ADDRESS BY HIS EXCELLENCY, PRESIDENT MUHAMMADU BUHARI, PRESIDENT FEDERAL REPUBLIC OF NIGERIA AT THE SIGNING OF ELECTORAL BILL 2022 INTO LAW

STATE HOUSE, ABUJA

FRIDAY 24TH FEBRUARY, 2022

The Electoral Act (Amendment) Bill 2022, passed by the National Assembly forwarded for Presidential Assent, via a letter dated 31st January, 2022. In line with established tradition, I received inputs from relevant ministries, departments and agencies of government after careful and thorough reviews of the Bill and its implications to democratic processes in our country.

2. It is gratifying to note that the current Bill comes with a great deal of improvement from the previous Electoral Bill 2021. There are salient and praiseworthy provisions that could positively revolutionize elections in Nigeria through the introduction of new technological innovations. These innovations would guarantee the constitutional rights of citizens to vote and to do so effectively.

3. The Bill would also improve and engender clarity, effectiveness and transparency of the election process, as well as reduce to the barest minimum incidences of acrimony arising from dissatisfied candidates and political parties.

4. These commendable efforts are in line with our policy to bequeath posterity and landmark legal framework that paves the way for credible and sound electoral process that we would all be proud of.

5. Distinguished Senators and Honourable Members of the National Assembly, from the review it is my perspective that the substance of the Bill is both reformative and progressive. I am making this bold declaration because I foresee the great potentials of the Bill. Worthy of note include the democratic efficacy of the Bill with particular reference to sections 3, 9(2), 34, 41, 47, 84(9), (10) and (11) among others.

6. This however, cannot be said about one provision as contained in the proposed Bill, which provision constitutes fundamental defect, as it is in conflict with extant constitutional provisions.

7. Section 84 (12) constitutes a disenfranchisement of serving political office holders from voting or being voted for at Conventions or Congresses of any political party, for the purpose of the nomination of candidates for any election in cases where it holds earlier than 30 days to the National Election. The section provides as follows:-
"No political appointee at any level shall be voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election".

8. This provision has introduced qualification and disqualification criteria that ultra vires the Constitution by way of importing blanket restriction and disqualification to serving political office holders of which they are constitutionally accorded protection.

9. The practical application of section 84(12) of the Electoral Bill, 2022 will, if assented to, by operation of law, subject serving political office holders to inhibitions and restrictions referred to under section 40 and 42 of the 1999 Constitution (as amended).

10. It is imperative to note that the only constitutional expectation placed on serving political office holders that qualify, by extension as public officers within the context of the constitution is resignation, withdrawal or retirement at least 30 days before the date of the election.

11. Hence, it will be stretching things beyond the constitutional limit to import extraneous restriction into the constitution on account of practical application of section 84(12) of the bill where political parties’ conventions and congresses were to hold earlier than 30 days to the election.

12. Arising from the foregoing, with particular regards to the benefits of the Bill, industry, time, resources and energy committed in its passage, I hereby assent to the Bill and request the Nationally Assembly to consider immediate amendments that will bring the Bill in tune with constitutionality by way of deleting section 84(12) accordingly.

FCT COMPLAINTS COMMISSION BOSS, DALHATU CALLS FOR REVIEW OF ABUJA MASTER PLAN

The Honourable Commissioner, Public Complaints Commission, FCT, Comrade Dalhatu Ezekiel Musa has called for a review of the Abuja master plan.

Dalhatu made the call in Abuja on Tuesday at a one-day Town Hall meeting organised by the Minister of the Federal Capital Territory, Mohammed Bello, on resettlement and compensation matters in the wake of demolition exercise embarked upon by the Ministry in the Capital city. The Commissioner said the existing master plan was designed in 1976 and it is now outdated as it no longer reflects the realities on the ground.

“The master plan itself is obsolete, it is an expired document. 1976 we are talking about constitution of Nigeria 1999 and everybody is saying they should amend it, 1999 and 1976 which one is more recent? So you are talking of documents of 1976 and you want to implement it now? It must be reviewed. We take into cognisance the population, and let me tell you, the master plan was done as if it was done on a virgin land. Is Abuja now a virgin land? We must revisit the master plan and look at the issues that are on ground. So we can do physical planning not geometric planning” the Commissioner said in his submission.

The Commissioner restated his position on the demolition exercise, arguing that it was wrong for officials of the Federal Capital Territory Administration (FCDA), to wait for people to complete their buildings before moving in to demolish them. He said FCDA should be more proactive in stopping people from erecting structures on unapproved lands in order to minimize their losses.

“Development control are to control whatever development that is happening that is going against the extant rules, the rules of engagement of the development of the city. Nobody would be comfortable when we have criminals littered everywhere but why on earth must they always wait until all the developments are done? Why would they wait because nobody would build a house except the super-rich people within one month? The communities we come to destroy would first do foundations, it would take two to three months, take it to roofing level and then plaster. Some are even doing borehole, some would do fence, it would take them years. Where was development control when all this was happening? But they would come in one day and destroy all of this. Do you know what we are losing? Government is losing and the citizens are also losing” he added.

Dalhatu, however, commended the Minister for listening to his initial advice to convene the stakeholders meeting, describing it as a good initiative and called for continued engagement with the people to find a lasting solution to developmental issues in the Federal Capital Territory.

I’ve Survived Over 50 Boko Haram Attacks - Zulum

Governor Babagana Zulum of Borno State on Tuesday said the Boko Haram sect has attacked him more than 50 times.
The governor said this in an interactive session with State House correspondents after a meeting with President Muhammadu Buhari.

2023: You Are A Super Failure - Tinubu Support Group Blasts Yahaya Bello

Supporters of the National Leader of the All Progressives Congress, Asiwaju Ahmed Tinubu, under the aegis of Tinubu Support Group, have taken a swipe at the Kogi State Governor, Yahaya Bello, for asking Tinubu to drop his 2023 presidential ambition.

UCHE SECONDUS SUSPENDED AS PDP NATIONAL CHAIRMAN

The leadership crisis currently rocking the opposition Peoples Democratic Party, PDP, worsened on Monday as High Court in Rivers State has restrained Uche Secondus from parading himself as the National Chairman of the party.

The order was given by Justice O. Gbasam of the State High Court sitting in Degema local government area of the State.The judge also approved the suspension of Secondus as a member of the party pending the hearing and determination of motion on notice for interlocutory injunction.

The order followed a complaint brought before the court by some aggrieved members of the party. The suit No: PHC/2183/CS/2021 filed by Ibeawuchi Ernest Alex, Dennis Nna Amadi, Emmanuel Stephen and Umezirike Onucha against Uche Secondus (1st defendant) and the PDP (2nd defendant).

The judge made the pronouncement after reading the affidavit in support of the motion of ex parte and after hearing the submission of H.A. Bello, Counsel to the Applicants.

The order reads, “An order restraining the 1st Defendant from parading himself as member of the 2nd Defendant or the National Chairman of the Defendant or performing the functions of national chairman of the 2nd defendant or calling, attending or presiding over any meeting of the 2nd defendant or any committee of the 2nd defendant at the Ward, Local Government or State level or calling for any Ward, Local Government or State Congress of the 2nd defendant or setting up committees for such Congresses or participating in any activity of the 2nd defendant whatsoever whilst on suspension as a member of the 2nd defendant pending the hearing and determination of the motion on notice for interlocutory injunction.

The Federal Government, Monday, flagged off the commencement of N-Power Batch C across the country,with 510 enrollees participating in the stream 1 of the youth empowerment scheme.

Ministry of Humanitarian Affairs, Disaster Management and Social Development,Sadiya Umar Farouq,who flagged off the event in Abuja,said another 490 enrollees would be engaged in the Batch C,stream 2 to be flagged off at a later date.

While, explaining that N-Power volunteer (graduates) were entitled to a monthly stipend of N30,000 for a period of one year, she said non-graduate beneficiaries were entitled to N10,000.000 monthly stipends for a period of 9 months under the Batch C.

She spoke further:”The N-Power programme deployes an online application and selection strategy to ensures fairness, transparency and credibility in the recruitment process.

“The programme commenced in the Office of the Vice President back in June 2016 when the application portal was first opened. Over 750,000 applications were received, out of which, 200,000 beneficiaries were screened and selected into the first batch called Batch A.

“The portal was opened again in June 2017 where over 2.5 million applications were received, from which another 300,000 volunteers were selected into the programme as Batch B.

“Permit me at this juncture to thank His Excellency, President Muhammadu Buhari for his administration’s unwavering efforts in eradicating poverty in our country and for supporting and sustaining the National Social Investment Programme. With the creation of the Federal Ministry of Humanitarian Affairs and the relocation of the NSIP from the OVP to the Ministry, it is worthy to note that Mr. President recognized the creativity and impact of the NPower and has graciously approved the expansion of the programme from 500,000 to 1,000,000 beneficiaries, to enable more young people to benefit.

“Based on this approval, the portal was again opened in June 2020, and over 6 million new applications were recieved. 1,000,000 beneficiaries will be mined from this as the NPower Batch C. The batch C is divided into 2 streams. Stream C1 of 510,000 beneficiaries and stream C2 for 490,000 beneficiaries. Under the Batch C1, a total of 450,000 have been selected to benefit under the graduate component, while 60,000 beneficiries will be non-graduate beneficiaries.”

Farouq assured that the” Federal Ministry of Humanitarian Affairs, Disaster Management and Social Development is committed to ensuring that the strategic objectives of all the Social Intervention Programmes are achieved.”

“Some innovations have been introduced into the N-Power selection and payment processes such as the creation of the National Social Investment Management Systems (NASIMS), partnership with key MDAs including the NYSC, the UBEC, the NPHCDA, the NOA to mention but a few, with which the Ministry is leveraging to effectively implement its interventions.

*To ensure that the challenges of communication is addressed, most particularly as it relates to limitations on information flow and internet access across the country and in a bid to provide accessibility to all target programme applicants and beneficiaries, the Ministry has concluded to provide access to information via a USSD code. In line with the above, the USSD short code *45665 # has been secured via integration to provide the required connectivity and technical support for the provision of information services to our beneficiaries,”she further said.
