MORUPISI FILES RECUSAL APPLICATION AGAINST SOME JUDGES

The Court of Appeal has just resumed the case in which the Public Prosecutions is challenging the decision by the High Court to release former Permanent Secretary to the President Carter Morupisi from prison.

The court had adjourned this morning after the Morupisi legal team indicated that it was making an application for some of the five panel of the judges to recuse themselves.

Justices Isaac Lesetedi, Leatile Dambe, Edwin Cameron, Johan Froneman and Goemekgabo Tebogo-Maruping are presiding over the matter.

MORUPISI BACK IN COURT TODAY

Carter Morupisi, the former Permanent Secretary to the President, who has been convicted and sentenced to seven years in jail, is scheduled to be back in court today.

He has been dragged to court by the state, which is appealing a decision to reverse the sentence by the High Court on grounds that he was sentenced unfairly.

Morupisi was serving a sentence for money laundering and corruption after being found guilty, given a suspended sentence which he unsuccessfully appealed to end up with a stiffer sentence of seven years.

He challenged Judge Walia’s judgement, saying the judge violated his constitutional right of a fair justice. The state then filed an application to have the appeal heard expeditiously.

Judge Mercy Garekwe declared of the Court of Appeal that the request by the State to hear the case on the decision to free Morupisi jail was urgent and must be heard fast.

She warned that the decisions by Justices Zein Kebonang and Reuben Lekorwe to release Carter Morupisi from prison have seriously dented the integrity of the Judiciary and the country as an investment destination.

She said that if left unchallenged the public confidence in the judiciary will diminish, and there will be chaos as the supremacy of the Court of Appeal will be undermined.
