THE STATE VS BUBACARRR KEITA
The Judge entered the courtroom at 14:36. The clerk announced the case as state vs Bubacarr Bob Keita. The judge then warned the audience to maintain silence and no noise.
The State prosecutor Kimbeng K. Tah took the floor and announced himself for the state along with Alsanna Jobe and Patrick Gomez.
Lamin LS Camara also took the floor and introduced himself alongside F. Jallow for the accused person.
He was then asked by the Judge to move his motion. In moving the motion, Lamin S. Camara, Counsel for Bubacarr Keita alias “Bob” informed the court that the defence team is ready to proceed with the motion dated 18th July, 2022, subject to the direction of the court.
According to Counsel Camara, one of the requests stated in the motion is for the ruling of the Bundung High Court on the 7th July, 2022 to be set aside; adding that they also want a stay of execution of the said ruling pending the hearing and determination of the appeal filed at the Gambia Court of Appeal.
“My lord there is a motion before this court, dated on the 18th of July, 2022 and returned on the same day. The said motion is seeking for four prayers and under prayer 1 and 2 are in the alternative to prayer 3 and 4,” said Counsel. My Lord the motion are almost the same, 1 and 3 and 2 and 4 vice vie, he added.
Lawyer Camara further submitted that the motion is supported by 45 paragraphs Affidavit, sworn by Babucarr Keita, the accused person. “We are relying on all the paragraphs contained herein, particularly paragraphs 4-45. My lord attached to this application, are two exhibits BK1, which is the ruling of this honourable court of Thursday, 7th July, 2022, which is sought to be set aside and or stay. There is also attached to this Affidavit my lord Exhibit BK2 which is a notice of appeal to the Gambia Court of Appeal against the decision of this honourable court which is Exhibit BK1.
