Can a police officer search your car🚗 without a search warrant?👮‍♂️ Yes, he can! ✅ Under the motor vehicles act, Section 213(5), there are grounds under which a police officer can search your car. They are as follows: ⬇️ 1. If he has the reason to believe that any person in the car has committed an offense under this Act. 2. When he has a hint of suspicion or reasonable doubt to do so 3. If the police officer has received some information from a credible source, regarding some illegal activity taking place in the car or if someone has filed a complaint against suspicious and illegal activity taking place in the car. Can daughters be given coparcenery rights?🙍‍♀️ Vineeta Sharma v Rakesh Sharma Civil Appeal Diary No.32601 of 2018👨‍⚖️👩‍⚖️ The case develops upon the rights of a daughter with respect to the Section 6, amended by the Amendment Act of 2005. The case overruled Prakash v Phulvati, to hold that section 6 nowhere entails the requirement of having a living coparcenary or living daughter to avail such right. Coparcenary right is by birth and not depending upon whether the father is alive. In addition to this the Court held ⬇️ 1. The rights can be claimed by the daughter born earlier with effect from 9.9.2005 with savings as provided in Section 6(1) as to the disposition or alienation, partition or testamentary disposition which had taken place before 20th day of December 2004. • Section 6 of HSA,1956 does not do partition of coparcenary. It determines the share of the deceased coparcener when he was survived by a female heir, of Class -I as specified in the Schedule to the Act of 1956 or male relative of such female. • Plea of oral partition cannot be accepted unless the plea is supported by public documents and is evinced in the same manner as affected by a decree of a court, it may be accepted. Whether the anticipatory bail granted is time bound ? 🤔 Sushila Aggarwal v State of NCT of Delhi 2020 SCC OnLine SC 98 The case deals with the issue of anticipatory bail. The key takeaways from the judgment are extracted as below ⬇️ 1. When a person complains of apprehension of arrest and approaches for order, the application should be based on concrete facts relating to the offence, and why the applicant reasonably apprehends arrest 2. Depending on the seriousness of the threat of arrest the Court should issue notice to the public prosecutor and obtain facts, even while granting limited interim anticipatory bail 3. Nothing in Section 438 Cr.PC, compels courts to impose conditions limiting relief in terms of time, or upon filing of FIR, or recording of statement of any witness, by the police, during investigation or inquiry 4. Courts ought to be generally guided by considerations such as the nature and gravity of the offences while considering whether to grant anticipatory bail, or refuse it 5.
