국제법상 국제기구 정의
국제기구(International Organization) 정의
국제기구란 조약 또는 기타 국제법(관습 등)에 의해 규율 되는 문서에 의해 설립되고 독자적인 국제법인격을 가진 기구를 뜻하며, 주권을 가진 국가들 중 2개 이상의 국가들이 합의에 의해 만든 국제협력체로서, 독자적인 지위를 갖는 기관으로 구성된 기구이다.
국제법은 국제사회에서 다수의 국가들 사이에 적용되는 법으로, 국가 상호 간의 관계 또는 국제 조직 등을 규율하며 또한 국제법은 조약과 국제 관습법, 법의 일반원칙 등의 형식으로 나타남. 국제기구의 회원으로는 국가기관 이외에 기타 실체도 포함될 수 있다고 규정하여, 비국가행위자(NSA; Non-state Agent), 즉 다국적기업(MNE; Multinational enterprise), 비정부기구(NGO), 심지어 개인도 포함될 수 있다고 규정(한국법제연구원, 유럽에너지법 I, 31p, 고시계사).
어떤 실체가 IO인지 식별하고, IO를 국제 “NGO(비정부기구: Non-Governmental Organization)” 및 공공법인과 같은 “국제적인 협회” 및 별도의 법인격이 부여되지 않은 “조약기관(예, 당사국과 사무국 회의)”과의 구별을 통해 국제기구의 위치를 파악하여 개념을 명확히 정의할 수 있다.
2. IO-WGCA와 국제기구 관계
1) IO-WGCA(국제기구 세계녹색기후기구 ; International Organization-World Green Climate Association)가 국제기구인지 여부를 식별하는 조건으로는 국제기구 정의 상 우선 “조약 또는 기타 국제법에 의해 규율 되는 문서”에 의해 설립되어 있는 지를 살펴보는 것이 첫 단계라 할 수 있다. 본 국제기구기구(IO-WGCA)는 ‘비엔나협약(조약 제1089호-오존층 보호에 관한 협약)’ 및 ‘국제연합기본협
