The High Court said that in matrimonial disputes, the law must aid parties to resolve the differences with the assistance of the Court. This new matrimonial procedure is highly efficient and it allows parties to be more involved in their own case. The High Court said that the legislation on divorce must focus on the parties rather than the dispute itself.

This means that courts should be more focused on what is best for both parties and not just one of them because of a disagreement. This is an important decision in deciding what is best for both parties. The High Court held in its judgment that the fixation of the minimum period of separation of one year as stipulated under Section 10A is violative of the Constitution .The High Court held that the impugned provisions of Section 10A of the Act were violative of Article 14, 15 and 21 of the Constitution

The Madras High Court prohibited all media outlets from disclosing any information about the survivor, her deposition, or anything else that might qualify as evidence during the trial in the case while hearing a petition filed against Nakkheeran magazine last year for violating the Supreme Court's guidelines on covering cases of sexual assault and r**e. The court further warned the media that any violations would result in severe penalty from the court.

When a woman was dressed in sexually provocative clothing, a sexual harassment complaint will not stand prima facie: Kerala Court in Bail Order.
The Court noted that it is a well-established principle that when there is a prolonged delay in filing a FIR, the reason for the delay must be adequately explained. The court observed that to attract section 354A of IPC which deals with sexual harassment, there must be physical contact and advances involving unwelcome and explicitly overtures. There must be demand or request for sexual favors. There must be a sexually colored remarks. The court further observed that the photographs presented here by the accused would reveal that the de factor complainant herself is exposing to dresses which are having some sexually provocative one. Hence, section 354A will not stand prima facie.

The Indian judiciary is divided into several levels in order to decentralize and address matters at the grassroots levels. The basic structure is as follows:

1. Supreme Court: It is the Apex court of the country and was constituted on 28th January 1950. It is the highest court of appeal and enjoys both original suits and appeals of High Court judgments. The Supreme Court is comprised of the Chief Justice of India and 25 other judges. Articles 124-147 of the Constitution of India lay down the authority of the Supreme Court.

2. High Courts: High Courts are the highest judicial body at the State level. Article 214 lays down the authority of High Courts. There are 25 High Courts in India. High Courts exercise civil or criminal jurisdiction only if the subordinate courts in the State are not competent to try the matters. High Courts may even take appeals from lower courts. High Court judges are appointed by the President of India upon consultation with the Chief Justice of India, the Chief Justice of the High Court and the Governor of the State.

3. District Courts: District Courts are established by the State Governments of India for every district or group of districts based on the caseload and population density. District Courts are under the direct administration of High Courts and are bound by High Court judgments. Every district generally has two kinds of courts:

a. Civil Courts

b. Criminal Courts

District Courts are presided over by District Judges. Additional District Judges and Assistant District Judges may be appointed based on the caseload. Appeals against District Court judgments lie in the High Court.

4. Lok Adalats/Village Courts: these are subordinate courts at the village level which provide a system for alternate dispute resolution in villages.

5. Tribunals: the Constitution provides the government with the power to set up special Tribunals for the administration of specific matters such as tax cases, land cases, consumer cases etc.

Appellate jurisdiction refers to the authority of a court to rehear/review a case decided by a lower court. In India, appellate jurisdiction is vested in both the Supreme Court and High Courts. They may either overrule or uphold the judgments of lower courts.

Title : Without Reason No Arrest by Police
and Without Reason Not Arresting by Police
पुलिस के लिए यह अनिवार्य है कि वह किसी संज्ञेय अपराध में किसी व्यक्ति को गिरफ्तार करने या न करने के कारणों को दर्ज करे, जहां सजा 7 साल या उससे अधिक की हो।
यदि कारण दर्ज नहीं किया जाता है, तो गिरफ्तारी अमान्य है। इसी प्रकार बिना कारण गिरफ्तारी न करने की भी अनुमति नहीं है।

It is Compulsory for Police to Record the Reasons for Arresting or Not Arresting a person in a cognizable offence where punishment amounts to 7 years or more.
If the reason is not recorded, the arrest is invalid. Similarly, without the reason of not arresting is also not permitted.
