't go home now, it's very late, what would you tell our parents if I got kidnapped or attacked by bad boys on my way home? Kenny asked.

“You're right, but I am afraid that our parents might look for us and we're not with our phones or any means of communication. Ada murmured.

“Sister, I understand, but don't worry, when we get home we will explain to them. Kenny said.

“Around 6:am, their parents began to look for them and they were still at the Hospital with the strange man.

“Honey, do you see Kenny and Ada this morning? Mrs. Daniel asked.

“Not at all, I haven't set my eyes on them this morning. Have you called Eric to find out whether they went to visit him this morning? Mr. Daniel asked.

“I have called him. What did he say?

“He said, he hadn't seen them this morning.
My God Where Kenny and Ada could've gone to this morning? Mr. Daniel murmured.

“Poi'son, How was the last night's job? Ebuka asked.
“Boss, the job was done successfully, your brother is dead.
“Where did you guys keep his dead body? Ebuka asked.
“Boss, we k'lled him and threw his co**se inside a big river. Po'son replied.

“Nice one boys, I hope no one saw you guys.

“Not at all Boss, no one saw us.

“Good job, I am sending you boys additional 500K for a job well done. But where is my car? He asked.
