At LNBA Assembly: Justice Actors Speak against Impunity; Call for Adherence to the Rule of Law

Justice actors across Liberia have converged in the nation’s capital Monrovia for a two-day Liberia National Bar Association’s Assembly held from Friday, April 5-6, 2024 to discuss and address the general question of impunity in Liberia; the implication for Liberia’s rule of law system.

At the two-day event, top justice actors in the country to include Her Honor Sie-A-Nyene G. Yuoh, Chief Justice, Supreme Court of Liberia; Her Honor Nancy F. Sammy, President, National Association of Trial Judges of Liberia (NATJL); Cllr. N. Oswald Tweh, Minister of Justice & Attorney General of Liberia and Cllr. Tiawan S. Gongloe, a career lawyer and renowned human rights advocate have all spoken against the culture of impunity in the Liberian society and are calling for the adherence to the rule of law.
Cllr. Tiawan S. Gongloe speaking as keynote speaker at the event on the topic: “Addressing the General Question of Impunity in Liberia: The Implication for Liberia’s Rule of Law,” said adherence to the rule of law is the only way to prevent impunity.

Cllr. Gongloe stated that the legal profession will be meaningless and irrelevant if the people of Liberia accept the culture of impunity whereby individuals can violate the rights of people without any consequence.
According to him, the absence of adherence to the rule of law will make the country to be like the jungle, where survival is based on strength. “We must commit ourselves to promoting adherence to the rule of law because the rule of law is the only way to promote sustains peace, progress and prosperity,” he emphasized.
Therefore, on the issue of holding individuals to account for their unlawful actions against citizens and residents of Liberia there should be no debate among us members of the legal profession. The issue of whether or not there should be justice has only one holding for those who believe in peace, progress and prosperity in Liberia and that are a resounding yes.

He noted that as a body, the LNBA has already chosen the path to addressing the general question of impunity in Liberia. The implication of choosing this path is that justice will prevail and Liberia will experience sustained peace, progress and prosperity for all. I call upon all members of the Bar to support this position of the bar by leading the process of creating awareness throughout the country.

Her Honor Sie-A-Nyene G. Yuoh, Chief Justice, delivering a special statement on behalf of the Supreme Court of Liberia said it is imperative that all individuals within the country hold sacred the adherence to the rule of law at all times.

Chief Justice Yuoh said that even where allegation of the commission of an offense is brought up due process must at all times be accorded the accused. “This right to due process is sacredly embedded in the Constitution,” She emphasized.
The Chief Justice noted that it is imperative that the prosecutor arm of government proactively exercise its authority to ensure that perpetrators of offensives are prosecuted irrespective of their statuses or affiliations.
She admonished the prosecution arms of government (Ministry of Justice & Liberia Anti-Corruption Commission) to be aware that the court cannot adjudicate perpetrators of offenses; noting that cases are to be properly filed before the court for adjudication and not contrary.

The Chief Justice commended the LNBA through its President Cllr. Sylvester D. Rennie, for the assembly and also for maintaining a cordial working relationship with the Supreme Court of Liberia.
Her Honor Nancy F. Sammy, President, National Association of Trial Judges of Liberia (NATJL) in a brief complimentary greeting at the occasion deliberate over the question of impunity or rule of law, which way is Liberia heading?

Judge Sammy said the public has a long standing perception that impunity happens in the absent of the rule of law. And as the result of impunity, individuals suspected of committing crimes are not prosecuted and the victims are left without compensation for lost or injuries sustained.
She says the judicial cannon obligate trial judges in courts to promote justice and serve the public interest.
The judge averred that should justice actors adhere to the rule of law as the motto of the LNBA says, than the culture of impunity will have to be discouraged and the courts remain the appropriate forum to promote justice.
Cllr. N. Oswald Tweh, Minister of Justice & Attorney General of Liberia called on justice actors to redouble their efforts to ensure that the rule of law system is at highest in the society.

“We are witnessing a lot of illegal activities in the country including mob justice which is on the increase. We have to change the mentality of our people against crimes. We must create more awareness on the rule of law and rights, wherein, people will allow the justice system to work. As justice actors we have to make our people to trust and believe in the justice system,” stated Cllr. Tweh.
The Justice Minister assured the public that the issue of rule of law will work in the country because the government cannot allow the country to degenerate into chaos.
Cllr. Sylvester D. Rennie, National President of the Liberia National Bar Association (LNBA) in a formal opening of the two-day Assembly on Friday, April 5, 2024 said the assembly was in fulfillment of the constitutional responsibility of the bar.

Cllr. Rennie said years back, the LNBA had four quarterly assemblies which took members of the association at various counties to honor the occasions.
He explained that members of the bar converged at a national convention and agreed that it was necessary to narrow down the number of assemblies to a single one. “It’s in this light, that we have assembled her today to deliberate on issues concerning the organization’s growth and development,” he concluded.

( Monrovia, 4 April 2024, Thursday)
: The National Elections Commission (NEC) on Thursday, 4 April 2024 declared Political Campaign open for the Representative By-Elections in District #1 Grand Gedeh county and the Senatorial By-Election in Nimba County. Both By-elections will be held simultaneously on 23 April 2024. The Commission says political campaign will end on 20 April 2024.

Meanwhile, the Candidate Nomination exercise which began on 6 March 2024 ended on 19 March 2024 with a total of 19 aspirants qualified as candidates to run in both By-elections. The final listing of 19 Candidates was published on 4 April 2024. (Nimba Senatorial-4 candidates) and (District number 1 Grand Gedeh, Representatives-15 candidates).

The commission conducted replacement of lost and damaged voter ID cards from 20 to 25 March 2024 with a total of 141 voter ID cards replaced in both Nimba county (84 cards) and in District #1 Grand Gedeh County (57 cards).

The Commission launched its Civic and Voter education simultaneously in both counties during which time the NEC began the distribution of CVE materials to citizens in Nimba and district number 1 in Grand Gedeh. The distribution of CVE and Gender related materials are underway to being distributed in the counties.

The Commission says a total of 327, 661 registered voters are expected to exercise their franchise in the Nimba Senatorial By-election (307, 254 registered voters) and the district number 1 representative By-election in Grand Gedeh (20, 407 registered voters).

Klay Health Center faces major challenges, as OIC lunches calls for assistance.

The officer in Charged at the Klay Health Center in Klay District, Bomi County has outlined numerous challenges the facility is currently faced with.

Speaking to Pumah FM Reporter who visited the Clinic over the weekend, the Officer in charge Madam Musu Washington said that the Klay health Center needs expansion and provided with the necessary medical equipment to help improve the status of the clinic.

Madam Washington also said that currently the health center does not have an assigned doctor, and lacks Laboratory facilities including X-ray machine and several other medical equipment.

She indicated that the absence of laboratory facility and X- ray machine are reported to be major impeding the smooth operations of health workers at the Klay Health center in Bomi County.

The Klay health center according to the OIC is currently operating in the absence of those facilities, something she said is greatly affecting the smooth running of the Klay Health Center in Klay district, Bomi County.

She also disclosed that money was allocated for the Klay Health Center during the district setting but they are yet to receive said benefit. Stating that the clinic is seriously in need of assistance.

Madam Musu Washington mentioned further that the clinic is being run by three nurses, two midwives including ten staff but said the ten staff are not on the government of Liberia payroll.

Meanwhile Madam Musu Washington then used the medium to encouraged citizens of Klay Town and other part of Klay District to always take advantage of the health center to seek treatment. She called on pregnant women and community midwives to stop home delivery and take advantage of the nearby heath center.

More than 200 pieces of Steel Rods owed by GeoSkope Limited, a Liberian owed construction company have been allegedly stolen from the commissioner compound in Beajah, Senjeh District.

The steel rods were intended to be used for the rehabilitation work taking place on the Coleman Hill Sackie Town Road.

Mr. Franklin Benda, GeoSkope Limited General Manager expressing deep concerned about the stolen materials used on the Thursday’s Edition of the Western Region Moring Drive said, securities at the commissioner compound in beajah must account for the missing items.

Also speaking on the matter, the outgoing commissioner Madam Maima Free confirmed the information but stated that the district clerk had brief her days ago. She expressed regret over the situation and promised to work with the company for further actions to be taken in line with the law.

In a related development, Senjeh District Representative Honorable Obediah Varney has informed the public that after several negotiations and mitigations with GeoSkope Limited, over the payment deadline of the company’s balance, the county and the contracting company have reached a decision for the recommence the road work as soon as possible.

The Senjeh District Lawmaker further attributed the delay of the payment to the pending confirmation of the Superintendent and other county officials.

Honorable Varney promised to work with the committee responsible for local county officials’ confirmation at the Liberian senate to have those already nominated by the President be confirmed and immediately begin work.

The Vice President of the African Methodist Episcopal Zion University, Dr. Professor Richardson Koffa Kloh calls on Government and Institution responsible for education in Liberia to come to their aid as violent storm damaged the facility of the institution main campus.

Normal academic activities became paralyzed at the Campuses of the A.M.E. Zion University following a violent storm on Tuesday night that damaged the facility of the Institution main campus on Benson Street in Monrovia.

Speaking to our reporter who visited the campus early Wednesday morning, the Vice president for Administration Dr. Professor Richardson Koffa Kloh said the extend of the damaged has brought a serious setback to the institution and wants Government and Institutions responsible for education in Liberia to come to the aid of the school.

The violent storm occurred at the time the institution is completing its final exams for semester one according to the Vice president. The facility according to our reporter is hosting the junior and senior students on the Benson Street Campus and if nothing is done to renovate the school in the soonest possible time it could undermine the next graduation cycle scheduled for this year and other academic activities.

Meanwhile as part of the damaged Professor Kloh named the office for records and admission, testing and evaluation, the office of education among other offices on the third floor of the building were all damaged as a result of the Tuesday night storm.

The African Methodist Episcopal Zion University (AMEZU) offers degrees in Accounting, Management, Economics, Banking and Finance, Demography and Public Administration with seven colleges in total; namely: Wilfred E. Clarke College of Criminal Justice Administration and Law Enforcement, Andrew Cartwright College of Business and Public Administration, Reuben L. Speaks College of Liberal Arts, Bishop Warren M. Brown College of Divinity, Alicia Smith-Lartey College of Education, College of General Studies awarding degrees in continuing Education and College of Agriculture awarding Associate of Arts degree in Agriculture.

Except for the College of Agriculture, the University currently offers Bachelor Degrees in all of its programs. It has enrolled over 30,000 students and graduated over 10,000 students.

This unfortunate situation came at the time the University's President Dr. Emmanuel Johnson is out of the country seeking support for the institution as well.

Binda Foundation identifies with Muslim community in Gbarpolu County.

Gbarpolu County, Stephen Binda based in the US through his humanitarian foundation over the weekend donated assorted food items to several mosques in Gbarma district, Gbarpolu County.

The donation which was held on Friday, March 29 in Gbarma Town valued at over one hundred and twenty thousand Liberian dollars (L$ 120,000.00) included rice, soft drink, cooking oil, tea bags, sugar amongst other items, was intended to identify with Muslims as they observed the holy month of Ramadan.

Making the donation, the foundation country director Mr. Prince Vongbor commanded the Muslims for always coming together each year to fast and pray for the country, something he said, the foundation takes pride in helping Muslims during these times of the holy month because of the sacrifice in praying for the country.

Mr. Prince Vongbor indicated that the head of the foundation, Stephen Binda thought it wise to identified with the Muslims because they have always demonstrated a through sense of patriotism and a defined role of their religious bond.

Meanwhile, receiving the donation on behalf of the Muslim community in Gbarma district, the Imma of the Gbarma mosques Mohammed She commanded the Binda foundation for the donation especially during these difficult times.

Imma Mohammed Seh said, the donation was timely and pray that Allah grant Mr. Stephen Binda and his foundation more blessings, favor and financial powers to continue reaching out to Muslims during these challenging times.

Also speaking on the donation, the Chairlady of the Gbarma Town Central mosque Madam Massa Boakai thanked Mr. Stephen Binda for the donation and at the same time requests his foundation assistance for the construction of a Muslim school in their community.

She said, their children are growing outside of the Muslim faith and there is a serious and urgent need for the construction of a Muslim school.

The towns that benefited from the Binda foundation donation were Gbarma Town, Beatoe and Parker Town. Others include Zuo, Yarngayah, N’jaboi and Tarkpoima amongst others.

My friend, Dr. Sylvia Olayinka Blyden of Sierra Leone, the media expert writes;

He is Bassirou Diomaye Diakhar Faye, born 25 March 1980. He's the new President of Senegal & was only 43 years old on Elections Day held last Sunday. His Excellency the new President just turned 44 years this Monday. He had been locked up in jail by outgoing President Macky Sall for 11 months on charges of seditious libel & also for contempt of Court but without being convicted of the crimes. He was charged over his activism on behalf of his political leader.

Senegal's new president never had presidential ambitions but got nominated whilst he was in Jail so as to replace his leader, Ousman Sonko when the latter got banned from contesting for the presidency due to a sex-related conviction.

Outgoing President Sall released incoming President Faye from Jail on March 14th; just 10 days before the Elections on March 24th but despite the short time to campaign, Faye went on to sweep the Presidential Elections in an amazing First Rounds victory after a previous former president Abdoulaye Wade, two former prime ministers, other kingmakers, political strongmen & strongwomen all backed Faye.

Earlier today, President Elect Bassirou Diomaye Faye was hosted by outgoing President Macky Sall who had locked him up on April 14th last year. On April 2nd this year, the same Macky Sall will hand over power to Bassirou Diomaye Faye who never had presidential ambitions but what God has destined, no mortal can stop it.

President Boakai Suspends FIU Director General Stanley Ford

Executive Mansion, Monrovia: The President of the Republic, H.E Joseph Nyuma Boakai, Sr., has suspended, with immediate effect, Mr. Stanley Ford, Director General of the Financial Intelligence Unit (FIU) for allegations of financial and other malpractices at the institution.

The President has made it clear that there is no tolerance for any form of malpractice and, as such, he has directed the Ministry of Justice to undertake a comprehensive investigation into the matter. He expressed confidence that the investigation will ensure that justice is served.

The President has further urged Mr. Ford to submit himself to the investigation and cooperate fully to make sure that the matter is resolved expeditiously.

This move by the Liberian Leader is a clear demonstration of his commitment to upholding the rule of law and ensuring that public officials are held accountable for their actions.

President Boakai Receives Special Investigative Report of January 30, 2024, on the UMU Commencement Incident

Executive Mansion, Monrovia: H.E President Joseph Nyuma Boakai, Sr., has received the Special Investigative Report on the security breach that occurred during the Commencement Convocation of the United Methodist University (UMU).

The incident had impugned the reliability of state security, particularly the Executive Protection Service (EPS).

The report was presented by the Special Investigative Team (SIT), which conducted a thorough investigation into the incident. The investigative team included representatives from the Liberian National Police (LNP), the Armed Forces of Liberia and the Executive Protection Service.

The Team established that the unauthorized person later identified as Sam D. Kanwea, Jr., did not intend to harm the President despite his surreptitious pe*******on of the presidential security and the physical touching of the President.

The Report recommended that the individual be charged in violation of sections 14.22 (Offensive Touching) and 14.23 (Reckless Endangerment of another Person) of the Penal Law of Liberia.

Moreover, the Report indicated that the failure of the EPS Agents to ensure proper security to avoid such invasion is a violation of the EPS Duty Manual and the Standard Operating Procedure governing the service.

The Report further recommended administrative actions against the Agents assigned and the continuation of in-service training to ensure enhanced operational capacity and readiness to always provide advance security service.

The Director of the EPS, Mr. Sam Gaye, has taken full responsibility of the situation and promised elevated measures to avoid any future security breach as well as the implementation of the recommendations of the Report.

The President expressed his gratitude to the Team for the Report, which includes findings and recommendations aimed at preventing such an event from happening in the future. He also promised to review the Report and consider the recommendations.

President Boakai Provides Perspectives on Governance Issues In A BBC Interview as He Promises Swift Dismissal of Corrupt Officials

Executive Mansion, Monrovia; President Joseph Nyuma Boakai, Sr., was recently interviewed by the British Broadcasting Corporation (BBC) where he shed light on various governance issues including corruption, food security, impunity, drug abuse, and the future of Liberia's youth.

He emphasized the need for a change in the perception of government as a place for self-elevation and personal enrichment, rather than a place of service and accountability. He vowed that he would dismiss any official of government caught in acts of abuse of public resources, as he views corruption as the root cause of Liberia's problems.

President Boakai said he believes that Liberia is not a poor country but on the contrary, the country is well endowed, and that people must understand their responsibility to the state and people to change the narrative about Liberia being a poor and corrupt country.
The President intimated that he is selective when it comes to appointing people in government, as he is determined to fight corruption to the core. He pointed to his long years of public service without any stain of corruption to serve as a reminder for people coming to Government.

Regarding agriculture, President Boakai re-echoed his conviction that Liberia has the potential to feed the world if its endowments are managed well.

He said that Liberia’s soil and land are fertile to produce rice, the country's staple, and his comments do not amount to a quick-fix solution to food insecurity but rather an accentuation that the country has the resources to do a lot more if corruption is curbed.

On the issue of war crimes court, President Boakai stated that he believes that those who bear the greatest responsibility for crimes must account for their actions and admit their wrongs as a way of ending impunity and promoting reconciliation.

Local development from Tubmanburg City Bomi county..

Residents of Guie town, a community on the Tubmanburg to Monrovia highway have set up road blocks in an effort to prevent all Western Cluster trucks from plighting the road.

The decision of the citizens is as a result of a recent accident which occured on the 27th of this month involving a hired Western Cluster truck and a motorcycle carrying students from Guie town to Klay when the truck on its way from Monrovia ran into the motorcycle of three students along with the motorcyclist leaving them severely injured.

The protesters alleged that the company have deliberately refused to identify with those victimized and worse of all, some of the victims who are all residents of Guie have been discharge from the Liberia government hospital here in Tubmanburg with little or no proper medication being administered to them for their wellbeing.

They used the occasion to call on the county authority to swiftly intervene in order to prevent the reoccurrence of such a tragic incident in the county.

His Honor, Yousef D. Kaba, Associate Justice in Chambers of the Supreme Court of Liberia has ordered the Asset Recovery Team to release all Gracious Ride vehicles seized and stay all seizure pending the outcome of the conference.

The Justice in Chambers has cited both parties to a conference on Monday, 1st April, 2024 at 11:00am after Gracious Ride seek redress through the court.

In a related development, former Inspector General of Police Patrick Sudue vehicle that was seized by the Asset Recovery Team has also been ordered release by the court.

A Motorcyclist including three Female students on Wednesday morning were involved in a tragic accident along the Bomi Monrovia Highway.

The accident which occurred a few miles away from Klay Town at about 9:45a.m, involved a motorcycle carrying three Female students and a Truck belonging to Western Cluster Limited.

According to an eye witness who spoke to our reporter, the motorcycle was transporting the three students to school when the Truck allegedly ran into the motorcycle leaving the three students including the bike rider severely injured.

The eye witness also disclosed that the Truck driver was speeding in the opposite direction heading to Tubmanburg when he collided with the Motorcycle that was heading to Klay Town with the three Female students.

The accident according to this Eye witness was terrible, prompting the Truck driver to immediately escape the scene.

The Four Victims are being treated at the Liberia Government hospital in Tubmanburg, Bomi County.

Meanwhile, this station has been informed that one of the accident victim has been referred to Monrovia due to the severity of the condition.

Also speaking, the Officer in Charged at the klay Health Center Madam Musu Washington said they were able to give first aid to the four accident victims before taking them to Tubmanburg. She explained further that three out of the four victims sustain a major wound, describing the accident as very terrible.

At the Same time, Klay District commissioner Momo Seh expresses concern about the trend Western Cluster Limited, a multimillion dollars investment continue to operate on, threatening the survival of people living along the Bomi to Monrovia road.

The district commissioner statement came shortly after the tragic accident. He indicated that the action of western cluster truck drivers shows no respect for human rights and dignity, as such he wants the Bomi legislative caucus to take a decisive step to curtail reoccurrence.

Members of the fourth estate, distinguish ladies and gentlemen.

The office of the CEO is deeply concerned over the latest appointments by H. E President Joseph N. Boakai affecting the 15 Counties Local Administration.

Under the Local Government Act of 2018, specifically under ‘General Provisions” Chapter 1.3 the objective of the Local Government Act of 2018 which repeal the Local Government Law Title 20, Liberia Codes of Law Revised and established in its stead, a new Title 20 known as the Local Government Act of 2018 affirms the commitment of the Government of Liberia to further the unity of the republic by providing equal opportunity for all of its citizens to engage in the governance of the state through the devolution of certain administrative, fiscal and political powers and institutions from the national government to local governments, with these objectives:

To give effect to the country’s national policy on decentralization and local governance;

To ensure democratic participation, in and control of, decision-making by the citizenry;

To create and establish democratic, political, administrative and fiscal structures in local governance

To ensure sources of revenues in support of local government administration and operations.

The President of the Republic of Liberia H.E Amb. Joseph Nyuma Boakai recent appointment of Development Superintendents, including County Inspectors and Fiscal Superintendents across our country violates Chapter 2.13a of the Local Government Act of 2018 which states among many things that the County Administration shall comprised of:
. Superintendent. County Administrative officer. County Finance Officer. County Development Officer and. Head of County Administrative Departments

I am calling on the president in the fate of promoting good governance, and in the quest of re-enforcing decentralization, to withdraw those positions that violate the local Government Act of 2018 and do the right appointments in accordance with the Local Government Act of 2018.

I am also encouraging the legal advisor to the president and those working at the Ministry of State for Presidential Affairs to step up their work to avoid these embarrassments on the presidency.

We are cognizant of the facts that many supporters may need to be accommodated, but upholding the rule of law is cardinal.
