Mr. President, I hope that this message reaches you in perfect spiritual, mental, and physical HEALTH.
Mr. President, I am writing to express my concern about the executive order issued by former President George M. Weah that bans the exportation of unprocessed rubber.
As you may know, the rubber industry plays a significant role in our economy and the livelihoods of many people depend on it. I believe that lifting the ban on unprocessed rubber exportation would greatly benefit our country by boosting economic growth and creating more job opportunities.

I'm urging and pleading with you to reconsider this executive order and work towards finding a solution that balances the needs of the industry with any environmental or economic concerns.

As you may be aware, many Liberian farmers rely on rubber production for their livelihoods. The ban on unprocessed rubber exports has caused significant hardship for these farmers, as they are no longer able to sell their products on the international market. This has led to a loss of income and has caused many farmers to struggle to make ends meet. In addition, the ban has led to a decrease in rubber production, which has had a ripple effect on the economy of Liberia. Many businesses and services that depend on rubber production have been affected, and the overall economic outlook for the country has been negatively impacted. I hope you will consider these hardships Mr. President.

As a ranking member of the Senate’s Foreign Affairs Committee, I did my own due diligence on Madam Sara Beysolow Nyanti, President Joseph Boakai’s nominee for Foreign Minister. Her degrees from Western Governors University - an accredited online university where you can earn an affordable, accredited, career-focused college degree at an accelerated pace - are legitimate. I saw the transcripts. I didn't see any for Andrew Jackson University, which is now defunct. It was founded as a for-profit institution in 1994 by Robert McKim Norris Jr. and D. Michael Barrett. After being acquired in 2010 by Universitynow, Inc., it was renamed New Charter University, and subsequently in 2020, it was again renamed Bottega University (in Salt Lake City). Accredited as an online educational platform, it offers certificates and undergraduate and graduate courses. She may not have followed the traditional route in the pursuit of her university education that we are all accustomed to, but if a degree from an accredited university is a requirement, she has one.

Concerning the circumstances of her UN assignments, I spoke to two former senior UN officials who are familiar with her work, a senior former official of the International Republican Institute who was assigned to South Sudan at the time, and a retired former UN official who is familiar with her work in Nepal. I also had the privilege to speak with John Garang's widow, South Sudan’s former First Lady and one of the country's two VPs. All gave satisfactory feedback on her work. I am familiar with her work in Yemen when I served as head of the World Bank’s Global Hub for Fragile States.

The issue for me was integrity and her ability to deliver. My own research and outreach to people who are familiar with her work reassured me. I do not doubt that she is competent to be our Foreign Minister. Could there be other issues? I don't know. This is why the Foreign Affairs Committee chaired by Senator Abe Darius Dillon has decided to do a second hearing in the Committee Room before forwarding the nominee to the Senate Plenary for a vote. The Senate is an elder's house, and we must act like it by being thorough in our decision-making processes void of emotions and public sentiments.

CDC Demands Apology from President Boakai, Alarms Over Motives Necessitating the President's Deceit About GOL Consolidated Account Balance-

The Coalition for Democratic Change ( CDC) has called on President Joseph Nyumah Boakai to unconditionally apologize to its Political Leader, former President George Manneh Weah, the Liberian people and the world at-large for deliberately providing misleading accounts about the financial situation of the country, especially with regards figures of the consolidated account balance at the Central Bank of Liberia.

It can be recalled that a couple of days ago, the Coalition for Democratic Change, while responding to President Boakai's first State of the Nation Address during a press conference held at its Headquarters, expressed disdain about the President's decision to intentionally and maliciously dispute figures provided by his immediate predecessor and leader of the CDC, H E., George M. Weah about the the total balance of the consolidated accounts at the Central Bank of Liberia; and at the same time, the party challenged President Boakai to publish in 48 hours the statement of the consolidated accounts corroborating his claims or the CDC would have made copies of the authentic CBL statement that confirms what former President Weah reported in his farewell address to the nation.

The CBL Governor's appearance today at the Legislature, which witnessed his documentary testimony of the consolidated account balance as of January 19, 2024 to exactly the same as President Weah reported in his farewell address about the figure being a little over 40 Million USD, as opposed to what President Boakai erroneously reported to be 20.5 Million USD, coincides with the party's 48 hours ultimatum to President Boakai as was provided during its recent Press Conference.

With this vindication from the Central Bank of Liberia’s Governor, the Coalition for Democratic Change sees President Boakai's action as not only a deliberate intent aimed at misleading and deceiving the very people he claimed during his campaigns to govern with honesty from the get-go of his administration, but a mudslinging attempt to impugn the stellar accountability and transparency credentials of the CDC-led government under the astute stewardship of former President George Manneh Weah.

While the CDC demands an apology from President Boakai, it is also taken aback by the growing incompetence associated with the Boakai Presidency in the formative days of his administration.

The failure of the President to have completed his constitutional duty of delivering an inaugural address which was disgracefully aborted, coupled with his inability to fact-check rudimentary financial issues such as the bank balance of the country's consolidated account is flabbergasting, worrisome and concerning as to whether President Boakai has the capacity to do the heavy liftings associated with the Liberian presidency.

The CDC also has reasons to believe that President Boakai's decision to have deliberately understated what was left in the consolidated account after he obviously verified, could be criminally motivated and as such is calling for a further criminal investigation.

This position of the party is even more cemented from the facts that there are unimpeachable reports of monies intended for the inaugural program in various districts yet to be accounted for, and are reportedly squandered and mismanaged.

The CDC remains committed to this cause supra mentioned as it will collaborate with other political parties and Civil society institutions in the coming days or weeks to ensure investigations are launched into what appears to be emerging financial improprieties taken place under the watch eyes of president Boakai.”

Justice Nagbe's Request for Early Retirement and Cllr. Dean's Nomination as His Successor: My Perspective

A firestorm of controversy has ignited since news broke of the "retirement" of Justice Joseph Nyenetue Nagbe due to ill-health and the nomination by the President of Cllr. Frank Musa Dean to succeed him. The controversy centers around the legality of the "retirement" as well as the timing of the nomination.

The arguments are that Justice Nagbe is not qualified for retirement because he does not satisfy the requirements for retirement as provided for under the New Judiciary Law, and that a lame duck President can not nominate or appoint his successor.

I will construct my argument on three issues which are germane to providing an understanding of the controversy:

1. Does Justice Nagbe's request for retirement meet the legal requirements for the retirement of Justices of the Supreme Court?

2. If not, can the President exercise his executive authority to grant him a special dispensation for retirement?

3. Whether or not the President's powers to nominate and appoint officials of government are limited at anytime during his tenure?

Issue #1 presents a question of Justice Nagbe's eligibility for retirement. But here
are the facts upon which a determination can be made as to his qualification for retirement, or upon which the retirement law can be applied. Justice Nagbe was appointed to the Supreme Court in June 2018, about five and half years ago. He did not serve in any other judicial capacity. He was a legal practitioner and later a Representative for two years and a Senator for twelve and half years.

Section 13.4 of the Judiciary Law - Title 17 - the Liberian Code of Laws Revised, provides in Subsection 3 (sic) that "Any Justice, judge or stipendiary magistrate ... who has served continuously for 10 years or more in any such capacity and has been certified, after appropriate physical or mental examination by competent medical authorities that he has become permanently disabled from performing his duties, or who has completed at least 25 years of continuous judicial service or at least 30 years of cumulative judicial service, may retire from regular active service with the right to receive a retirement pension...."

That's what the law says. Even though Justice Nagbe has 20 years of cumulative public or government service both in the Legislature and the Judiciary, he served only five and half of those years in the Judiciary; that's four and half years short of the tenure requirement for retirement. This is the only eligibility requirement for retirement, and he falls short of that.

Issue #2 pertains to and brings to focus the executive authority of the President as head of state and head of government.

"The Executive Power of the Republic shall be vested in the President who shall be Head of State, Head of Government and Commander-in-Chief of the Armed Forces of Liberia." Constitution of Liberia, Article 50.

As "Head of State and Head of Government," the constitution gives the President enormous powers, called the enumerated powers of the President. Some of such powers are found in Article 59 of the constitution: "The President may remit any public forfeiture and penalties, suspend any fines and sentences, grant reprieves and pardons, and restore civil rights after conviction for all public offenses, except impeachment."

Coming with the enumerated powers of the President are unenumerated powers, which follow from the interpretation of the enumerated powers. For simplicity, unenumerated powers are implied powers or powers not individually listed in the constitution. Issuing Executive Orders, for instance, is an unenumerated or implied power of the President.

Unenumerated powers are implied powers, and in exercise of them, the President must act lawfully (paraphrased), as opined by the U. S. Supreme Court in the President Harry Truman's Steel Factory Siezure Case of 1952.

And the reasoning for unenumerated powers is that if the President is the head of state and head of government, and has inherent or enumerated powers (i.e. constitutionally) to do certain things, then it follows that the President can do other lawful things arising from or consequential to those enumerated powers. So, if the President, for example, can "grant reprieves and pardons, and restore civil rights after conviction for all public offenses," in exercise of his enumerated powers, then it follows that the President can also grant centain unenumerated rights or benefits to public officials and ordinary Liberians. Therefore, the President can grant Justice Nagbe retirement, which is lawful.

And thanks to the President for granting his request for retirement. I believe, in making this decision, the President gave due consideration to Justice Nagbe's cumulative 20 years of public service, and the untold hardship that he would suffer -- even to the detriment of his life -- if he had no income to take care of himself and pay his medical bills. Remember, Justice Nagbe got sick while serving his country.

As to issue #3, which is the most straightforward of the three, the President is the President for six years, beginning at noon on the third working Monday of January 2018 and ending at noon on the third working Monday of January 2024, and can perform all his constitutionally assigned functions, including implied functions arising therefrom, until the end of his tenure or his last day in office.

In other words, there is no constitutional prohibition or limitation on the powers and authority of the President until he leaves office. So, the President acted in his constitutional authority to nominate Cllr. Dean as Associate Justice. And this act of the President can not be questioned by any other Branch of the Government, under the political question doctrine, because it's not unconstitutional.

The problem with that nomination, however, is that the Senate may not have ample time to diligently vet the nominee for this high profile position. We are in a special session lasting only two weeks, with one week gone already.

It only takes the right individual to do the right thing at the right time.
Today, under the well-knowledgeable stewardship of the Gardnerville Township commissioner Hon. Stanley L Wright, the multitude of the township can display to the nation a massive developmental initiative across the township.
Mr. Wright was appointed a few months ago by the outgoing president George Weah to serve as a commissioner in the township of New Gardnerville but his workings have unfurled the eyes and minds of a lot of Liberians who always thought that the commissioner's work (s) is limited to only making sure that companies, industries and businesses pay their required taxes to the (GOL).
But contrary to what many Liberians believe, Hon. L Wright has introduced a new path of duty as a commissioner by being a developmental-oriented commissioner.
