Hon. Justice Basiru V.P Mahoney of the High Court of the Gambia has found Sanna Fadera, the first accused, guilty of committing treason. The Judge ruled that the evidence showed that Fadera prepared and endeavored to overthrow the government of the Gambia by unlawful means.

However, Gibril Darboe (second accused), Ebrima Sannoh (third accused), and Fa Bakary Jawara (fifth accused) were acquitted and discharged of treason, concealment of treason, and inciting mutiny.

EULOGY FOR BARRISTERS WILFRED DAVIDSON ABIMBOLA CARROL AMD DR. HENRY DARLINGTON RICHMOND OLUWOLE CARROL

When the sudden deaths of Barristers Wilfred Davidson Bola Carrol and Dr. Henry Darlington Richmond Oluwole Carrol was announced, there struck a deep and solemn note in our lives that resonated far and wide and cause a sombre reflection amongst many. The transient spectrum of mortality invoked in so many of us a spark that presented the solemnity of mortal existence, in all its splendour and glory, pain and sorrow, fortitude and serenity.

The erudite playwright and Victorian poet, William Shakespeare in his play Julius Caesar skilfully captured and summed this beautifully in the entrant verse:
“What can be avoided Whose end is purposed by the mighty gods? Yet Caesar shall go forth; for these predictions Are to the world in general as to Caesar. When beggars die, there are no comets seen; The heavens themselves blaze forth the death of princes.

Cowards die many times before their deaths; The valiant never taste of death but once. Of all the wonders that I yet have heard. It seems to me most strange that men should fear; Seeing that death, a necessary end, Will come when it will come.”

With immense pain, sorrow and regret I stand before you all to eulogies the lives of two great men whose star shone over the horizons of the Gambian River, a little over 6 decades ago.

Two outstanding quintessential gentlemen who undoubtedly, are amongst the greatest and finest legal scholars of our generation and time.

Sir Bola as I fondly called him was a big brother who I recalled growing up as a child in his company and presence. It was a religious rite of passage that every Sunday in those days, after attending Sunday service at Wesley Church, we will all go to Carrol k***a in Buckle Street packed like sardines In my aunty, Aunty Princess’s Renault 18. We would have amazing moments with Aunty Daisy spoiling us with all manner of goodies. It was a tradition that was kept way into my adult years and when I look back with great fondness, I can actually say, those were one of the most memorable moments of my life.

I and Bola grew very close and I would spend many evenings at his home in To***co Road where he then resided, whilst basking in all his legal text and writings. I can authoritatively say that it was then, during those formative years of my life, that my love and passion for advocacy and the law was born.

Bola also was a phenomenal poet who introduced me to various literary works of great poets but most notably the literary giants of the African renaissance.

Some 27 years ago, right in this very church, under the direction and impeccable tutelage of Wilfred Bola Carrol, I performed one of the greatest poems of renowned poet and literary giant, David Diops “Africa my Africa”.

Not only did Bola mentor me to perform this poem with all its dramatic effects, but it was an unprecedented moment when he actually got me, to do a rendition of this poem in typical Senegalogambian Wolof dialect and indeed it was a masterpiece and up to this day, individuals such as Aunty Annie Belle and a few others will call me “Tenkem Tenkem” which was one of the phrases that Bola taught me to represent the English word Obstinately.

I have performed this poem in colleges in America, Universities in Geneva and Oxford and it has always remained a sensation and I can only credit this excellent delivery to non other but the poet extraordinaire , the versatile International Bilingual Defence attorney, Wilfred Davidson Bola Carrol Esq.

Due to reason I may never be able to recall I and Bola slowly drifted whilst Lord Carrol and I slowly became closer. This might have been as a result of Bola being out of the country most times and then moving away from Banjul to Bakau. Whatever reason it was I saw myself growing closer to Dr. Carrol and this bond could best be described as electric.

Dr Carrol and I would spend hours in his office going over legal texts and I was his ardent proof reader. He would make me sit and read his articles and most times I’d correct grammatical errors which obviously would lead to bitter arguments as he would swear to all things dear to him that it was a typographical error. Eventually, I made sure I had witnessessr around and I would either take my friend F***y Mahoney or Kaddijatou Jallow along. I would then decide to keep reading through the text and not make a single comment. Then cheekily I’d ask, "Dr carrol were those your words as captured by the typist or did she add anything to it? He would quickly say "oh those are my words, the typist try this tem" and after saying this, I will then go on to mention all the errors that I had come across and he would argue bitterly that definitely the typist added those in there. "You nor sabi them wan ya so how them arnyan rek." To which I’d say “Dr. Carrol, to borrow your words, Eat the humble pie and accept you made an error." He will bellow with a big hearty laugh and then say “Olufemi you na smart boy but I put it to you “ that okro nor ba long pass im master.”

When I visited The Gambia last, and by which time I had already gotten my first Masters degree from the University of Oxford. As i was approaching Dr Carrols office, and he spotting me through the side window of his office, he yelled here comes the 3rd Gambian Oxford- trained lawyer. I laughed and said to him But Dr. Carrol as far as records hold at the University of Oxford I am the 1st Gambian lawyer to be matriculated into the Oxford University. Your grandfather was the first to be matriculated but not as a lawyer but as an undergrad. I then turned around and said to him but wait a minute, am a bit confused here. Where do you come in with all this rank and first or second in line when we talking about Oxford University? He quickly replied:

"Olufemi Roberts are go sue you for defamation. I put it to you that my grandfather is the first Oxford trained lawyer then his grandson Henry Davidson, which is my humble self and then you follow as the third." Being my true self, I didn’t want to give in, so I quickly responded but Dr Carrol your name is not in the records held at the University of Oxford.
What followed was a famous Land -Law Latin maxim:

“Quic Quid Planta tur solo, solo cedit.”
Olufemi I put it to you that that I studied at the university college of Buckland in Oxfordshire and therefore as the Latin maxim suggests “what ever is affixed to the soil belongs to the soil and therefore I am an Oxford trained lawyer period”.

Today, before everyone, I want you to know that not only are you the original Oxford trained lawyer , but you are undoubtedly one of the most prolific legal scholar of modern times and I say this with much admiration and pride. I now concede that your grandfather was the first, you the second and I the third. I know absolutely, that I may never be able to untie the lace of your legal sandals because there would never ever be another Dr. Richmond Darlington Oluwole Carrol.

Today Dr, I salute your courage, I applaud your brilliance and mastery of the substantive Law, I recognise your unparalleled and unmatched passion for defending and upholding the dictates of equity, justice and Human rights for all but above everything else , I salute your strength of character, that had undoubtedly etched your scholarship as one of the greatest legal scholars of our generation that this country thus far has produced.

Your brilliance and scholarly work will live on and generations will remember thee with much admiration and pride. Your dedication and unwavering passion for the relentless pursuit for justice shall not die but forever remain in our hearts.

I praise you great man of skill, who helped the right and fought the wrong, and indeed made our folk a nation. In peace your sacred ashes rest , fulfilled your days endeavours. You have blessed the earth and you are blessed, of God and man forever.

I have come to that end where I must sign off and I do so with pain, sadness and a very heavy heart. And so on this 27th Day of October In the Year of our Lord Two Thousand and Twenty Three, I say please Sir Dr. Henry Darlington Richmond Oluwole Carrol, LLB BL LLM PHD MRG Founder Lecturer University of The Gambia, Oxford scholar, Latin Guru, astute theologian, solicitor General emeritus, former Chairman law reform commission and most definitely the one and only tripple Dr. Please accept the sincerest assurances of my deepest considerations and most fraternal prayerful wishes, that your gentle, benevolent and extraordinary but unique soul, will rest in eternal peace till we meet again someday, taking our place yet again in the Bar, whilst our creator and Judge of all judges, adjudicates from the heavenly Bench.

Delegatus non potest delegari , one of your favourite quotes came to mind as I warned Isha, as she is tasked to read this tribute on my behalf, that she who has been delegated cannot herself delegate.

BORA SUES GOV’T, IGP FOR D7M

Popular comedian Alagie Sissawo, commonly known as Bora, has filed a civil suit against the Attorney General and the Inspector General of Police for illegal detention and violation of his fundamental rights.
Bora is asking seven million dalasi as damages for detaining him beyond the constitutional limit.
Represented by Dandimayo Chambers, Bora also seeks the court to order the police to return his iPhone 13 Pro Max with immediate effect.
Alagie Bora was arrested on 13th August and released on bail two days later but his bail was revoked and he was re-arrested on 4 October.
He was then kept in police detention for a week.
In his affidavit, Bora said while being released from detention, the police pushed him into a pool of dirty water at an unknown location at night.

Breaking News!!

Madi Jobarteh has been released on bail, secured by one Gambian surety and a bail bond of D100,000. He is required to present himself at the SIU In Banjul on 26th October 2023. Currently, no charges have been filed against him.

Madi Jobarteh's health took a concerning turn on Tuesday afternoon while in detention at anti crime unit and was taken to the Westfield Clinic . It’s worth noting that the security personnel have been stationed at the Clinic to limit access to him.

This morning his lawyers met officials of the SIU at the clinic to finalize the bail.

Brikama Area council suspends seven people

FROM: CHAIRMAN’S OFFICE
TO: ESTABLISHMENT SUB-COMMITTEE
Re: Chairman’s recommendation for the suspension of the following Staff Members
In line with the objectives of the new Council to combat corruption at BAC, this office writes to make the recommendation for the indefinite suspension of the following persons listed below until a thorough and impartial investigation can be conducted into the allegations and for the reasons expounded here under.

1. Mr. Alhagie Jeng
2. Mr. Sulayman Jeng
3. Mr. Malick Jeng
4. Mr. Omar Saidykhan
5. Bai Sait Jeng
6. Ebrima Jallow
7. Muhammed Ebrima Jallow

1. Mr. Alhagie Jeng- the Director of finance:
Mr. Jeng has had many members of his family employed or enrolled on the council’s payroll without following due process for their employment; which is that their employments were not confirmed by the Establishment Committee. In fact, his son, Mr. Bai Sait Jeng; is on Council’s payroll and found collecting Council revenue, which has never been submitted to Council.

I further have every reason to believe that, that was not first time his son had done such and would have continued to do the same, if not sheer luck for the Council and the patriotic citizens of the region, who have reported him to us, we would have never known about his collection.
We further do not know who his son had accounted to for the monies he had been collecting, as his name is not even on the list of revenue collectors, who are required to report to the council on a weekly basis.

I further do not know how many other people are engaging in such dubious activities in cahoots with the DFS without the Council’s knowledge.

Furthermore, the DFS has deliberately ensured that his son, Sulayman Jeng, and nephew, Malick Jeng, are responsible for the collection of the most lucrative revenue bases of the council, which is assigned to Sulayman Jeng and valued properties to Malick Jeng. All these assignments were done without due process.
Additionally, under his watch, as DFS, his brother in law, Omar Saidykhan, has been responsible for withdrawals of over D5,000.00 in 2023 alone, which has not been accounted for, meaning they were withdrawals, which were not backed by vouchers to justify them.

The internal Audit, as part of their assignment by General Council Resolution of July 2023, made several requests for the justification of such withdrawals but to no avail.
We further believe Mr. Jeng, have either deliberately or otherwise, and failed to hold his revenue collectors accountable for their deliberate refusals to account for their weekly collection. This has now forced the council to make late payments of salaries and on that current trend; we would soon be forced to default in salary payments.
Thus, an urgent action is needed to remove Mr. Jeng from his post, in order thoroughly investigate Mr. Jeng and to put his department for the progress of this council.

2. Mr. Sulayman Jeng:
Mr. Jeng was employed without due process but through nepotism, simply because of his relations to the DFS.
Sulayman has also been implicated in the fraudulent collection of his brother Bai Sait Jeng.
Sulayman has also failed to make any submissions for the months of the September 2023. This means he has been suppressing revenue for the months of the September resulting in our late payment of salaries.

3. Malick Jeng:
Mr. Jeng was also employed without due process but through his relations to the DFS.

Despite being responsible for the collection of valued properties Malick only accounted for D6, 000 on 16th August 2023 and D2,000.00 on 24th August 2023. This is the only D7,000.00 he accounted for in the whole month of August 2023 and made Zero (0) submission in the whole month of September 2023. Therefore, by suppressing our ability to pay salaries and registered any development in this country.

4. Omar Saidykhan:
Mr. Saidykhan is also employed to the council, without due process except due to their relations to the DFS.
Mr. Saidykhan also made the following withdrawal from the council’s vista Account on 7th June 2023: D72,000.00; D63,000.00; D450,000.00; D450,000.00; D67,500.00; on 8th June 2023: D 125,000.00.
In GT Bank: 13th June D 71, 000.00 on 15th June 2023 D1,700,000.00; D 1,000,000.00.
These withdrawal for the month of June alone 2023 are all unaccountable for. Thus, he needs
to be immediately suspended pending through investigation.

5. Bai Sait Jeng:
Mr. Bai Sait Jeng has been enrolled on the Council’s payroll without the proper process, but simply because of his relations to his father.
His issue came to the attention of the council after he was reported to a council of collecting license revenue of the council. The particular member of the Council intercepted him, during which he confirmed that he was collecting Council’s revenue.
However, his name is not on the list of council’s revenue collectors and thus was never accountable to council’s auditors and has never made any payments to the council for any revenues, he had collected.
In fact, when Bai Sait Jeng was summoned by the Finance Committee, he confessed that he is not a Council staff and does not receive Council salary, despite him being on the payroll and being paid on a monthly basis. On the collection of revenue, he claims he has been accompanying his brother Sulayman Jeng. However, the date in question that he was caught collecting he was not with brother, Sulayman Jeng.
Thus his account of what is happening is not accurate and the fact he is on our payroll without his knowledge, is very implicating for his father, Alhagie Jeng.

6. Ebrima Jallow:
Ebrima Jallow is the acting manager of License and we have already submitted a separate report to the establishment regarding Ebrima Jallow printing revenue invoices outside of the

council without the knowledge of the procurement department. This is clear violation of all the protocols and rules.
Mr. Ebrima Jallow is also found to have enrolled his son, Mr. Muhammed Ebrima Jallow, on the Council’s payroll, who is receiving salaries, but has never worked for the Council.
There is also information received by Chairman’s office implicating Mr. Ebrima Jallow of receiving License fees, which were not accounted to Council. Mr. Ebrima Jallow also confirms that he has been collecting in the field, but has not been accounting such revenues to council, as his name is not on the audit weekly collectors list. He claimed to be doing this in line with Sulayman Jeng, but Sulayman has not been paying anything to the council and has only made a total payment of only D12,000 to the Council for the months of August and September (31 August 2023 – D9,000.00 and 7 September 2023).

7. Muhammed Ebrima Jallow
Muhammed Ebrima Jallow is only in our payroll, because his father put him there, but he is not a staff of the council and that already been confirmed.
Thus, I recommend for his name to be removed from our payroll with immediate effect.
8. Seven Additional Revenue Collectors:
These license revenue collectors are:
1. Alfusainey Colley
2. Assan Jassey
3. Binta Fatty
4. Buba Jabang
5. Famara Sanyang
6. Kebba Jammeh
7. Momodou Lamin Saidykhan
All these collectors are found to have suppressed our revenue for the months of August and September 2023. For example for the period of 31st August 2023 - 6th September 2023:
Mr. Alfusainey Colley, claimed to have collected D44,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D14,000.00 into the account.
Mr. Assan Jassey, claimed to have collected D300,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D0.00 into the account.

Ms Binta Fatty, claimed to have collected D23,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D13,000.00 into the account.
Mr. Buba Jabang, claimed to have collected D23,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D0.00 into the account.
Mr. Famara Sanyang, claimed to have collected D135,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D0.00 into the account.
Mr. Kebba Jammeh, claimed to have collected D61,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D46,000.00 into the account.
Mr. Modou Lamin Saidykhan, claimed to have collected D71,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D46,000.00 into the account.
Mr. Sulayman Jeng, claimed to have collected D423,000.00 and paid it into the Council’s ECO bank account, but the ECO Bank Account Statement for the same period proved that he only paid D3,000.00 into the account.
And the same trend has happened for the whole month of September and August is even worst.
RECOMMENDATIONS:
Thus, I would recommend for the above persons to be suspended without leave with immediate effect:
1. Mr. Sulayman Jeng
2. Mr. Malick Jeng
3. Mr. Omar Saidykhan
4. Bai Sait Jeng
5. Ebrima Jallow
6. Muhammed Ebrima Jallow
We further recommend the suspension of the Seven Revenue collectors, but pending their successful transfer of their collected data to their succeeding officers.
The Director of Finance has notified the Chairman’s office that he has sought for request for transfer to another Municipal Council.

Hello Borra La Duula Molu,

As you must’ve heard or seen online, Alhagi Borra mentioned the efforts of Police Officer Alieu Jawara and the investigative team to grant him bail.

They’re planning to reinstate the same conditions that were abruptly revoked six days ago, and he has remained uncharged during all this time. As part of this new police bail arrangement, they have requested him to surrender his phone.

However, His legal representatives are firmly advocating against surrendering his handset, given that they have initiated a lawsuit at the High Court seeking his unconditional release.

They argued that since he is not facing any criminal charges, he should not be compelled to surrender his phone under any circumstances. Alhagi Bora is strongly refusing to leave the police station without his phone, asserting that he has not been accused or charged with any wrongdoing.

We will keep you posted as soon as we get anymore information.

Police Surveillance on Madi Jobarteh

Since this morning Police vehicles are loitering around my neighborhood and officers walking up and down the street near my house. They are there purposely for me as my family and neighbors have identified the same vehicle that brought officers to my house on Friday. Earlier in the morning I saw a missed called from ASP Sulayman Gaye who had led officers to my house on Friday. I am neither a criminal nor a fugitive to warrant such harassment and intimidation.

For that matter I just have sent this message to ASP Sulayman Gaye to tell him to stop harassing and intimidating me.

“Mr Gaye. I want to ask you to stop harassing and intimidating me. I have not violated any law and I have not committed any crime and I am not a witness to any violation or crime. Therefore remove your vehicles and officers from my vicinity. Do not put me under any surveillance. We are not in a police state. I am sick with a severe illness and I need my time and space to recover. You are putting unnecessary strain on myself and on my family. Your actions are totally unlawful and abusive. So once again, I urge you to stop harassing and intimidating me. Remove your vehicles and officers from my neighbourhood. The police are meant to protect rights and uphold the law and not to damage them.”

Alhagi Bora Sisawo was taken into custody 36 hours ago, following the revocation of his bail. Prior to his arrest, he had diligently adhered to the bail conditions, consistently reporting to the police as required. Regrettably, his family and legal representatives have been unable to locate or establish contact with him since his apprehension.

As you may all notice by now, Borra’s bail has been revoked this morning and he have now surrendered himself to the authorities at the Kairaba police station.

We do not really know the full accounts to the revocation but we are working towards it and we will keep y’all posted as soon as we know what’s going on.

Who killed the Cops?

In pain they bow while their comrades are being lowered into their graves. Their only crime was to be uniform to defend and protect Gambians and residents of the Gambia. One of them probably because his name was Pateh. Their death surrounded by lies and politics. We condemn, became saddened without thinking. While I took time to listen to all parties (a) Mama the Lady in Cassamance (audio encounter with Ousainou Bojang + another person), (b) The President (security council), (c) government spokesman Sankareh, (d) Nfamsu Bojang (Ousainous brother), (e) Facebook postings of some UDP members who spoke about police excesses, I ask the question who killed the cops?

First, there are several questions that came to mind, and I will try to pin them here with my doubts.

1. Sankareh told us that Ousainou Bojang is the suspect and he works for Brikama Area Council and the intention was to kill a dozen of officers. The government has all the authority to verify such before saying things that are not true. But one thing is true, he has a motive and a direction he wanted to pitch for our consumption—the UDP is the direction of his statement. Why did he lie to us? Who gave him that information? He said the police, why did the police lie? We have seen Presidential advisers took the same direction as soon as the incident was announced. What are they feeding the President with? Do they know something we don’t know?

2. Sankareh told us that the police got footages of Ousainou at the UDP Yanks Dabos case in Banjul. Can Sankareh prove this? Still trying to associate Ousainou to the UDP.

3. The President said it was a plot to intimidate his government and the security. But who seeks to intimidate his government & the security? This statement was before the apprehension of Ousainou. How did the president get to that conclusion? What’s the direction of his statement? What are they telling the President?

4. The police told us that they followed the phone signals from point A, B , C till Cassamance and upon arrival a gentleman was handed to them whom they didn’t know at a time. But they know his number? Does that make sense? How can you tap the signal prior to knowing the suspect?

5. The police told us that Ousainou was in possession of the gun on the day of the UDP protest/court case in Banjul but failed to tell us where he was in possession of the gun, either in his house, Banjul, in court or amongst the UDP crowd. Again trying to associate to the UDP.

6. Some UDP members posted about the police excesses and pointed out some names including Pateh Jallow (Elo Jallow’s brother) but a different Pateh was killed. Was killing a Pateh part of the plot? Connect the dots and ask, who killed the cops? Could this have been staged? I wonder with my spirit telling that Gambians aren’t that evil but my consciousness of geopolitics and what positive and power could mean to some.

7. The car that was in circulation isn’t Ousainous but belongs to a state operative I heard. How was that car at the crime scene? Who owns the car? Why was it said that was the used car?

8. The killer must be a gun mastermind to be able to give no chance of survival shots to the two. Is Ousainou a gun expert? Is Ousainou a rebel? That one left my eyes and mouth wide open. I didn’t know you can be in Brufut all your life and still be a rebel. But the Gambia today, if you are a mandinka, you are UDP and if you are a Jola you are either APRC or a Rebel? Is Ousainou a rebel as the police told us? Remember we went to school with him, grew up with him to this day. He isn’t a stranger to us.

9. In the audio with Mama, was there at any point that Ousainou said he killed anyone? Seemingly, Mama was on a topic of her own and Ouzo was talking about his family and his white lady. Did Ouzo confess to killing in that audio? Take a second listen with care because he didn’t. So why Ouzo?

10. Where was Ousainou that night? Was his brother Nfansu not truthful? Where did they recover his clothes? Who identified that those were the clothes of the shooter and they belong to Ousainou?

11. If Ousainou was/is a rebel why was he looking for a marabout for his problems or seeking refuge in strangers when he could go back to his colleagues who are notorious for killings?

11. Where is the gun used to kill? Will it ever be found?

Someday, these folks will get justice. At this point, i hope it is not what minds are thinking.

Sheriffo Baiyo Sonko Detained At Kanifing Police Station And On Hunger Strike!

Sheriffo Baiyo Sonko, the nominated councilor for Transport at Brikama Area Council, has reportedly begun a hunger strike while in detention at Kanifing Police Station. Sonko was summoned for questioning on Friday afternoon and has been in custody since.

According to credible sources, Sonko has steadfastly declined any sustenance offered by the police and his family members. His intention is to abstain from food until he is released.
