MIDNIGHT ATTACK BY A POLICE TEAM ON A LABOURER AT DEVAK RIVER (VIJAYPUR)

CJM, Samba directed SSP, Samba to register an FIR.

In a significant order, the Chief Judicial Magistrate, Samba Umesh Sharma has directed the Senior Superintendent of Police, Samba to register a FIR with respect to the occurrence and further directed holding of the investigation into a midnight attack by a Police Team of Police Post, Rakh Amb Tali, Samba upon a labourer namely Farman Ali S/o Sh. Rashid Ahmed R/o Rakh Barouti, Tehsil and District Samba.

The aforesaid directions were passed in a complaint filed by Bashir S/o Lal Hussain R/o Rakh Barouti, Tehsil and District Samba (uncle of the victim Farman Ali) under Section 175 (3) of BNSS, 2023 through Advocates M. Zulkarnain Chowdhary wherein it was alleged that on 07-10-2024 at 3:00 A.M. at River Devak, Near Boundary Wall of AIIMS, Vijaypur (Samba), the victim Farman Ali was busy while loading sand in a tractor trolly when all of a sudden, a Police Party in a white colour Gypsy No.JK20A-2689 headed by Incharge, P/P, Rakh Amb, Tali namely Baljit Singh alongwith H/C Des Raj, H/C Gopal Krishan, SPO Dalip Kumar and others reached on spot and started abusing and beating Farman Ali without any provocation and started indiscriminate firing and fired a bullet on the right side of the face of the victim Farman Ali due to which it fractured the right side of the face and also hit other parts of the victim’s body.

Advocate M. Zulkarnain Chowdhary vehemently argued that the uncle of the victim Bashir approached the SHO, P/S, Vijaypur for registering of an FIR against the erring Police Officials but the needful was not done and the complainant thereafter approached SSP, Samba with a written application but the same also did not evoke any response.

On presentation of the application, the CJM, Samba directed the SSP, Samba to file a detailed report in the matter and the same was filed through DySP HQ, Samba wherein it was contended that the claim of the complainant is baseless and has been put forth just to counter the actual occurrence.

The CJM, Samba after receipt of the report directed the DySP HQ, Samba to appear in court for making submissions and the DySP appeared in person and reiterated the averments of the report filed by him.
Advocate M. Zulkarnain Chowdhary appearing for the complainant in the open court submitted that the Police report is not based on facts and the Police is violating the mandate of law as laid down in Lalita Kumari’s judgment and despite disclosure of cognizable offence, the Police has refused to lodge FIR in the matter.

After heated arguments from both the sides, the CJM, Samba Umesh Sharma observed that without any doubt, the fact as to whether the grievous injury sustained by Farman Ali has been caused by any gun shot or by anything else can only be cleared, if a full fledged investigation is carried out in the matter for which a prior FIR is a sine qua none. A thorough investigation to find out as to whether the gun shot fired by the Police Team was fired in air or not and if it was fired in air, as to how the same has hit the jaw of Farman Ali as alleged by the complainant. The Ld. Counsel M.Zulkarnain Chowdhary has also submitted that in case the bullet which had hit the Farman Ali was not fired by the Police party as alleged by the Police then again it requires thorough investigation as to by whom the said bullet was fired, if not, by the Police party. Therefore, in view of the allegations made in the application, this is a fit case where FIR needs to be registered so that a proper investigation, especially in light of expert opinion including that of the medical and blastic /forensic experts into vital aspects of the case is carried out and the real culprits, if any, behind the alleged occurrence are identified and booked under law.

With these observations and directions, the CJM,Samba Umesh Sharma directed the SSP, Samba to register FIR with respect to the occurrence and also directed thorough investigation in the matter.

*Police books 02 drug peddlers under PIT NDPS Act in Kupwara*

Kupwara, December 02: In a determined effort to combat drug abuse and trafficking, Police in Kupwara have booked two drug peddlers under the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances (PIT NDPS) Act.

Kupwara Police successfully executed two PIT NDPS Act warrants issued by the Divisional Commissioner, Kashmir, against two hardcore drug peddlers namely Fayaz Ahmad Dar son of Gh Ahmad Dar resident of Halmatpora and Majid Rehman son of Ab. Rehman Khan resident of Challgund Hyhama. Following the ex*****on of the warrants, the accused have been lodged in District Jail Poonch and District Jail Kathua, respectively.

This action against them was initiated following the submission of material records, dossiers, and connected documents by the Senior Superintendent of Police, Kupwara. Additionally, Majid Rehman is also involved in two narcotics-related cases viz, FIR No. 26/2024 U/S 8/21 NDPS Act and FIR No. 138/2024 U/S 8/20 NDPS Act registered at Police Station Kupwara.

These decisive actions highlight the steadfast commitment of J&K Police to eradicating drug trafficking and abuse in the region. The detention of these habitual offenders under the PIT NDPS Act sends a strong and clear message to those involved in drug-related crimes.

No School can interview children for Admission: Director School Education Kashmir cautions private institutions

Srinagar, Dec 01: Parents across Kashmir are raising concerns over the practice of private schools conducting interviews with children before granting admission to pre-nursery, nursery and LKG classes. Many parents believe this process is unnecessary and creates undue pressure on both children and their families.

While talking to News Agency, Director of School Education Kashmir Dr. Tassaduq Hussain addressed the grievances of parents, stating that the National Education Policy(NEP) prohibits conducting interviews with children.

Dr. Tasaduq clarified, “If any school is engaging in such practices, they are likely interacting with parents instead. We will address this issue in a meeting and issue clear directions shortly.”

Parents have urged the government and educational authorities to take swift action to end this practice and make the admission process fair and stress-free for young children.

Following the Director’s statement, it is expected that formal directions will soon be issued to address the concerns and ensure transparency in the admission process.

Commercial LPG cylinder prices hiked by Rs 16.5, domestic remained unchanged

New Delhi, Dec 1:Oil marketing companies have raised the prices of commercial LPG gas cylinders with immediate effect.

The rate of 19 KG commercial LPG gas cylinders has been increased by Rs 16.50 with effect from today.

In Delhi, the retail sale price of a 19 kg commercial LPG cylinder is Rs 1,818.50 from today. Prices of 5 KG Free Trade LPG cylinders have also increased by Rs 4.

Prices of 14.2 KG domestic cylinders remain unchanged.

Last month too, the rates of 19 kg commercial LPG cylinder were increased, by Rs 62.

These price adjustments are expected to impact commercial establishments and small businesses that rely heavily on LPG for their operations.

The revision comes as part of a broader trend in fuel price adjustments in response to changing global market conditions, seen in recent days due to volatile international order.

This price revision will directly impact restaurants, hotels, and other commercial establishments that utilise these cylinders for daily operations.

Despite the increase in commercial LPG prices, there has been no change in domestic LPG cylinder rates, offering some relief to households.

70% Absenteeism Found at PWD Office; Dy CM Promises Action

Jammu, Nov 28: In a scathing remark against absenteeism in government offices, Jammu and Kashmir’s Deputy Chief Minister Surinder Kumar Choudhary has vowed to take strict action against employees neglecting their duties.
The Dy CM made the statement after conducting a surprise inspection at the Chief Engineer Public Works Department (CE PWD) office in Jammu, where he discovered that nearly 70% of the staff were absent from their posts.
Speaking to the media after the inspection, the Dy CM said, “We are representatives of the people, and we are elected by the people. The earlier rule is over, and now it is the rule of the people, the rule of democracy.”
He expressed his dissatisfaction after finding that not only were many employees absent, but some of the on-duty workers also misled him regarding the absentees. “It is unacceptable that some on-duty employees lied to me about the situation, which is why those responsible have been suspended,” he stated.
The Dy CM confirmed that the Chief Engineer (CE) had been summoned to the Secretariat for an explanation regarding the absenteeism and the mismanagement in the office. He highlighted that the government was determined to uphold its commitment to the people. “This is a people’s government now, and those who do not work for the people will face action,” he added.

Mehbooba Slams Plea Filed In Rajasthan Court Against Ajmer Dargah

PDP president Mehbooba M***i on Thursday flayed a plea in a Rajasthan court claiming that the Ajmer dargah was built over a Hindu temple, saying “targeting” of mosques and shrines can lead to “further bloodshed”.
“Thanks to a former Chief Justice of India a Pandora’s box has been opened sparking a contentious debate about minority religious places. Despite a Supreme Court ruling that the status quo should be maintained as it existed in 1947, his judgement has paved the way for surveys of these sites potentially leading to increased tension between Hindus and Muslims,” she said in a post on X.

She was apparently referring to an order by a bench led by then CJI DY Chandrachud allowing the ASI to conduct a scientific survey of the Gyanvapi mosque to determine if the 17th century structure was built upon a pre-existing temple. However, the court had asked the ASI not take recourse to any invasive act during the survey.

Violence had erupted in Sambhal where a court-ordered survey of the Jama Masjid mosque was carried out following claims that a Harihar temple previously stood at the site.
“First mosques and now Muslim shrines like Ajmer Sharief are being targeted which can result in further bloodshed. The question remains – who will take responsibility for perpetuating this communal violence reminiscent of the partition days?” she added.
