*Jammu, 16-10-2020:* Re-iterating the demand for statehood to Jammu region, the activists of NPP led by Mr. Harsh Dev Singh JKNPP Chairman and Mr. Yash Paul Kundal State President Young Panthers held a massive protest at exhibition ground in Jammu today. The protesters carrying national flags and placards raised slogans of *"Peoples Alliance Hai Hai, BJP govt Hai Hai, *Jammu Pradesh ko Rajya ka darza do, darza do,* *Kashmir ke gunohon ki saza Jammu ko dena bandh karo, bandh karo”* etc.

Speaking on the occasion, Mr. Harsh Dev Singh advised the Kashmir centric leaders to stop crying over spilt milk as Art 370 and Art 35-A had become a part of history. He said that there was no question of revival of the said provisions as the matter was subjudice in the Supreme Court which alone had the right to comment or adjudicate the issue. Rejecting the Gupkar declaration and resolution of People Alliance, Mr. Harsh Dev said that the political parties should stop playing politics over the said subject and rather focus on mitigating the endless problems faced by the people in both the regions of J&K.

Asserting that Jammu Pradesh was the biggest causality of Kashmir crisis, Mr. Singh said that there was no justification whatsoever in clubbing Jammu with Kashmir and classifying it as a Union territory. “The peace loving people of Jammu region were well known for their nationalist, secular credentials and respect for country’s constitution, its integrity and sovereignty. Jammu region had remained most peaceful even when the other states witnessed violent protests, arson and bloodshed as seen during the recent CAA and NRC agitation in the country. It was however most distressing to note that it was being made to suffer only for the troubles in Kashmir and divested of even its basic rights. The 4G internet connectivity was snapped in Jammu region only because of problems in Kashmir. Statehood was snatched from us only because of issues with Kashmir. The democratic rights have been denied to us only because of adverse security situation in Kashmir and so on and so forth”, lamented Singh.

“For how long shall the people of Jammu Pradesh continue to suffer for the troubles in Kashmir. Why should we be punished for the sins of some anti India or separatist elements in Kashmir. Why should we be deprived of statehood status which the people of the dogra land enjoyed for the last around 200 years since 1846”, questioned Singh.

Cautioning the BJP govt to desist from taking the people of Jammu for granted, Mr. Harsh Dev sought early grant of statehood to Jammu region. “Let the centre decide the way it wants to deal with Kashmir. But punishing Jammu region for the problems in Kashmir is wholly unjustified and would be firmly resisted by the Panthers Party”, said Singh.

Srinagar October 11: Former Jammu and Kashmir Chief Minister Farooq Abdullah on Sunday held the Centre's decision to abrogate Article 370 responsible for the Chinese aggression at the Line of Actual Control (LAC) in Ladakh.

Speaking exclusively to India Today TV, Farooq Abdullah said that China "never accepted" the Abrogation of Article 370, and hoped that it will be restored with China's support.

"Whatever they are doing at LAC in Ladakh all because of the abrogation of Article 370, which they never accepted. I am hopeful that with their support, Article 370 will be restored in J&K," Farooq Abdullah said.

"I never invited the Chinese President, it was [PM] Modi who not only invited him, but did jhoola sawari with him. He [PM Modi] even took him to Chennai and had food with him," Farooq Abdullah said.

Further speaking on the Centre's decision on Jammu and Kashmir, Farooq Abdullah said that "what the government had done on August 5 [in 2019] was unacceptable".

Farooq Abdullah further said that he was not even allowed to speak on the problems of Jammu and Kashmir in Parliament.

Article 370, combined with Article 35A, accorded Jammu and Kashmir special status under the Constitution of India, allowing it to have a separate constitution and a separate penal code among other legal distinctions.

Parliament had passed two resolutions on August 5 last year. The first rendered Article 370 inoperative in Jammu and Kashmir by applying the power granted under the same Article of the Constitution. The second resolution was for bifurcation of the state of Jammu and Kashmir into two Union Territories -- Jammu and Kashmir, and Ladakh.

The special status of Jammu and Kashmir, and its reorganisation came into effect on October 31.

After the abrogation, top Jammu and Kashmir political leaders including Farooq Abdullah, his son and former CM Omar Abdullah and PDP chief and former CM Mehbooba M***i were put under house arrest. The Abdullahs have been released since.

Currently, India and China are locked in a tense border standoff in Ladakh. Both sides have held a series of high-level diplomatic and military talks to resolve the border row.

MHA notifies adaptation of 11 more Central Laws, 10 amended State Acts in J&K UT

Pharmacists’ issue resolved; Municipalities to have Ward Committees

JAMMU, Oct 7:Union Ministry of Home Affairs (MHA) has issued orders for adaptation of 11 more Central Laws and 10 amended Acts of the erstwhile State in the Union Territory of Jammu and Kashmir with immediate effect. With this, the number of Central Laws having been adapted in the Union Territory has increased to 48 as 37 legislations were extended in the month of March this year.

The adaptation of more Central Laws has been ordered by the Department of Jammu, Kashmir and Ladakh Affairs in the Ministry of Home Affairs in exercise of the powers conferred by Section 96 of the Jammu and Kashmir Reorganization Act, 2019.
As per the Union Territory of Jammu and Kashmir Reorganization (Adaptation of Central Laws) Second and Third Order, 2020 issued by Union Home Secretary, Ajay Kumar Bhalla, the General Clauses Act, 1897 applies for the interpretation of these orders as it applies for interpretation of laws in force in the territory of India.

The provisions of these orders shall not render invalid any notification, order, commitment, attachment, bye-law, rule or regulation duly made or issued or anything duly done before October 31, 2019, the Union Home Secretary has clarified in the orders.

“It is necessary to adapt the Central Laws made under the Concurrent List, with required modifications and amendments, for ensuring administrative effectiveness in the Union Territory of Jammu and Kashmir thereby removing any ambiguity in their application in line with the Constitution of India”, he said.
Besides 11 Central Laws, 10 laws which were framed by the erstwhile State have also been adapted after making necessary modifications as suggested to the Department of Jammu and Kashmir and Ladakh Affairs of the MHA by the Government of Union Territory.

The 11 Central Laws which have been adapted are the Pharmacy Act, 1948; the Banning of Unregulated Deposit Schemes Act, 2019; the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996; the Contract Labour (Regulation and Abolition) Act, 1970; the Factories Act, 1948; the Industrial Disputes Act, 1947; the Industrial Employment (Standing Orders) Act, 1946; the Motor Transport Workers Act, 1961; the Sales Promotion Employees Act, 1976; the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and the Trade Unions Act, 1926.

As far as Pharmacy Act of 1948 is concerned, the MHA has created a special provision regarding persons registered under the Jammu and Kashmir Pharmacy Act, Samvat, 2011.

The new section in the Central Act states: “Notwithstanding anything contained in Section 32, any person whose name has been entered in the register of Pharmacists maintained under the J&K Pharmacy Act, 2011 and possesses qualification prescribed under the Act shall be deemed to have been entered in the register of Pharmacists prepared and maintained under Chapter IV of the Central Act subject to an application to be made in this behalf within a period of one year commencing from October 31, 2020 and payment of such fee as may be prescribed by the Government of Union Territory of Jammu and Kashmir”.

It is pertinent to mention here that majority of the Pharmacists were registered under the repealed Jammu and Kashmir Pharmacy Act on the basis of Matriculation and therefore don’t qualify for registration under the Central Pharmacy Act, 1948 wherein a degree or diploma in pharmacy or pharmaceutical chemistry or a chemist and druggist diploma is mandatory.
Now, the MHA on the request of J&K Government has inserted special provision as a result of which there is no threat to the livelihood of the Pharmacists.
As far as Central Laws relating to contract labour, factories, industrial disputes, industrial employment, motor transport workers and sales promotion employees are concerned, amendments have generally been carried out regarding compounding of offences.

The laws of erstwhile State which have been adapted in the Union Territory of Jammu and Kashmir after necessary amendments are J&K Municipal Act, 2000; J&K Municipal Corporation Act, 2000; the Jammu and Kashmir School Education Act, 2002; the J&K Board of School Education Act, 1976; the J&K Cooperative Societies Act, 1989; the J&K Self-Reliant Cooperatives Act, 1999; the Salaries and Allowances of Members of J&K State Legislature Act, 1960; the Salary and Allowances of Leaders of Opposition in the State Legislature Act, 1985; the J&K Goods and Services Act, 2017 and the J&K Metropolitan Region Development Authorities Act, 2018.

Under the amended J&K Municipal Act and J&K Municipal Corporation Act, there is a provision for constitution of Ward Committees for monitoring the functioning of schools, maternity centres, dispensaries and health centres wherever they are under the control of the Municipality. Moreover, Area Sabha will be constituted to formulate proposals and determine the priority of schemes and development programmes to be implemented in the respective areas.

The amendments in the J&K Board of School Education Act have been carried out to further streamline the functioning of Board. Moreover, under the amended Act, any institution in or outside the Union Territory may apply to the Board for being admitted to the privileges of the Board
In the GST Act, insertions have been made with regard to facility of digital payment to receipt, procedure for furnishing return and availing input tax credit, utilization of input tax credit subject to certain conditions, order of utilization of input tax credit and power of Government to extend time limit in special circumstances.(By Daily Excelsior)

Shopian, Oct 07: Two militants have been killed in a night long encounter between government forces and militants at Sugan village of Zainapora belt in South Kashmir's Shopian district.

A senior police officer told that two unidentified militant have been killed while as seaech operation is on in the area.

He added that militants were repeatedly asked to surrender, however, they refused to do so and fired upon forces which was retialated resulted in killing of two militants.

Earlier an official said that a joint team of Police, army's 44 RR and CRPF launched a cordon and search operation on specific information about the presence of militants in the area.

He said that as the joint teams of forces approached towards the suspected spot, the hiding militants fired upon them which was retaliated, triggering an encounter.

*Bi-Annual Durbar Move*

*Move Offices to close in Srinagar on Oct 30, reopen in Jammu on Nov 9*

SRINAGAR, OCTOBER 06: As part of bi-annual Darbar move, the Civil Secretariat, seat of Jammu and Kashmir government, along with other offices will close here on October 30 and reopen in the winter capital Jammu on November 09.

According to an order issued by General Administration Department, the Government offices observing five days week shall close at Srinagar on October 30, 2020 (Friday) after the office hours and the offices observing six days week shall close at Srinagar on 31 October 2020 (Saturday) after the office hours and reopen at Jammu on November 09 (Monday), 2020. All the departments shall ensure that records are packed in boxes after working hours on last working day in Srinagar.

It has been ordered that the offices moving in camp shall carry only 33% of the strength of staff in that particular office or with 10 officials whichever is minimum.

All Departments have been asked to send their advance parties on 23 October 2020 (Friday) consisting of one Gazetted Officer and four to five Non-Gazetted Employees who will receive the records at Jammu. The departments shall ensure that boxes are properly locked and their keys reach the advance parties at Jammu well in time. The S.S.P. Security, Civil Secretariat will furnish a list of defaulting departments in this regard to the General Administration Department.

J&K RTC has been asked to make available sufficient number of buses in good condition for transportation of Jammu based employees on 31 October and 1st November and Kashmir based employees on 7th and 8th November 2020. The booking of buses shall be for the destination of the employees wherever feasible. Tickets shall be issued by RTC in advance i.e. from October 20th, 2020 both from Civil Secretariat as well as from the main booking counters of RTC.

J&K RTC will also make available trucks for shifting the records from Srinagar to Jammu. The trucks shall be requisitioned by the departments from J&K RTC and the departments shall draw advance for meeting carriage and package charges. The trucks shall be allowed to enter the Secretariat premises after 5.30 P.M on the last working day. Loading of records in the offices located outside the Secretariat premises, observing six days week, shall take place after working hours on the last working day. The loaded trucks shall leave for Jammu on 1st November, 2020 in a convoy. J&K RTC will also ensure that one Crane, two empty Buses and two empty Trucks accompany the convoy on the respective days so that the employees do not face inconvenience due to any break down of buses/trucks on the way. Mobile workshop shall also accompany the convoy.

It has been ordered that the S.S.P Security, Srinagar will supervise packing/ loading of records of the officials located outside the Secretariat from Security point of view and issue clearance certificates to the drivers who in turn will show them to S.S.P. Security Civil Secretariat to allow them to be included in the convoy. The S.S.P Security, Civil Secretariat will ensure entrance of trucks/records in the Civil Secretariat, Jammu/Srinagar after proper scrutiny.

It has been ordered that Police shall es**rt the ‘employees’ and the ‘records convoy’ all along the route up to their respective destinations. They will also make sure that the move convoy is given precedence in crossing the Jawahar Tunnel. The Director General of Police, J&K will issue necessary guidelines to the field agencies accordingly.

Health & Medical Education Department shall make arrangements for COVID-19 Rapid Antigen Test of all the employees of Civil Secretariat Srinagar who are shifting to Jammu in connection with the Annual Darbar Move (Winter Season). Further, any employee testing positive in the Rapid Antigen Test shall resume duties at Jammu only after testing negative.

The Health and Medical Education Department shall plan for medical aid facilities at various places including Qazigund, Banihal, Ramsu, Ramban, Udhampur and Jajarkotli, on the days when the employees travel from Srinagar to Jammu. Financial Commissioner Health and Medical Education will issue necessary instruction in this behalf to the Directorates of Kashmir and Jammu Divisions accordingly.

It has been ordered that no moving employee shall occupy any Government/EP/Municipal residential accommodation except under proper allotment order. Moreover, the move employees can retain the Government accommodation allotted to them at Srinagar for bona-fide use of their families under intimation to the Estates department on applicable terms and conditions.

The moving employees having Ration Cards at Srinagar shall surrender the same to the Director, Consumer Affairs and Public Distribution Department, Srinagar and obtain a surrender certificate. The Director, Consumer Affairs and Public Distribution Department, Jammu shall issue Ration Cards to move employees at Jammu on the opening of the Offices. The employees who desire to move without families may retain the Ration Cards at Srinagar for the Winter Season.

Special Move T.A shall be paid at the uniform rate of Rs. 25,000/-per employee. This shall be drawn and disbursed in advance. Special move T.A shall not, however, be payable to such of the employees who do not move within the prescribed time. Advance pay is also authorized in terms of Rule 14.26 of the J&K Financial code (vol-1) in favour of such of the Non-Gazetted moving employees who may apply for the same which shall be recoverable in installments as per rules.

The Salary for the month of October, 2020 in respect of all the employees working in moving offices shall be drawn on 23rd of October, 2020.

No leave shall be admissible in combination/continuation of move days except in very exceptional circumstances. The concerned Administrative Secretaries shall sanction leave whatever due to the employees on very exceptional circumstances. It has been also ordered that all the Administrative Departments shall detach the staff if any, attached by them from subordinate offices of Kashmir division.

The office timing on the reopening of the offices at Jammu shall be 9.30 am to 5.30 pm in respect of Civil Secretariat and heads of department located within the Civil Secretariat premises and 10 am to 4.30 pm in respect of all moving Departments located outside the Civil Secretariat and observing six days a week.
