LIBERIAN LEGISLATURE
JOINT RESOLUTION -001/2024
OF THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE REPUBLIC OF LIBERIA ON THE MECHANISMS FOR THE
ESTABLISHMENT OF AN EXTRAORDINARY CRIMINAL COURT AND A DOMESTIC CORRUPTION COURT FOR WAR AND ECONOMIC CRIMES, RESPECTIVELY.

WHEREAS, the various phases of the Liberian civil wars from 1989 to 2003 resulted in deaths of innocent civilians and destruction across Liberia, including the displacement of nearly half of the population, horrific abuses, including summary ex*****ons, massacres, mutilation, torture, r**e and other forms of sexual violence, and forced conscription and use of child combatants; and,

WHEREAS, Chapter I, Article I of the 1986 Constitution of Liberia vests power in the people of Liberia to institute by their authority and for their benefit the right to alter and reform their government when their safety and happiness so require; and,

WHEREAS, for the safety and happiness of the people, the Government of Liberia, pursuant to Article 57 of the 1986 Constitution, has signed all United Nations Conventions on human rights, treaties, protocols and agreements, including but not limited to the Rome Statute of 1998, and thereafter, the Legislature, consistent with Article 34(f) has ratified all of the international treaties, human rights conventions, protocols and agreements, including the Rome Statute of the International Criminal Court (ICC) to form part of the domestic laws of the Republic of Liberia; and,

WHEREAS, Article 34() of the 1986 Constitution vests in the Legislature the power and authority to establish various categories of courts for criminal offenses and provide for the punishment thereof and the creation of specialized courts, including the Extraordinary Criminal Court is intended for the security of the state as in keeping with Article 34(b), and the Legislature is also empowered under Article 34(1) to make other laws which shall be necessary and proper for carrying into ex*****on the foregoing powers, and all other powers vested by this Constitution in the Government of the Republic, or in any department or officer thereof; and,

WHEREAS, Article XII of the Liberian Comprehensive Peace Agreement signed on August 18, 2003, provided for the establishment of a Truth and Reconciliation Commission (TRC) to provide a forum that will address issues of impunity, as well as an opportunity for both victims and perpetrators of human rights violations to share their experiences in order to get a clear picture of the past to facilitate genuine healing and
reconciliation; and,

WHEREAS, the Liberian Legislature enacted the Act to Establish the Truth and Reconciliation Commission of Liberia (IRC Act) in 2005, formally creating the TRC with a mandate to promote national peace, security, unity, and reconciliation by investigating gross human rights violations and violations of humanitarian law, sexual violations, economic crimes that occurred between January 1979 and October 2003; and,

WHEREAS, the Liberian TRC submitted its final report to the Legislature on December 19, 2009, recommending the establishment of an Extraordinary Criminal Court of Liberia, an international domestic court with authority to prosecute individuals accused of gross human rights violations, serious humanitarian laws violations, and certain domestic crimes, and,

WHEREAS, Section 48 of the TRC Act provides that Β«The Head of State shall, report to the Legislature within three months of receipt of the report of the TRC, and on a quarterly basis thereafter as to the implementation of the Commission's recommendations," and "Where the implementation of any recommendation has not been complied with, the Legislature shall require the Head of State to show cause for such non-compliance," and,

WHEREAS, Successive Governments of Liberia have not fully implemented the recommendations of the Truth and Reconciliation Commission to date, including the establishment of an Extraordinary Criminal Court for Liberia, due to many technical, legal and constitutional issues arising from the TRC Report and controversy on the actual intent of the TRC as contemplated by the warring factions, African Governments, and the civil society, who negotiated the Accra Comprehensive Peace Accord; and,

WHEREAS, the United Nations (UN) and other international partners have experience with the creation and functioning of war crimes courts, including courts with international and domestic participation and expertise; and,

WHEREAS, the Legislature notes that certain constitutional and legal prohibitions have to be considered in the establishment of an extraordinary criminal tribunal for war crimes on Liberian soil and several processes and broad consultations have to take place to derive the best product for the prosecution of war crimes; and,

WHEREAS, the Legislature also notes that economic crimes, including corruption, committed between the period 1979 and 2023 and beyond, are cognizable under domestic criminal jurisprudence and in domestic criminal courts; and,

WHEREAS, the final report of the TRC contains other recommendations besides the issue of war and economic crimes which are yet to be implemented; and,

WHEREAS, the UN Human Rights Commission in July 2018, expressed,
with regard to Liberia, β€œconcerns that none of the alleged perpetrators of gross human rights violations and other crimes mentioned in the TRC report has been brought to justice" and urged Liberia to establish a process to bring about accountability for past crimes and report back on the issue of impunity and accountability for civil wars-era crimes by 2020; and,

WHEREAS, up to 2024, no such report by the Government of Liberia in fulfillment of its international obligations has been produced and provided by the Government of Liberia to the UN Human Rights Commission; NOW, THEREFORE, it is resolved by the Senate and the House of Representatives of the Republic of Liberia in Legislature assembled:

(1) That justice should prevail and there should be no impunity for those who bear the greatest responsibility for war crimes, crimes against humanity, other violations of international humanitarian law and other domestic crimes which occurred during the Liberian civil crisis;

(2) That pursuant to Chapter 1, Article 1 of the 1986 Constitution which vests in the people of Liberia the right to alter and reform their government when their safety and happiness so require, and the Executive consistent with Article 57 has signed all United Nations Conventions on human rights, treaties, protocols and agreements, including, but not limited to, the Rome Statute of 1998, all of which the Legislature has ratified under Article 34(D); the Legislature supports the full implementation of the Truth and Reconciliation Commission recommendations including the timely establishment of an Extraordinary Criminal Court for Liberia to be known as UN backed "Special War Crimes Court for Liberia (SWACCOL)" to prosecute those who bear the greatest responsibility for war crimes and crimes against humanity committed between the period 1979 and 2003;

(3) That consistent with Article 34(e) (b) (j)(I) of the 1986 Constitution, the Executive shall develop a legal framework and submit same to the Legislature for enactment into law for the establishment of an Anti-Corruption Court (ACC), under domestic jurisprudence, for fast-track trial of those who will be investigated and subsequently indicted for acts of corruption and other economic crimes committed from 1979 to 2003; β€œand such crimes committed from 2004 to present constituting constitutional rule. This fast-track corruption court shall remain the
primary court for the dispensation of justice for corruption and other economic crimes going forward, in line with Liberia's Penal Code and prevailing international laws and standards;

(4) That the President shall write the UN, the EU, and the US Government expressing the Government's intention to establish the Extraordinary Criminal Tribunal on Liberian soil and thereby request financial and other assistance; develop a financial resource mobilization plan and submit it to the United Nations, the EU, the US Government, and other international partners to seek financial and economic support for the establishment and operations of an Extraordinary Criminal Tribunal on Liberian soil or alternatively to a country to be designated;

(5) That the President shall report to the Legislature as to the progress made on the establishment of the two courts as well as challenges, if any, or outcome(s) of his engagements with the United Nations, the EU, the US Government, and other international partners regarding the resource mobilization plan and results, including domestic resource mobilization through the budgetary process, pursuant this Resolution;

(6) That consistent with Chapter 2, Article 5(c) of the 1986 Constitution, the President shall issue an Executive Order to establish the Office of War Crimes (OWC) within the Ministry of Justice, and appoint forthwith, a Special Envoy or Officer-In-Charge (OIC), duly certified by the International Criminal Court (ICC) in The Hague, Netherlands, or the African Court on Human and Peoples' Rights (ACtHPR) or any other International Courts and Tribunals with the relevant experience, qualification and competence in international criminal law and practice, to organize and coordinate all actions and activities regarding the Court and assist the President to mobilize resources and do all that is legally feasible, including the establishment of a secretariat, where applicable, to facilitate its operations
and the successful implementation of its mandate, among others, done in consultation with the UN, the EU, the US, and/or other independent parties; and

(7) That to jump-start this renewed campaign of national reconciliation and healing as the final phase of Liberia's recovery process, the President shall implement the following recommendations of the TRC; (a) Offer apology on behalf of the State to the many victims and the people of Liberia in general for its role in the conflict and for the injuries and losses sustained by individuals and communities;

(b) Work with the United Nations, the EU, the US Government, and other international partners to set up a Reparation Trust Fund (RTF) for victims and communities worst affected by the conflict, to benefit through direct financial assistance or through development programs and projects; and

(c) Continue the National Palava Hut Program and other programs for national healing, peace building and reconciliation; and

(d) Construct a national monument to commemorate the victims of the atrocities, to serve as a reminder of the w,ar and to create a national consciousness against armed conflicts.

Twenty-seven (27) oTwenty-nine (29) Senators have signed a resolution endorsing the establishment of the war and economic Crimes court in Liberia.

Thanks to Senators who have trusted in my leadership on why they should sign this resolution and also thanks to those who have another view on this matter.

We have communicated with the Speaker of the House of Representatives Cllr. Fornati Koffa and members of the House of Representatives seeking their concurrence.

We believe this decision will bring an end to the perception in the public that Members of The Liberian Senate are against establishing war and economic crimes courts. We believe this decision is the beginning of ending impunity in Liberia.

Gbarpolu Citizens in America Gift 387 Armchairs to Gbarnga-gborketa Town Public School

Gbarnga-gborketa, Bokomu District ~ The citizens of Gbarpolu County living in the United States have made a significant donation to the Gbarnga-gborketa Town Public School in the Bokomu district of Gbarpolu electoral district #2.

On April 8, 2024, a total of 387 armchairs were presented to the school to improve the learning environment for the students.

Jeffery Carter, a representative of the Gbarpolu County Association In The united states., had the honor of presenting the armchairs to the school in the Bokomu District.

In his address, he highlighted the deep connection that the diaspora community maintains with their homeland and expressed their understanding of the challenges faced by schools in the county.

"For some time now, your brother, sisters, and families in the US say that they are aware that certain schools in our beloved county are lacking basic setting capacity," Carter stated. "In recognition of this, our brothers and sisters in the US have decided to support the government's efforts by providing these chairs to improve the learning environment of students at Gbarnga-gborketa Town Public School."

The Parent-Teacher Association (PTA) Chair, school administration, and students gathered to express their heartfelt thanks to the Gbarpolu citizens in America for their thoughtful gesture.

They acknowledged the importance of the donation and assured the donors that the armchairs would be put to good use for the benefit of the students and the school as a whole.

"We are truly grateful to our citizens in America for this big donation of armchairs," said the PTA Chair Samuel Y. Gokporlu

He said that the donation will help us address the challenges we have faced in providing adequate seating.

The school principal Harris K. Mulbah echoed the sentiment of gratitude, emphasizing the impact that the donation is going to have on the educational experience of the students.

He pledged to ensure that the chairs were utilized effectively and maintained for years to come.

James Miller, the student President said that he and the rest of the students are excited by the new addition to their school. He expressed appreciation for the support shown by the Gbarpolu citizens in America.

He said that they, the students eagerly anticipated the improved learning environment that the armchairs would provide, fostering a sense of comfort and focus in their studies.

The only Auditorium of the Gbarma Central High School, along with the office of the District Education Officer, bore the brunt of the storm's fury. The once vibrant and essential spaces now lay in ruins, posing a significant threat to the District education system.

With the heart of the school and district administration in shambles, urgent action is needed to rebuild and restore these vital structures according to the authorities in the District.

The Auditorium, where students gathered for assemblies, performances, and events, now stands as a stark reminder of the storm's devastating impact.

The District Education Officer's office, the hub of educational planning and coordination, is now a shell of its former self.

In the face of this crisis, the Gbarma school system is appealing to the public for immediate support.

The Principal of the Gbarma Central High School, Blama V. Kinneh is calling on all stakeholders, government agencies, NGOs, and concerned individuals to join hands in the rehabilitation efforts.

"Together, we can restore hope and opportunity to the students and educators of Gbarma Central High School. Time is of the essence – let us act swiftly and decisively to rebuild what the storm has taken away," Principal Konneh said.

President's Representative Donates Rice and Funds to Muslims in Gbarpolu for Ramadan Celebration

Gbarma ~ In a heartwarming display of generosity and solidarity, the Assistant Minister for Urban Affairs, Mike B. Jabateh, on behalf of President Joseph Nyuma Boakai Sr, presented 200 bags of rice and $L100,000.00 to Muslims in Gbarpolu ahead of the Ramadan Day celebration.

The donation ceremony took place on April 8, 2024, in Gbarma, where the Ministry of Internal Affairs official made the generous gesture.

During the presentation, it was revealed that Gbarma and Kongba Administrative Districts received 40 bags of rice along with $L40,000.00 in cash.

The remaining four districtsβ€”Bopolu, Bokomu, Belle, and Guo Nwolailaiβ€”received a distribution of the remaining rice and funds based on their respective needs, as determined by the Ministry of Internal Affairs Assistant Minister.

During the Presentation, the Assistant Minister said that the donation not only symbolized the spirit of giving but also exemplified the government's commitment to ensuring that the country partakes in the joyous occasion of Ramadan.

Meanwhile, the beneficiaries have commended the Presidency for the suppliers.

On March 31, 2024, a groundbreaking moment unfolded as President Joseph Nyuma Boakai Sr nominated Lawrence, the esteemed Voice of Gbarpolu Radio / TV (VOG) District Correspondent, as the Commissioner of Kongba District, a testament to his outstanding contributions and remarkable leadership and community service through their local radio, Radio Kongba.

For over three years, Lawrence Sherbo has been the steadfast voice of the people, tirelessly working as a District Correspondent for Voice of Gbarpolu.

Through his compelling storytelling and deep-rooted passion for uplifting his community, he has brought to light the triumphs, challenges, and aspirations of the people of Kongba District, earning their trust and admiration along the way.

His reports were always human interest stories: About the continued suffering of the people of Normon, the long story around the Normon proposed clinic project, the health-related, the roads, forest governance, the justice system, etc.

Despite facing numerous hurdles, Lawrence Sherbo pursued his education with unwavering determination, completing his high school education in 1988, at the C H Dewey Central High School, Tubmanburg City in Bomi County.

Besides, on October 07, 2017, obtained a certificate from the Forestry Training Institute (FTI) in Tubmanburg City, showcasing his commitment to continuous learning and personal growth.

His journey is a testament to the power of perseverance and dedication in achieving one's dreams.

Before he was nominated Commissioner of the Kongba District, Lawrence Sherbo honed his skills and expertise through a diverse array of job experiences with notable organizations such as the Society For the Conservation of Nature in Liberia (SCNL) - from 2015 to 2024, LISGIS, NEC, and IRC.

SENATOR KANNEH CONGRATULATES, CLLR MOIFFIE KANNEH ON HIS APPOINTMENT, APPRECIATES PRESIDENT BOAKAI

Monrovia-Liberia, April 6, 2024

The office of Senator Botoe Kanneh and in her name as Senate Committee Chair on Gender, Children and Social Protection congratulates a Professional and legal Luminary in Cllr. Moiffie Kanneh on his appointment.

According to a Communication from the Office of the President, signed by His Excellency President Joseph Nyuma Boakai served the Liberian Senate, the President is requesting a Confirmation hearing for Cllr. Moiffie Kanneh who was nominated as Deputy Director General at NASSCORP.

The Confirmation hearing following his Communication, was then put on hold due to a "Petition for a Writ of Prohibition" filed by Madam Carmena Cephas-Yeke, dismissed Deputy Director General at the National Social Security & Welfare Corporation (NASSCORP ).

But on Thursday, April 5, 2024, a directive of his Honor Yussif D. Kaba, Associate Justice Presiding through the Clerk of the Supreme Court, mandated the Justice Ministry, Justice MINISTER, and Attorney General of the Republic of Liberia as RESPONDENT to resume jurisdiction, and proceed in keeping with the Law, as the Justice has declined to issue the Writ prayed by the PETITIONER.

With this ruling from the Court, the Liberian Senate will now begin jurisdiction into this and anticipate Monday, April 8, 2024, as the new date for his confirmation hearing.

Meanwhile, the Senator sees this Appointment as welcoming and is congratulating him as he awaits his confirmation hearing as Deputy Director General at NASSCORP.

It's the Senator's ardent hope that when confirmed he will prioritize the interest of the Liberian People over personal Interest.
