DIFFERENCE RIGHTS OF RICH AND POOR PEOPLE TO QUR'BAN MEAT
Ulama Syafi'iyyah affirm that the Qurban received by the poor had the status of TAMLIK (giving full ownership rights). The qurban they received became their property in intact. Therefore, he is ALLOWED to allocate the Qurban he receives FREELY, by selling, donating, give alms, eating, serving guests, and so on.
While the Qurban received by a rich person does not become his property in full, he is only allowed to receive Qurban for consumptive allocations. Therefore, rich people are only allowed to eat and give to other people to eat, such as being served or donated to guests. IT IS NOT ALLOWED for RICH PEOPLE to sell, donating, make one's wills, or any similar allocation that gives full rights to the given party.
In the books of al-Tuhfah and al-Nihayah
submitted that:
"For the poor, it is permissible to use the Qurban that was taken (freely) even if by selling it to a Muslim, because he has it. Not like a rich person, he is not allowed to sell it, but he is only allowed to allocate the Qurban given to him in the form of food, alms, and serve it even to the rich, for at its peak he is like the person who doing the qurban himself."
