Sathiskumar Balakrishnan, 44, pleaded guilty to issuing obscene comments against late influencer Rajeswary Appahu, also known as Esha, using the TikTok account .

He was accused of insulting Rajeswary, calling her a “daughter of a whore”, among others, at 10.12pm on June 30.

For this, he was charged under Section 233 of the Communications and Multimedia Act 1998 and possibly faces up to one year in jail, a fine of up to RM50,000, or both, upon conviction.

However, he pleaded not guilty to insulting the modesty of Rajeswary’s mother R. Puspa via the same TikTok account at 10.15pm on June 30.

If convicted under Section 509 of the Penal Code, he will be punished with imprisonment of up to five years or with fine or with both.

Later, sessions court judge Siti Aminah Ghazali granted Sathiskumar a RM36,000 bail and ordered him to surrender his passport to the court and to report himself to the nearest police station every month.

KUALA LUMPUR – Seorang wanita yang juga pempengaruh kontroversi mengaku salah di Mahkamah Majistret di sini hari ini atas pertuduhan mengeluarkan kata-kata kesat bertujuan membangkitkan kemarahan berhubung kes buli siber pempengaruh Rajeswary Appahu atau dikenali Esha.

Perbuatan itu dilakukan oleh tertuduh, Shalini Periasamy berusia 35 tahun menggunakan akaun media sosial TikTok dengan nama ‘alphaquinnsha’.

Shalini yang hadir bersama dua individu dipercayai bapa dan suaminya kelihatan tenang ketika dibacakan pertuduhan tersebut di hadapan Hakim Mahkamah Sesyen, Arunjothy M Selvarwam hari ini.

Sejurus selepas pertuduhan dibacakan, Shalini yang bekerja sebagai pembantu rumah jagaan orang tua itu mengaku salah perbuatannya dan mengakui dirinya sudah insaf dengan insiden tersebut.

Hakim kemudian mengenakan denda sebanyak RM100 atau penjara tujuh hari andai denda tersebut tidak dibayar.

Mengikut pertuduhan, Shalini didakwa atas pertuduhan dengan sengaja mengeluarkan kata-kata kesat melalui akaun TikTok alphaquinnsha dengan tujuan membangkitkan kemarahan untuk mengganggu keamanan.

Kesalahan dilakukan pada 1 Julai lalu kira kira jam 4.10 pagi di Sentul.

Tertuduh didakwa melakukan satu kesalahan di bawah Seksyen 14 Akta Kesalahan-Kesalahan Kecil 1955 dan boleh dihukum di bawah seksyen yang sama.

Pada 5 Julai, Esha berusia 30 tahun itu ditemui meninggal dunia, sehari selepas membuat laporan polis berhubung ugutan jenayah dan fitnah terhadap dirinya.

Ketua Polis Daerah Sentul, Asisten Komisioner Ahmad Sukarno Mohd Zahari sebelum ini mengesahkan seramai 11 saksi termasuk ahli keluarga mangsa selesai dirakam percakapan bagi melengkapkan kertas siasatan polis dalam kes tersebut.

Untuk makluman, ketika ini, seorang lagi sedang didakwa di mahkamah berlainan berhubung kes tersebut. – MalaysiaGazette
